Who Fox Varian Is
Varian, who lives in Yorktown Heights, New York, was assigned female at birth. She grew up through her parents’ separation and a lengthy custody fight, moved between schools, and has a history of depression, anxiety, social phobia, autism, and disordered eating.5Alliance Defending Freedom. At 15, while in therapy with Einhorn, she began questioning her gender identity. Within roughly two months, she changed her name twice, cut her hair short, started binding her breasts, and began identifying as transgender.6The Free Press. Varian has said the regret was immediate. “I immediately had a thought that this was wrong, and it couldn’t be true,” she told interviewers. “I felt shame. What the Lawsuit Claimed
Varian filed suit in September 2023 in Westchester County Supreme Court as Varian v. Einhorn, No. 61150/2023. The Expert Witness the Defense Didn’t Expect
The plaintiff’s most consequential witness was Dr. Loren Schechter, president-elect of the World Professional Association for Transgender Health and head of gender-affirming surgery at Rush University Medical Center. Schechter testified that Chin should not have operated, saying “a reasonable surgeon would have put on the brakes.” He also testified that Einhorn had referred Varian for surgery on a diagnosis of body dysmorphia rather than gender dysphoria, which he said violated applicable standards of care.8Washington Times. How Parental Consent Was Obtained
Because Varian was 16, the surgery required a parent’s signature. Her mother, Claire Deacon, testified that she had opposed the mastectomy and consented only because she feared her daughter would take her own life. Deacon said of Einhorn: “This man was just so emphatic, and pushing and pushing, that I felt like there was no good decision.” She called it a “scare tactic,” adding, “I don’t believe it was malice, I think he believed what he was saying — but he was very, very wrong.”9New York Post. What the Verdict Signals for Other Detransitioner Cases
Roughly 28 detransitioner lawsuits were reported pending in various stages across the United States as of early 2026.9New York Post. - Chloe Cole is suing Kaiser Foundation Hospitals and several providers in California over hormones and a double mastectomy she received at 15. After a California appellate court ruled in September 2025 that no valid arbitration agreement existed, the case was cleared for open court and trial was set for April 5, 2027. - Luka Hein alleges she was rushed into a double mastectomy at 16 after only two doctor visits. Her September 2023 filing in Douglas District Court, Nebraska, names the University of Nebraska Medical Center, Nebraska Medicine, and four individual providers, and remained active on the most recent available information.13Thomas More Society. - Prisha Mosley’s North Carolina case had its malpractice claims dismissed as time-barred; after North Carolina passed House Bill 805 in July 2025 extending the statute of limitations for gender-transition malpractice claims from four to ten years, her team moved to reinstate them. Institutional Response
On February 3, 2026, days after the verdict, the American Society of Plastic Surgeons issued guidance recommending that gender-related breast, chest, genital, and facial surgeries be delayed until a patient is at least 19. The ASPS called the timing “happenstance” and cited the 2024 U.K. Cass review and a recent HHS report rather than the Varian case. HHS publicly commended the decision.16STAT News. By the time of the ruling, 27 states had enacted restrictions on gender-affirming care for minors, the Trump administration had taken federal action against the practice, and at least 20 hospital chains had closed their pediatric gender clinics following a federal crackdown on Medicaid funding.18The Advocate.
