Detroit Mayor Kwame Kilpatrick: Scandal, Conviction, and Commutation

Kwame Kilpatrick is the former mayor of Detroit who resigned in 2008 after a text-message perjury scandal, was later convicted in a sweeping federal corruption case, and was sentenced in 2013 to 28 years in federal prison before President Donald Trump commuted that sentence on his last day in office in January 2021.¹ He served roughly seven years of that sentence. His 24 felony convictions still stand.

From the Michigan House to Detroit City Hall

Kilpatrick was elected to the Michigan House of Representatives in 1996 from Detroit’s District 9. He won reelection twice, becoming Democratic Leader and the youngest person and first African American to lead a party caucus in the Michigan legislature.² In November 2001 he won the Detroit mayoral race, resigned his state House seat, and was sworn in as mayor that December.³ He won reelection in 2005 against Freeman Hendrix.

The Text-Message Scandal That Forced Him Out

Kilpatrick’s fall started with a whistleblower case. Former Deputy Police Chief Gary Brown and ex-bodyguard Harold Nelthrope sued the city and the mayor in 2003, saying they had been fired for investigating Kilpatrick’s Executive Protection Unit and his personal conduct. In September 2007 a Wayne County Circuit Court jury found violations of Michigan’s Whistleblower Protection Act and awarded the officers $6.5 million.⁴ After previously undisclosed text messages surfaced, the settlement rose to $8.4 million with a confidentiality clause meant to keep the messages private.⁵

At the whistleblower trial, Kilpatrick and his chief of staff, Christine Beatty, had denied under oath that they were in a romantic relationship. The Detroit Free Press then obtained thousands of text messages between them showing an affair in 2002 and 2003 and discussions that contradicted their sworn statements about Brown’s firing. In March 2008, Wayne County Prosecutor Kym Worthy charged both of them with perjury, obstruction of justice, and, for Kilpatrick, misconduct in office. Six of the eight counts were felonies.⁶ The Michigan Attorney General added two more felony counts that August.²

Kilpatrick first resisted calls to step down. In September 2008 he took a plea deal, pleading guilty to two counts of obstruction of justice and no contest to one count of assault. He resigned as mayor effective September 18, 2008, served 120 days in jail, and agreed to pay approximately $1 million in restitution.² Beatty pleaded guilty to perjury in December 2008 and served about three months.⁷

The Federal Corruption Case

While the state case moved through court, the FBI had been building a much bigger one. The bureau opened its investigation in 2004 and used wiretaps, undercover operators, and cooperating witnesses to map a corruption network running out of City Hall.⁸

A federal grand jury indicted Kilpatrick in June 2010 on charges of mail fraud, wire fraud, and tax evasion, tied in part to the Kilpatrick Civic Fund, a tax-exempt charity he had founded. Prosecutors said he pulled $640,000 from the fund for personal expenses including yoga, golf, children’s camp, travel, cars, a family history video, polling, and tuition for relatives.⁹ The indictment was superseded multiple times and grew to 46 counts covering racketeering conspiracy, bribery, extortion, obstruction of justice, and fraud.¹⁰

The Pay-to-Play Scheme With Bobby Ferguson

The center of the case was Kilpatrick’s relationship with Bobby Ferguson, a Detroit contractor and close friend. Kilpatrick used his office to steer city contracts to Ferguson, who kicked back cash and other benefits. Ferguson’s companies took in at least $83 million in gross revenue from municipal contracts between 2002 and 2008.¹¹

Much of the scheme ran through the Detroit Water and Sewerage Department, which handled more than $2 billion in contracts during the period at issue. Kilpatrick served as “Special Administrator” of DWSD from January 2002 to January 2006 under a federal consent decree, a role that let him bypass normal procurement rules. He and his staff pressured DWSD director Victor Mercado to direct work to Ferguson.¹² Contractors who refused to bring Ferguson on as a subcontractor risked delayed, reassigned, or canceled contracts. One engineering firm, Lakeshore, paid Ferguson $1.52 million for no services after the city canceled other Lakeshore work. Ferguson held up a contract amendment for Inland Waters Pollution Control until it paid him $175,000, and demanded a 35 percent stake in a $140 million pump station project from Walbridge; when Walbridge refused, the contract went elsewhere.¹¹

Bribes to His Father

Kilpatrick’s father, Bernard Kilpatrick, worked as a consultant beginning in 2001 and used that position to collect payments from people who wanted city business or pension deals. Trial evidence showed Bernard took roughly $250,000 in cash from Karl Kado for favorable treatment on Cobo Hall contracts, over $300,000 from Jon Rutherford for support of a waterfront casino project, and private jet service and benefits worth more than $300,000 from businessman Tony Soave to protect Soave’s city contracts. During his son’s time as mayor, Bernard deposited over $840,000 in cash into his personal bank accounts.¹⁰

The Pension Fund Scheme

The SEC charged Kilpatrick and former city treasurer Jeffrey Beasley in 2012 with secretly accepting lavish gifts from investment adviser Chauncey Mayfield in exchange for steering roughly $117 million in pension fund investments to a real estate trust controlled by Mayfield’s firm, MayfieldGentry Realty Advisors. The gifts included private jet travel to Las Vegas, Bermuda, and Tallahassee that cost over $125,000, none of which was disclosed to the pension boards.¹³ Between 2006 and 2009, pension fund trustees influenced by Kilpatrick and his appointees loaned more than $200 million to businessmen involved in bribery and kickback schemes, at an estimated cost of $84 million to retirees.¹⁴

Conviction and 28-Year Sentence

The federal trial ran five months before U.S. District Judge Nancy G. Edmunds. On March 11, 2013, after roughly 14 days of deliberation, the jury convicted Kilpatrick on 24 counts including racketeering conspiracy, extortion, bribery, mail fraud, and tax violations. Ferguson was convicted on 9 counts, and Bernard Kilpatrick was convicted of one count of filing a false tax return.¹⁰ In total, 32 other people were convicted in the broader investigation.⁸

Judge Edmunds sentenced Kilpatrick to 28 years in federal prison in October 2013. The U.S. Attorney’s Office for the Eastern District of Michigan said he had “pervasively and systematically corrupted city government” and acted as though “he was above the law,” and that his crimes were “not the result of a momentary lapse in judgment.”⁸ Ferguson received 21 years and Bernard Kilpatrick received 15 months.¹⁵ Kilpatrick was also ordered to pay nearly $1.7 million in restitution to the City of Detroit and the IRS.¹⁶

What It Cost Detroit

Kilpatrick’s corruption shaped how Detroit was governed after him. When emergency manager Kevyn Orr was appointed in 2013 to stabilize the city’s finances, he cited that history as a reason city officials could not be trusted to manage fiscal affairs, saying “any city that has this level of investigations and corruption in recent years, certainly that raises questions as to whether or not they had a firm hand on the tiller.”¹⁷ Orr launched a probe of both city pension funds.¹⁸ Detroit filed for Chapter 9 bankruptcy in July 2013, then the largest municipal bankruptcy in American history.

Michigan voters responded at the ballot box. In November 2010 they approved a constitutional amendment, sponsored by state Senator Tupac Hunter, that bars anyone convicted of a corruption-related felony from holding state or local office for 20 years. The measure had passed the state Senate unanimously and the House 91 to 13.¹⁹ That amendment still bars Kilpatrick from state or local office.²⁰

The Trump Commutation

On January 20, 2021, his last day in office, President Trump commuted Kilpatrick’s 28-year sentence. Kilpatrick had served about seven years and had roughly 20 years remaining.¹ The commutation shortened his prison time; it did not vacate his 24 felony convictions.²⁰

Reaction in Detroit split. Mayor Mike Duggan said it was “a decision President Trump got right.” U.S. Attorney Matthew Schneider called Kilpatrick a “notorious and unrepentant criminal” who had served only a quarter of his sentence.²⁰ State Representative Karen Whitsett, a Democrat, was credited with lobbying Trump. The White House said the move was “strongly supported by prominent members of the Detroit community.”²¹

Where He Is Now

Since his release, Kilpatrick has worked as a pastor affiliated with Movemental Ministries and as a motivational speaker. He campaigned publicly for Trump in 2024, recording a radio ad for the Michigan Republican Party, speaking at events in Detroit, Philadelphia, and Georgia, appearing at an Oakland County Republican Party fundraiser, and attending Trump’s inauguration and a White House Black History Month celebration. Kilpatrick has said Trump promised him a full presidential pardon during a meeting at Mar-a-Lago in exchange for his campaign support; as of early 2025, no pardon had been granted.²¹

His financial obligations from the corruption case remain active. As of late 2022, his last reported restitution payment had been in February 2013, and he had paid about $5,000 toward the balance since his release.²² He also owed the IRS over $634,000 in unpaid income taxes from 2003 through 2008, and the agency filed a tax lien against him in Georgia in 2022.²³

In 2022, a federal judge issued writs of garnishment against PayPal and the crowdfunding platform Plumfund targeting $193,303 tied to Kilpatrick and his wife, Laticia, after she launched a campaign to raise money for a Florida home and baby expenses.²⁴ Federal authorities also flagged income from his book, “Off the Grid,” sold through PayPal for $19.99, as money that should go toward restitution.²⁵ In August 2024, prosecutors filed documents alleging he had been falsely claiming a Georgia residence to delay restitution enforcement, citing mail rerouted to Michigan, a listed Georgia home that appeared vacant and was for sale, and photographs of Kilpatrick at events in the Detroit area.²⁶ In February 2026, a court approved a new agreement under which Kilpatrick consented to pay $823,649 in remaining restitution to the city, with his Michigan state legislative pension and other income subject to garnishment. The specific payment plan details were sealed.¹⁶
