Diddy Crying During Sentencing: Apology, Family, and Sentence

Sean “Diddy” Combs broke down crying during his federal sentencing on October 3, 2025, sobbing as he apologized to his victims, turning to his mother in the gallery to tell her she had raised him better, and begging U.S. District Judge Arun Subramanian for mercy. The nearly five-hour hearing in Manhattan federal court ended with a 50-month prison sentence on two Mann Act counts of transporting individuals across state lines for prostitution. One of his defense attorneys cried while arguing for leniency. Six of his children stood together at the podium in tears. And Combs, in a yellow sweater, held his head in his hands as images of his children as babies played on a courtroom screen.¹

What Combs Said Through Tears

Combs let out a deep exhale before he began speaking. His voice grew heavier as he went.

“My actions were disgusting, shameful and sick,” he told the judge. “I was sick from the drugs. I was out of control. I needed help and I didn’t get the help.”²

He apologized directly to his former girlfriend Casandra “Cassie” Ventura, saying he did not take lightly any harm he had caused her. He apologized to a woman who had testified at trial under the pseudonym “Jane.” He addressed victims of domestic violence generally. Referring to the 2016 InterContinental Hotel surveillance video that showed him attacking Ventura in a hallway, he said, “That video, that disgusting, despicable video, triggered a lot of people around the world.”³

He described himself as “humbled and broken to my core.” “I hate myself right now,” he said. “I’ve been stripped down to nothing.” He listed what he had lost: his businesses, his career, his reputation, his self-respect.²

He closed by begging for a chance to be a father again. “I ask your honor for mercy. I beg your honor for mercy,” he said. “I ask your honor for a chance to get the help I desperately need to be a better person.”³

The Moment With His Mother and Children

The hardest break came when Combs turned to his mother, Janice Combs, seated in the gallery, and began sobbing. He placed his hands on his head. “You taught me better,” he told her. “You raised me better.”² His mother had not spoken in court but had submitted a letter to the judge asking for leniency, writing that she would turn 85 in December and wanted to “spend the last few years of my life with my son.” She acknowledged that Combs had made “some terrible mistakes.”⁴

Earlier in the hearing, six of his seven children had approached the podium together, arms around each other, several of them crying. Combs wept and held his head in his hands as they spoke.¹

Justin Combs called his father his “superhero.” “Seeing him broken down and stripped of everything is something I will never forget,” he told the judge, asking for “a second chance at life, a second chance to right his wrongs.” Christian Combs called his father “the greatest man in the world” and said Combs had always taught him to treat women with respect. Quincy Brown described his father as “a changed man” who had “completely transformed.” Jessie Combs acknowledged that her father “isn’t perfect and he has made many mistakes” but said the family still needed him. D’Lila Combs spoke on behalf of the youngest sibling, two-year-old Love, expressing fear that the child would grow up without a father. Chance Combs said her father was “working on becoming a better man and a more present father.”⁵⁶

Defense attorney Nicole Westmoreland also fought back tears while addressing the court, calling Combs a “barrier-breaking entrepreneur” and a “fighter for civil liberties and equality.”⁷ The defense played a mitigation video showing Combs with his children, running the New York City Marathon, participating in charitable events, and mourning his late ex-girlfriend Kim Porter.⁸

The Sentence the Judge Handed Down

The tears did not move the courtroom to the outcome the defense wanted, but they did not produce the outcome prosecutors wanted either. Prosecutors had requested 135 months, arguing in a 164-page memo that Combs’ conduct involved “violence, domestic abuse, drug use and distribution, and bribery” and that he remained “unrepentant.”⁹ The defense had asked for 14 months, essentially time served.¹⁰ The federal sentencing guidelines calculated an advisory range of 70 to 87 months.

Judge Subramanian rejected both proposals. He called the prosecution’s request unreasonable, saying comparable prostitution cases typically involved more extensive criminal histories and aggravating factors like “murder, minor victims, an expansive prostitution enterprise with numerous victims.” He rejected the defense’s 14-month request as “insufficient to satisfy the goals of sentencing,” citing the “severity of the conduct at issue, the violence, the drugs, the coercion, and the devastation that it caused to Mr. Combs’ victims.” He pointed to mitigating factors including Combs’ lack of recent criminal history, family ties, substance abuse, and mental health history.¹¹

Subramanian sentenced Combs to 50 months in federal prison, followed by five years of supervised release. He imposed the maximum fine of $500,000, calling it an “upward variance” because the standard guidelines did not reflect “the severity of the defendant’s conduct nor the defendant’s immense resources, which enabled his crimes.” He also ordered forfeiture of property used in connection with the offenses. Combs received credit for the roughly 13 months already served since his September 2024 arrest.¹²¹³

Throughout the judge’s 20-minute sentencing speech, Combs remained largely expressionless and did not look up. When the sentence was announced, he turned to his family in the gallery and mouthed, “I love you, I’m sorry.”¹

The Convictions Behind the Hearing

The sentencing followed an eight-week federal trial that ended on July 2, 2025. The jury found Combs guilty on two counts of transporting individuals across state lines to engage in prostitution under the Mann Act. It acquitted him on the more serious charges of racketeering conspiracy and sex trafficking by force, fraud, or coercion.¹⁴ Cassie Ventura, whose 2023 civil lawsuit and the leaked 2016 hotel video helped drive the federal investigation, did not appear at sentencing but submitted a three-page statement urging the judge to consider “the truths at hand that the jury failed to see.” She wrote that although Combs was acquitted of sex trafficking, “his sentence should reflect the reality of the evidence and my lived experience as a victim.”¹⁵

A former live-in assistant identified as “Mia” had been scheduled as the only victim to speak in person, but she withdrew after what prosecutors described as a “bullying” letter from the defense team challenging her credibility. Judge Subramanian addressed the defense directly on that point: “The tone of the defense’s letter was inappropriate. That should not be done again.”¹⁶

What Happened After

Combs was later transferred from the Metropolitan Detention Center in Brooklyn to the Federal Correctional Institution at Fort Dix, New Jersey, a low-security facility. He was assigned to work in the prison laundry room and enrolled in the Residential Drug Abuse Treatment Program, an intensive nine-to-twelve-month program that can reduce a federal sentence by up to one year for graduates.¹⁷¹⁸

His attorneys appealed both the conviction and the 50-month sentence to the U.S. Court of Appeals for the Second Circuit. At oral arguments on April 9, 2026, defense attorney Alexandra Shapiro argued that Judge Subramanian improperly considered “acquitted conduct” tied to the racketeering and sex trafficking charges the jury had rejected. The defense also argued that the sentence far exceeded the roughly 15-month terms typical in comparable Mann Act cases. Prosecutors asked the court to affirm.¹⁹ As of mid-2026, the panel had not ruled, and reporting indicated it appeared divided. Combs’ scheduled release date, without any reduction, is April 15, 2028.²⁰
