Do I Need a Business License in Florida to Sell Online?

If you are running an online store from Florida, you do not need a single “business license,” but you almost certainly need a few separate registrations before your first sale. So the honest answer to whether you need a business license in Florida to sell online is: yes, in pieces. At minimum, most sellers need a state Certificate of Registration from the Florida Department of Revenue to collect sales tax, and a local Business Tax Receipt from the county (and often the city) where the business operates. What you sell and how you sell it can add a few more items on top.

The State Certificate of Registration

The core state-level requirement is registering as a sales and use tax dealer with the Florida Department of Revenue. Once approved, you receive a Certificate of Registration, sometimes called a Seller’s Permit, that authorizes you to collect Florida’s 6% state sales tax plus any local discretionary surtax that applies where your customer receives the product.1Florida Department of Revenue. Registration is free online through the Florida Business Tax Application (Form DR-1). Filing the paper version costs $5.2Florida Department of Revenue. When Sales Tax Collection Is Actually Your Job

Your duty to register and collect turns on whether you have “nexus” with Florida. Any physical presence in the state, including a home office, stored inventory, a warehouse, or employees, creates nexus and triggers the registration requirement.1Florida Department of Revenue. Florida also applies an economic nexus rule. Sellers with no physical presence still have to register and collect if their taxable remote sales into Florida exceeded $100,000 during the previous calendar year.3Florida Department of Revenue. Selling Only Through Amazon, Etsy, or eBay

If every sale you make flows through a marketplace like Amazon, Etsy, or eBay, that platform is required by Florida law to collect and remit sales tax for you as a “marketplace provider.”4Florida Senate. That doesn’t automatically get you out of registering. If you also sell through your own website, at craft fairs, or through any channel outside the marketplace, those sales are yours to handle and you need the Certificate of Registration. Sellers who are already registered but move to marketplace-only should keep filing returns, even zero-dollar ones, to avoid delinquency penalties.

Local Business Tax Receipts

Separate from the state, Florida counties and many cities require every business operating within their borders to buy a Business Tax Receipt, formerly known as an Occupational License. This is a local tax on the privilege of doing business in that jurisdiction, and it applies to home-based and online-only operations exactly the same way it applies to storefronts.5Florida Senate. If your home sits inside an incorporated city, you likely need two receipts: one from the county tax collector, another from the city. Fees vary by jurisdiction and business type, so call your county tax collector’s office and your city’s business office to get the exact amount. Receipts go on sale July 1 and are due by September 30, and they expire the following September 30.5Florida Senate. Florida law does give home-based businesses one useful protection. Under Section 559.955, local governments can’t single out home-based businesses for licensing rules different from those imposed on other businesses. The same statute is explicit, though, that home-based businesses remain subject to the Chapter 205 business taxes.6Official Internet Site of the Florida Legislature. Business Name and Structure

A few registrations sit upstream of your permits, because the permits will ask what name and entity you’re operating under.

Fictitious Name (DBA)

Operating under any name other than your own legal name as a sole proprietor, or your entity’s legal name as an LLC or corporation, requires a fictitious name filing with the Florida Division of Corporations before you do business under it.7Florida Department of State – Division of Corporations. LLC or Corporation

Many online sellers form a Florida LLC to keep personal assets separate from business liabilities. Extra Permits Based on What You Sell

Some product categories add another state license on top of the Seller’s Permit and Business Tax Receipt.

Handmade Cosmetics and Body Products

Manufacturing or repackaging cosmetics in Florida, including handmade soaps, lotions, and lip balms, requires a Cosmetic Manufacturer Permit from the Department of Business and Professional Regulation. Food

Selling food online generally requires a permit from the Florida Department of Agriculture and Consumer Services. Florida’s cottage food law carves out home-based food businesses whose annual gross sales stay at or below $250,000. Cottage food operators can sell online and ship through mail carriers, but each product must be prepackaged and labeled with ingredients, net weight, allergen information, and a statement that it was “made in a cottage food operation that is not subject to Florida’s food safety regulations.”13Florida Senate. Other Regulated Products and Services

The DBPR regulates dozens of industries, from auctioneers to real estate brokers. Other categories, including pawn shops and private investigators, fall under the Department of Agriculture and Consumer Services.14Florida Department of State. Tangible Personal Property Return

One filing routinely surprises new sellers. If you own business equipment in Florida on January 1 of any year, meaning things like computers, printers, desks, packaging equipment, or inventory shelving, you’re required to file a Tangible Personal Property Tax Return (Form DR-405) with your county property appraiser by April 1.16Florida Department of Revenue. If the total assessed value of your equipment is $25,000 or less and you file on time, you qualify for a full exemption and owe nothing. Filing an initial return also lets you get a waiver from filing in future years, as long as your value stays at or below $25,000.16Florida Department of Revenue. What Happens If You Skip It

Operating without proper registration costs more than it saves.

The Department of Revenue charges interest on any sales tax you should have collected. The floating rate for the first half of 2026 is 11%, calculated daily, running from the date each payment was originally due.17Florida Department of Revenue. On the local side, running without a required Business Tax Receipt triggers a flat 25% penalty on the tax owed. If it remains unpaid after 150 days, the county can sue to recover the tax plus court costs, attorney fees, and an added penalty of up to $250. On-time receipts that lapse face a 10% penalty in October plus 5% for each additional month, capped at 25%.5Florida Senate. None of these numbers will bankrupt a small business, but they are entirely avoidable. Most of the registrations covered here are free or inexpensive, and each of them takes less than an hour online.

The Order That Makes Sense

A practical sequence for a new Florida-based online seller:

  • Pick your structure. Sole proprietorship needs no state formation; LLCs and corporations file with Sunbiz first.
