If you had no income last year, you generally do not need to file California state taxes. The Franchise Tax Board only requires a return when your income crosses set thresholds tied to your filing status, age, and number of dependents, and someone with zero earnings sits well below every one of them. That said, a handful of specific situations can still create a filing obligation, and in some cases filing voluntarily is the only way to collect money the state already owes you.

The FTB Income Thresholds

For a single filer under 65 with no dependents, the 2025 gross income threshold is $22,941 and the AGI threshold is $18,353. A married couple filing jointly, both under 65 with no dependents, must file above $45,887 in gross income or $36,711 in AGI. Thresholds rise with age and each additional dependent. Zero income clears all of them.

When You Still Have to File

A few circumstances create a filing obligation regardless of how little you earned.

You Owe Use Tax on Out-of-State Purchases

If you bought goods from an out-of-state or online retailer that didn’t charge California sales tax, you probably owe use tax on items you use, store, or consume in California. You Received Advance Premium Tax Credit Payments

If you or a family member got advance payments of the health insurance premium tax credit through Covered California, you have to file a federal return to reconcile them on Form 8962, even if you otherwise wouldn’t need to. You Had HSA Activity

California doesn’t conform to the federal rules for health savings accounts. You’re a Part-Year Resident or Nonresident With California Income

Why You Might Want to File Anyway

For many low- or no-income Californians, the real question isn’t whether filing is required but whether skipping it leaves money behind. Often it does.

Refund of Withheld Tax

If you worked at all, your employer likely withheld state income tax from your paychecks. Filing a return is the only way to get that money back.4Franchise Tax Board. Do You Need to File?

California Earned Income Tax Credit

The CalEITC is refundable, meaning it can pay you money even when you owe zero state tax. For 2025, you qualify with earned income between $1 and $32,900. The credit runs from $302 with no qualifying children up to $3,756 with three or more.6Franchise Tax Board. Eligibility and Credit Information You have to file and claim it to receive it. Note the floor: with literally zero earned income, CalEITC is off the table.

Young Child and Foster Youth Tax Credits

Two more refundable credits stack on top of CalEITC. The Young Child Tax Credit pays up to $1,189 if you qualify for CalEITC and have a child under six. The Foster Youth Tax Credit offers the same amount to current and former foster youth ages 18 to 25 who qualify for CalEITC and were in California foster care at age 13 or older.6Franchise Tax Board. Filing your California return typically means filing federally too, which opens the door to the federal Earned Income Tax Credit and other refundable credits. If you qualify for CalEITC, you almost certainly qualify for the federal version.

What Happens if You Skip a Return You Should Have Filed

California’s late filing penalty is 5% of unpaid tax per month, capped at 25%. If you owe nothing, the percentage-based penalty is zero, so a missed filing on a zero-tax year carries no standard penalty. The bigger risk is the FTB deciding you had unreported income. It can send a Request for Tax Return and then a formal Demand for Tax Return. Ignoring the demand triggers a 25% penalty on whatever amount the FTB assesses, and interest runs the whole time.7Franchise Tax Board. Deadlines

Returns for the 2025 tax year are due April 15, 2026. California automatically extends the filing deadline to October 15, 2026 with no application, but any tax owed is still due April 15.8Franchise Tax Board. How to File

The FTB’s free CalFile tool lets you e-file your state return directly. Your AGI has to be above $0 to use it, and you must claim the standard deduction rather than itemize. The IRS Free File program offers free guided software for taxpayers with AGI of $89,000 or less.12Internal Revenue Service.
