A first DUI in PA does not always cost you your license. If your blood alcohol content was in the lowest tier — .08% to .099% — and you have no prior offenses, you keep your driving privileges. Once your BAC hits .10% or higher, or if you refused chemical testing, you are looking at a 12-month suspension. Pennsylvania’s Accelerated Rehabilitative Disposition program can shrink that to 30 or 60 days, or eliminate it entirely, if you qualify.
How Long the Suspension Lasts by BAC
Pennsylvania sorts DUI offenses into three tiers based on the alcohol in your system within two hours of driving.1Pennsylvania General Assembly. - General Impairment, .08% to .099% BAC: no license suspension.
- High BAC, .10% to .159%: 12-month suspension.
- Highest BAC, .16% or above, or a controlled-substance DUI: 12-month suspension.

What Refusing the Breath or Blood Test Costs You
Pennsylvania’s implied consent law treats driving on its roads as automatic agreement to a chemical test when an officer has reasonable grounds to suspect impairment.3Pennsylvania General Assembly. That suspension is civil, tied to the refusal itself, and stands whether or not you are ever convicted of DUI.
Refusing does not spare you from prosecution. Prosecutors can still build a DUI case on other evidence, and a refusal also knocks you out of the reduced-suspension options that ARD offers at lower BAC levels. How ARD Can Cut or Eliminate Your Suspension
Accelerated Rehabilitative Disposition is a pre-trial program for first-time DUI offenders that lets you avoid a criminal conviction. You complete a supervision period of six to 12 months, attend alcohol highway safety school, undergo a drug and alcohol evaluation, pay court costs, and sometimes perform community service.5Pennsylvania Liquor Control Board. The suspension reduction is the main draw:
- BAC below .10%: no suspension at all.
- BAC .10% to .159%: 30 days instead of 12 months.
- BAC .16% or higher, unknown BAC, or drug-related DUI: 60 days instead of 12 months.
Those reductions matter most in the tiers that would otherwise cost you a full year off the road.2Commonwealth of Pennsylvania. ARD is not a right. The prosecutor decides whether to offer it, eligibility varies by county, and cases involving an accident with serious injury are generally excluded. A clean criminal history is typically required. If you accept ARD and fail to finish the requirements, you land back on the standard track with the full suspension and penalties waiting.
Ignition Interlock and Driving During Your Suspension
Every first-offense DUI conviction in Pennsylvania comes with a one-year ignition interlock requirement.2Commonwealth of Pennsylvania. It must be installed on every vehicle you own, operate, or lease for one year measured from the date your license is restored.4Commonwealth of Pennsylvania. If you need to drive during the suspension itself, the standard Occupational Limited License is not available for DUI-related suspensions.7Commonwealth of Pennsylvania. Occupational Limited License FAQs The option built for DUI drivers is the Ignition Interlock Limited License, created by Act 33 of 2016, which lets you drive interlock-equipped vehicles during part or all of your suspension.8Commonwealth of Pennsylvania. CDL Holders: A Separate Federal Hit
If you hold a commercial driver’s license, a first DUI conviction in Pennsylvania also triggers a one-year federal disqualification from operating any commercial motor vehicle. That applies even when you were driving your personal car at the time of the arrest. Haul hazardous materials and the disqualification stretches to three years. Getting Your License Back
Restoration is not automatic when the clock runs out. About 30 days before your suspension ends, PennDOT mails a restoration requirements letter to the address on file listing what you owe and what you need to submit.11Commonwealth of Pennsylvania. A restoration fee applies; the amount is set by law and adjusted every two years for the Consumer Price Index.
Pennsylvania does not require SR-22 filings, so you will not need a high-risk insurance certificate on file with the state, though you still need standard liability coverage. If your suspension came from a High or Highest BAC conviction, a controlled substance violation, or a test refusal, the ignition interlock has to be installed before full driving privileges come back.4Commonwealth of Pennsylvania.
