Do You Need a Painting License in Florida?

You do not need a painting license in Florida. The state’s Construction Industry Licensing Board has never issued a painting-specific credential, and since July 1, 2025, Florida law expressly bars any local government from requiring a license to paint.1Online Sunshine. Florida Statutes 489.117 What you do need is a registered business, the right insurance, and, for a lot of Florida’s housing stock, a federal EPA certification.

What the Law Actually Says

The Florida Construction Industry Licensing Board (CILB) regulates trades like general contracting, electrical, plumbing, roofing, and mechanical work. Painting has never been on that list.2Florida Department of Business and Professional Regulation. Construction Industry For years, individual counties and cities filled the gap with local Certificates of Competency, but House Bill 735, signed in 2021, preempted local occupational licensing to the state level.3Florida Senate. House Bill 735 After several deadline extensions, that preemption took full effect on July 1, 2025.

Florida Statute 489.117 now names painting among the job scopes for which no local government can require a license. Local governments also cannot demand a license as a condition of pulling a permit for painting work.1Online Sunshine. Florida Statutes 489.117 Interior walls, ceilings, trim, cabinets, exteriors up to three stories: no trade exam, no experience documentation, no Certificate of Competency required anywhere in the state.

The Rooftop Exception

The statute carves out one narrow exception. A local government that already required a license before January 1, 2021, may continue to license rooftop painting, coating, and cleaning above three stories.1Online Sunshine. Florida Statutes 489.117 If you plan to bid high-rise exterior work, call the building department for the county where the project sits. For everything else, this exception will never touch your business.

Registering Your Painting Business

No trade license does not mean no paperwork. Before you take a paying job, you need to set up a legal business and register with your local jurisdiction.

Business Entity

Most painters operate as either a sole proprietorship or a limited liability company. A sole proprietorship requires no state filing but leaves your personal assets exposed to business debts and lawsuits. Forming an LLC through the Florida Division of Corporations (Sunbiz) costs $125, which covers the filing fee and the required registered agent designation.4Florida Department of State. LLC Fees Property damage claims are common in this trade, and the LLC structure puts a legal wall between the business and your personal finances.

Fictitious Name

If you plan to work under any name other than your legal name or your LLC’s exact registered name, Florida’s Fictitious Name Act requires you to register that trade name with the Division of Corporations before doing business. The filing fee is $50.5Online Sunshine. Florida Statutes 865.09 You also have to advertise the name at least once in a newspaper in the county of your principal office.6Florida Department of State. Florida Fictitious Name Registration Skipping the registration is a second-degree misdemeanor.

Local Business Tax Receipt

Most Florida counties and municipalities require a local business tax receipt, sometimes still called an occupational license, to operate within their boundaries. It is not a competency credential; it is a local tax on the privilege of doing business. Annual fees run anywhere from under $50 to several hundred dollars depending on the county and business category. Your county tax collector’s office handles the application.

Insurance Requirements

Insurance is where the real gatekeeping happens. The state does not require a painting license, but it does require certain coverage, and clients will require more.

Workers’ Compensation

Florida law requires every construction industry employer to carry workers’ compensation coverage with even one employee, including corporate officers and LLC members.7Florida Department of Financial Services. Coverage Requirements Getting caught without coverage when you have employees can trigger a stop-work order that shuts down the business immediately.

Sole proprietors with no employees are not required to carry it. Corporate officers and LLC members who own at least 10% of the company can apply for an exemption, which costs $50 and requires a valid Florida driver’s license.8Florida Department of Financial Services. Construction Industry Exemptions No more than three officers per company or affiliated group may elect the exemption, and it does not extend to non-owner employees.

General Liability

General liability insurance covers property damage and bodily injury claims tied to your work. Florida sets no statutory minimum for painters because painting is not a state-licensed trade. In practice, general contractors, property managers, and commercial clients will not hire you without proof of coverage. Policies for painting businesses commonly run between $300,000 and $1 million in general liability, with premiums driven by your revenue, employee count, and claims history.

EPA Lead-Safe Certification for Pre-1978 Buildings

This is the credential many Florida painters overlook. The EPA’s Renovation, Repair, and Painting (RRP) Rule applies to any paid work that disturbs painted surfaces in homes, child-care facilities, or schools built before 1978.9U.S. Environmental Protection Agency. What Does the Renovation, Repair, and Painting (RRP) Rule Require? Florida has a large stock of housing from the 1950s through 1970s, so the rule covers a substantial share of residential repaints.

Both the individual renovator and the firm have to be certified. Individual certification starts with an eight-hour training course that includes two hours of hands-on instruction, and it lasts five years.10U.S. Environmental Protection Agency. Renovation, Repair and Painting Program – Renovator Training Renewal is a four-hour refresher. Every other renewal cycle must include hands-on training; skip the hands-on portion and your certification runs three years instead of five. Letting the certification lapse entirely means retaking the full eight-hour course.

The firm certification is separate. It costs $300 for the initial application and $300 to recertify.11U.S. Environmental Protection Agency. Certified firms also have to keep records demonstrating lead-safe work practices for three years after each renovation.12U.S. Environmental Protection Agency. What Records Must a Subcontractor Keep?

Sales Tax on Painting Work

Florida’s sales tax rules trip up new painting contractors. Under a lump-sum or time-and-materials contract, you are treated as the final consumer of your materials. You pay sales tax when you buy the paint, primer, tape, and supplies, and you do not charge sales tax to the customer.13Florida Department of Revenue. The exception is a retail-sale-plus-installation contract, where you list and price all materials separately from labor before work begins. Under that structure, you buy materials tax-exempt for resale and charge the customer sales tax on the materials only. Most residential painters stick with lump-sum pricing and absorb the tax on their own supply purchases.

Lien Law Disclosure on Residential Contracts

Any direct contract over $2,500 for painting residential property of four units or fewer must include Florida’s construction lien law notice. The notice has to appear in bold, capitalized, 12-point type on the front page of the contract or on a separate signed and dated page.14Florida Senate. Florida Code Title XL – Section 713.015 It warns the homeowner that unpaid subcontractors or suppliers can lien the property even if the homeowner already paid you in full.

If the contract is oral, the notice still has to be delivered in a separate document that references the agreement. Missing the notice does not automatically void your lien rights, but it opens the door to disputes. For any residential job over $2,500, use a written contract with the disclosure built in.

When You Might Want a State Contractor License

Some painters eventually expand into work that goes past paint: full interior remodels, drywall replacement, additions. That work falls under CILB licensing categories and requires a state-certified or registered contractor license. The path involves four years of documented experience or a qualifying combination of education and experience, the state contractor examination, and a financial responsibility standard that starts with a FICO credit score of 660 (or completion of a board-approved 14-hour financial responsibility course).15Department of Business and Professional Regulation.
