Yes, Alabama does tax groceries. As of September 1, 2025, the state charges a 2% sales tax on most food bought for home consumption, down from 3% under Act 2025-305.1Alabama Department of Revenue. NOTICE State Sales and Use Tax Rate Reduced on Food Beginning September 1, 2025 That is one of the lowest state-level grocery tax rates in the country, but Alabama remains unusual because most states exempt groceries entirely. And the 2% figure is only the state’s share. Local city and county taxes stack on top, so what you actually pay at the register depends on where you shop.
What Qualifies for the 2% Rate
The reduced rate applies to “food” as defined by the federal SNAP program under 7 U.S.C. ยง 2012. In practical terms, that means the staples in the grocery aisles: fruits, vegetables, meat, poultry, fish, dairy, bread, cereal, snack foods, and non-alcoholic beverages bought to take home.1Alabama Department of Revenue. NOTICE State Sales and Use Tax Rate Reduced on Food Beginning September 1, 2025
The current 2% rate is the second cut in the state grocery tax in recent years. The first, under Act 2023-554, dropped the rate from 4% to 3% on September 1, 2023.2Alabama Department of Revenue. What Still Gets Taxed at the Full 4% Rate
Not everything you eat qualifies for the reduced rate. Hot foods and meals sold for immediate consumption stay at the full 4% state sales tax.4Alabama Legislature. Alabama Code 40-23-2 – Tax Levied on Gross Receipts That includes restaurant meals, hot deli items, and rotisserie chickens. A cold sandwich or a bag of chips from a grocery store qualifies for the 2% rate. A hot meal from the same store’s prepared-foods counter does not.
The dividing line follows SNAP eligibility. If SNAP wouldn’t cover it, the reduced rate doesn’t apply.1Alabama Department of Revenue. NOTICE State Sales and Use Tax Rate Reduced on Food Beginning September 1, 2025 Alcohol and tobacco are also excluded, taxed at 4% or higher depending on the product.
Over-the-counter vitamins and dietary supplements don’t qualify either, because the federal SNAP definition excludes anything the FDA requires to carry a “Supplement Facts” label rather than a “Nutrition Facts” label.5Office of the Law Revision Counsel. 7 USC 2012 – Definitions Those items are taxed at 4%. One narrow exception: vitamins, minerals, and dietary supplements dispensed by prescription from a licensed physician, chiropractor, orthodontist, or podiatrist are fully exempt from state, county, and city sales tax.6Alabama Legislature. Alabama Code 40-9-27 – Prescriptions for Vitamins and Dietary Supplements Picking up a bottle at the pharmacy counter, even on a doctor’s recommendation, doesn’t count unless it’s dispensed by prescription through one of those professionals.
Local Taxes on Top
Alabama counties and municipalities add their own sales taxes to the state rate, and those local taxes apply to food. Combined rates vary widely, and in some places total sales tax on groceries can exceed 10%.7Alabama Department of Revenue. Sales and Use Tax Rates
Act 2025-305 authorized local governments to reduce their own sales tax on groceries, but participation is voluntary.3Alabama Legislature. SNAP Purchases Are Fully Exempt
If you pay with SNAP benefits, you owe no sales tax at all, state or local. Federal law requires this: under the Food Security Act of 1985, any state that taxes SNAP transactions loses access to the federal program. Alabama’s statute acknowledges this openly, describing the exemption as a response to “the coercive threat of Congress.”8Alabama Legislature. Alabama Code 40-23-4.2 – Food Stamp Purchases Exempt
The exemption covers only the portion of the purchase paid with SNAP. In a split transaction, sales tax applies to whatever you cover with cash or card.9Food and Nutrition Service. SNAP Retailer Notice – Sales Tax, Fees, and Refunds
Buying Direct From a Farmer
Poultry, livestock, and other products of the farm, dairy, grove, or garden sold in their original condition by the producer or the producer’s immediate family are not subject to sales tax.10Alabama Legislature. Alabama Code 40-23-4 – Exemptions That is why produce at a farmers’ market often rings up tax-free when the person selling it grew it. The exemption turns on who is selling, not what is being sold, so the same tomato bought at a grocery store still carries the 2% state rate plus any local tax.
