Yes, Florida’s tax-free weekends and holidays apply to online purchases. The Florida Department of Revenue treats internet orders the same as in-store purchases during a sales tax holiday, as long as the retailer accepts your order during the holiday window and ships to a Florida address. Delivery can arrive days or weeks after the holiday ends without affecting your exemption.1Florida Department of Revenue. Back to School Sales Tax Holiday FAQs
When an Online Order Counts as Placed During the Holiday
The transaction date controls eligibility, not the shipping date. The Department considers an order accepted when the retailer takes action to fill it. For an internet order, that typically means the confirmation email sent after checkout. A phone order is accepted when the retailer assigns an order number, and a mail order when the retailer stamps a received date.2Florida Department of Revenue. Annual Back-to-School Sales Tax Holiday
Place an order at 11:55 PM on the last night of a holiday, and if the confirmation lands before midnight you’re covered, even if the item doesn’t ship for a week. An order qualifies as being “for immediate shipment” unless you specifically request a delayed shipment. Backorders, stock shortages, and processing delays don’t disqualify your purchase.2Florida Department of Revenue. Annual Back-to-School Sales Tax Holiday
Major online retailers like Amazon, Walmart, and Target generally program their checkout systems to strip Florida sales tax automatically on qualifying items during these periods. Verify the tax was actually removed before you confirm the order. Glitches are most common in the first hours of a holiday, when retailers are still pushing tax-code updates live.
How Shipping Charges Are Handled
Under Florida Administrative Code Rule 12A-1.045, transportation charges bundled into an item’s price follow the same tax treatment as the item itself. If the item is exempt during the holiday, the bundled shipping is exempt too.3Legal Information Institute. Florida Administrative Code 12A-1.045 – Transportation Charges When shipping is stated separately on the invoice and you have the option to avoid it (in-store pickup, for example), the shipping charge is generally not taxable regardless of the holiday.
Mixed carts get trickier. If you order exempt and taxable items together under a single shipping fee, the retailer has to allocate. In practice, most major online sellers handle this automatically, but it’s worth scanning your order summary if you’re combining holiday-eligible items with non-qualifying purchases.
Locations That Are Excluded, and Why It Rarely Matters Online
Florida Statute 212.08 excludes sales made within theme parks, entertainment complexes, public lodging establishments (hotels and resorts), and airports from the holiday, even during the holiday window.4The Florida Legislature. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions A backpack from a shop inside Orlando International or a t-shirt from a store inside Walt Disney World won’t be tax-free in August. Online purchases shipped to a Florida address don’t trigger this exclusion, since the sale doesn’t happen “within” those locations.
Which Holidays This Rule Applies To
The same online-order mechanic works across all of Florida’s sales tax holidays. The specific holidays and their qualifying items change from year to year.
Back-to-School (August 1–31)
This is the big one, and it’s permanent. It’s written directly into Florida Statute 212.08, so it runs every August without needing fresh legislation.4The Florida Legislature. Other Periodic Holidays
Florida has recently run tax-free periods for outdoor recreation and camping (July and September in 2025, covering items like tents up to $200, sleeping bags up to $50, and camping stoves up to $50)6Florida Department of Revenue. 2025 Hunting, Fishing and Camping Supplies Sales Tax Holiday and a one-week Tool Time Holiday in September 2024 for skilled-trade equipment.7Florida Department of Revenue. Disaster Preparedness Is No Longer a Holiday
Florida used to run annual disaster preparedness holidays. As of August 1, 2025, many of those items are permanently exempt: portable generators (10,000 running watts or less), waterproof tarps (1,000 square feet or less), batteries, fuel cans, smoke detectors, carbon monoxide detectors, fire extinguishers, and tie-down kits.8Florida Department of Revenue. New Sales Tax Exemptions Beginning August 1, 2025 You don’t need a holiday window to buy these tax-free online or in person.
Coupons, Gift Cards, and the Price Threshold
Coupons matter more than shoppers expect when items are near a price cap. Store coupons and retailer discounts reduce the sales price, which can push a $105 shirt below the $100 clothing threshold and make it eligible. Manufacturer’s coupons do not reduce the sales price for tax purposes, because the retailer gets reimbursed for the discount, so the full pre-coupon price is what counts against the threshold.2Florida Department of Revenue. Annual Back-to-School Sales Tax Holiday If you’re trying to squeeze an item under a cap, a store promo code helps; a manufacturer’s coupon doesn’t.
Gift cards don’t reduce the sales price of an item, so eligible items paid for with a gift card during the holiday are still exempt. Buying a gift card during the holiday and using it afterward won’t make your later purchase tax-free.2Florida Department of Revenue. Annual Back-to-School Sales Tax Holiday
How Much You Actually Save
Florida’s general state sales tax rate is 6%.9Florida Department of Revenue. Florida Sales and Use Tax Most counties add a discretionary sales surtax of 0.5% to 1.5%.10Florida Department of Revenue. If a Retailer Charges You Tax Anyway
Start with the retailer. Contact customer service and ask for a refund of the overcharged tax. Most large online retailers correct the error quickly once you point to the holiday.
If the retailer won’t refund the tax, apply directly to the Florida Department of Revenue using Form DR-26S, the application for a sales and use tax refund. The process can be started online with electronic documentation. Your application should include how you calculated the refund amount, the reason for the request, the dates of the overpayment, and supporting documentation like receipts and order confirmations.11Florida Department of Revenue.
