What Counts as a Legal Firework
A firework is legal in Garden Grove only if it carries the State Fire Marshal’s circular seal of registration on the packaging. Safe and Sane devices stay on the ground and don’t detonate. Fountains, sparklers, snap caps, and similar items that throw sparks or colored flame without lifting off qualify. Anything else does not.

Private property only. Parks, school grounds, sidewalks, and public streets are off-limits. Legal fireworks come from temporary stands inside Garden Grove, and only from those. Sales run July 1 through July 4. What’s Illegal All Year
Under California law, any firework that flies, explodes, or moves unpredictably along the ground is a “dangerous” firework and illegal to possess at any time. That covers bottle rockets, Roman candles, aerial shells, firecrackers, M-80s, and sky rockets.5Ready for Wildfire. Fireworks Safety
You do not have to light anything to be charged. Storing a box of bottle rockets in your garage is possession under California Health and Safety Code Section 12700. Modifying a legal firework, such as pulling the stick off a fountain to make it spin, also crosses into illegal territory.
Fines and Jail Time

State law adds criminal exposure. A general violation of Health and Safety Code Section 12700 is a misdemeanor punishable by a fine of $1,000 to $2,000, up to one year in county jail, or both.6California Legislative Information. - Under 25 pounds: $1,000 to $2,000 fine and up to one year in jail. A second offense raises the minimum fine to $2,000.
- 25 to 100 pounds: $2,000 to $10,000 fine and up to one year in jail.
- 100 to 5,000 pounds: $10,000 to $20,000 fine with possible state prison time.
- Over 5,000 pounds: $20,000 to $100,000 fine with possible state prison time.

Seizure and the Disposal Bill
Garden Grove’s municipal code authorizes the city manager and police to seize any fireworks sold, possessed, or used in violation of Chapter 5.28. Age Rules
California law makes it illegal to sell or give dangerous fireworks to anyone under 18, and illegal to sell Safe and Sane fireworks to anyone under 16. A second offense of selling dangerous fireworks to a minor carries a fine of up to $10,000, up to one year in jail, and no probation.6California Legislative Information. Call the Garden Grove Police Department’s non-emergency line at (714) 741-5704. Give the address, describe the people involved, and if aerial fireworks are launching, tell the dispatcher which direction they are coming from so officers can locate the source.
