Indiana does not issue or require a FOID card. The Firearm Owner’s Identification card is an Illinois requirement, and Indiana has no equivalent: no ownership card, no possession permit, and no firearm registration.1indy.gov. Permitless Carry Since July 1, 2022, any Indiana resident who is at least 18 and legally eligible may carry a handgun without a license.2Indiana General Assembly. Indiana Code 35-47-2-1 – Carrying a Handgun Without Being Licensed To buy from a dealer, you need a valid government-issued photo ID for the federal background check. That’s it.
Who Can Legally Own and Carry in Indiana
No card doesn’t mean no rules. Indiana’s permitless carry statute, IC 35-47-2-1, requires that you not be prohibited by state or federal law from possessing a handgun. Two lists apply.
Indiana’s Proper Person Disqualifiers
Under IC 35-47-1-7, you are not a “proper person” and cannot carry if any of the following applies to you:
- A conviction for a crime punishable by more than one year of imprisonment.
- A domestic violence conviction, unless a court has specifically restored your firearm rights.
- A current court order prohibiting you from possessing a handgun.
- A documented history of alcohol or drug abuse.
- Involuntary commitment to a mental institution, a finding of mental incompetence, or a current court designation as dangerous.
- A juvenile felony adjudication, if you are under 23 and the act would be a felony for an adult.
The statute also lists convictions for resisting law enforcement within the past five years, convictions involving unsafe handling of a handgun, and other recent firearms-article violations.3Indiana General Assembly. Indiana Code 35-47-1-7 – Proper Person
Federal Prohibitions
Federal law under 18 U.S.C. § 922(g) adds categories that Indiana’s statute doesn’t list on its own. You’re federally prohibited if you are a fugitive from justice, an unlawful user of controlled substances, an undocumented noncitizen or most nonimmigrant visa holders, someone dishonorably discharged from the military, or someone who has renounced U.S. citizenship.4Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts The dishonorable discharge bar is worth flagging because it reaches Indiana only through this federal incorporation. A dishonorable discharge prohibits firearm possession anywhere in the United States regardless of state law.
Buying a Firearm in Indiana
At a federally licensed dealer, you present a valid government-issued photo ID and the dealer runs your information through the FBI’s National Instant Criminal Background Check System (NICS). Federal law sets the age minimums: 21 for a handgun from a dealer, 18 for a rifle or shotgun. Indiana adds no permit, no registration, and no waiting period on top of the federal check.
Private sales between individuals are not subject to a mandatory background check in Indiana.5Indiana Attorney General. Gun Owners’ Bill of Rights The transfer is still regulated, though. It is illegal to sell or transfer a handgun to someone you have reasonable cause to believe is a felon, a drug or alcohol abuser, or mentally incompetent, and it is illegal to transfer any handgun to a person under 18 unless you are that person’s parent or guardian. Knowingly selling to a prohibited person is a felony.
Why Many Indiana Residents Still Get a License to Carry
Indiana still issues a License to Carry a Handgun, and there are practical reasons to have one even though you don’t need it inside Indiana.
The main reason is reciprocity. Roughly 31 states honor Indiana’s license, so you can legally carry in those states when traveling.6IN.gov. Which States Honor My Indiana Handgun License Without the license, your right to carry generally stops at the state line.
The second reason is the federal Gun-Free School Zones Act. Under 18 U.S.C. § 922(q), possessing a firearm within 1,000 feet of a school is a federal offense, with an exception for holders of a state-issued license that required a law enforcement background check before issuance. Indiana’s license satisfies that exception.4Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts If you live near a school or regularly drive through school zones, that alone can justify getting the license.
How to Apply
Indiana offers a five-year license and a lifetime license, and neither carries a state application fee.7Indiana State Police. ISP – Firearms Licensing You have 365 days from starting the online application to finish the remaining steps.8Indiana State Police. ISP – Apply for a New License to Carry
Start on the Indiana State Police firearms licensing portal. The application collects the information listed in IC 35-47-2-3: your full legal name, address, physical description, occupation, employment information, criminal history, and your reason for wanting the license.9Indiana General Assembly. Indiana Code 35-47-2-3 – License Requirement, Application, Procedure After submitting it, schedule electronic fingerprinting with IDEMIA, the state-authorized vendor; the $12.95 print fee is the only cost in the process.7Indiana State Police. ISP – Firearms Licensing Then visit your local sheriff’s office or municipal police department for residency verification and local review before the file goes to the Indiana State Police.10Indiana State Police. Indiana State Police Firearms Licensing Portal If approved, the license arrives by mail.
Where You Still Can’t Carry
Permitless carry doesn’t override location restrictions. Indiana prohibits firearms on school property, in airports and on aircraft, and on riverboat casinos.11IN.gov. Are There Places Where It Is Illegal to Carry a Handgun Even Though I Have a Valid Handgun License Counties may restrict firearms in buildings containing courtrooms, though not in portions of those buildings occupied by private businesses or residential tenants.12Indiana General Assembly. Indiana Code Title 35 – 35-47-11.1-4 Private property owners can prohibit firearms on their premises, and posted restrictions must be honored.
Federal buildings are off-limits under 18 U.S.C. § 930. That covers post offices, Social Security offices, VA buildings, and federal courthouses, with penalties up to one year in prison and up to two years for a federal courthouse.13Office of the Law Revision Counsel. 18 USC 930 – Possession of Firearms and Dangerous Weapons in Federal Facilities In national parks, firearms are allowed on trails and in outdoor areas as long as you comply with state law, but not inside any federal building within the park.
Traveling Out of Indiana
Indiana’s permitless carry right does not extend across state lines. If you’re driving out of state, check that state’s laws before you go. Your Indiana License to Carry gives you legal standing in roughly 31 states, but reciprocity agreements change and some states add restrictions Indiana doesn’t have.
If you’re flying, TSA rules require firearms to be unloaded, locked in a hard-sided container, and packed in checked baggage only. You must declare the firearm to the airline at the ticket counter every time you check it.14TSA. Transporting Firearms and Ammunition Ammunition may be packed in the same checked bag but must be in its original packaging or a container designed for it. Firearms are never permitted in carry-on bags.
