Does MassHealth Cover Abortion? Eligibility and Gestational Limits

Yes, MassHealth does cover abortion, and members pay nothing for it. Both medication abortion and surgical abortion are covered as part of the program’s family planning services, with no copays, deductibles, or other cost-sharing.1Mass.gov. Sexual and Reproductive Health Service Insurance and Cost Because the federal Hyde Amendment blocks federal Medicaid dollars from paying for most abortions, Massachusetts uses state funds to cover the care.

What Is Covered

MassHealth covers abortion by medication or surgery.2Mass.gov. MassHealth Sexual and Reproductive Health Services for Members No referral is required for pregnancy-related care, including abortion.3Mass.gov. Information for Pregnant MassHealth Members

Coverage doesn’t end when the pregnancy does. MassHealth covers healthcare services for 12 months after a pregnancy ends, regardless of the outcome, and members who had an abortion within the last three months may be eligible for 12 months of continuous coverage starting from the date the pregnancy ended.3Mass.gov. Doula support is also covered during labor, delivery, miscarriage, or abortion, and for up to 12 months after the pregnancy ends. The doula benefit launched in the spring of 2024 and is open to all pregnant and postpartum members without an individual provider recommendation.4Mass.gov. When MassHealth Pays for an Abortion

MassHealth pays for an abortion when one of two conditions is met: a provider determines the abortion is medically necessary “in light of all factors affecting the pregnant individual’s health,” or the pregnancy resulted from rape or incest that was reported to a law enforcement agency or public health service within 60 days.6Cornell Law Institute. 130 CMR 433.455 The medical necessity standard is broad, and Massachusetts is among the states that cover all or most abortions for Medicaid enrollees on that basis.7KFF. Providers handle the paperwork. They must complete a Certification for Payable Abortion form and keep it in the member’s record, with extra documentation required in specific situations, such as when two providers must certify the risk of severe, long-lasting physical health damage, or when law enforcement or public health documentation must accompany a rape or incest claim.6Cornell Law Institute. 130 CMR 433.455 Providers cannot use any form of coercion, and a member’s decision about abortion cannot affect their eligibility for other MassHealth benefits.8Cornell Law Institute. 130 CMR 484.002

Who Qualifies, Including Noncitizens

MassHealth eligibility generally depends on income, residency, and citizenship or immigration status. Pregnancy changes that calculation. Pregnant individuals can qualify for MassHealth Standard, the program’s comprehensive coverage tier, regardless of immigration status, as long as they meet income guidelines at or below 200% of the federal poverty level.9Mass.gov. MassHealth Information for Noncitizens That coverage runs through 12 months postpartum.3Mass.gov. Information for Pregnant MassHealth Members

Noncitizens who don’t otherwise qualify for comprehensive MassHealth may be limited to MassHealth Limited, which covers only emergency medical expenses. But under the pregnancy exception, undocumented pregnant members can access the full range of MassHealth Standard benefits, including abortion.

Gestational Limits and Minors

Massachusetts law lets a physician, physician assistant, nurse practitioner, or certified nurse midwife perform an abortion when, in their best medical judgment, the pregnancy has existed for less than 24 weeks.10Mass.gov. Mass General Laws c.112 Section 12M After 24 weeks, abortion is permitted in cases of fatal fetal diagnoses under the 2020 ROE Act.11Mass.gov. Accessing Abortion Care in Massachusetts MassHealth follows these same legal parameters when paying for care.12Cornell Law Institute. 130 CMR 484.001

For minors, parental consent is required for anyone under 16. The 2020 ROE Act ended the parental consent requirement for 16- and 17-year-olds.13American Journal of Public Health. Impact of Removing Parental Consent Requirements on Abortion Timing A minor under 16 who cannot or does not want to get a parent’s permission can petition a court through a judicial bypass process.14Planned Parenthood. Finding a Provider

Because no referral is required, members can go directly to a covered provider. Planned Parenthood League of Massachusetts accepts Medicaid. Its Greater Boston health center, for example, lists Medicaid, Medicaid Family Planning Benefits, and Medicaid for Pregnant Women among accepted coverage.15Planned Parenthood. Greater Boston Health Center Because federal law currently blocks Planned Parenthood from receiving federal Medicaid reimbursement, it covers the cost of care for MassHealth patients through a combination of state funding and donor support. Members should not have to pay out of pocket.16Planned Parenthood. Medicaid Information

One boundary worth naming: MassHealth warns that “crisis pregnancy centers” or “pregnancy resource centers” are not part of the MassHealth network and do not offer the reproductive health services MassHealth covers, including abortion.2Mass.gov. Why It’s Free in Massachusetts

Since 1976, the federal Hyde Amendment has barred the use of federal Medicaid dollars for abortion except in cases of life endangerment, rape, or incest. States can choose to use their own money to cover abortion more broadly, and Massachusetts is one of roughly 20 that do.17Guttmacher Institute. State Insurance Coverage of Abortion Under Medicaid The legal foundation traces to the 1981 state court decision in Moe v. Secretary of Administration and Finance, brought by the ACLU of Massachusetts, which established that the state constitution protects reproductive freedom.18ACLU of Massachusetts. Moe v. Secretary of Administration and Finance

The no-cost piece became explicit in 2022. Chapter 127 of the Acts of 2022, “An Act Expanding Protections for Reproductive and Gender-Affirming Care,” amended the MassHealth statute to require coverage for “abortion, as defined in section 12K of chapter 112, abortion-related care” and prohibited any deductible, coinsurance, copayment, or other cost-sharing for those services.19General Court of Massachusetts. Acts of 2022, Chapter 127 The same statute reaches commercial health insurance plans and the Group Insurance Commission, though self-insured plans and qualifying religious employers may be exempt from the commercial mandate.20Mass.gov.
