Does South Carolina Accept an International Driver’s License?

South Carolina does accept an International Driving Permit, but only as a translation of the foreign license you already hold. The state’s actual authority to let you drive comes from your valid home-country license under South Carolina Code 56-1-30, which exempts nonresidents aged sixteen and up who carry a valid license from their home country.¹ The IDP is not a standalone license and cannot replace one. It translates your foreign license into English so an officer can read it during a traffic stop.²

If your foreign license is already printed in English, you don’t need an IDP at all. If it isn’t, the SCDMV strongly advises getting one before you arrive. South Carolina law doesn’t require the IDP by statute, but showing an officer a license they can’t read turns a routine stop into a problem.

How Long You Can Drive on a Foreign License

There’s no single cutoff. South Carolina’s exemption lasts as long as you can genuinely claim nonresident status. Under Section 56-1-30, you lose the exemption if you have “for all other intents and purposes” moved your residence into the state, which can happen when you sign a lease, take a job, or enroll in school.¹

Short-Term Visitors

If you’re here on a tourist visa or visa waiver, your driving privileges last as long as your authorized stay in the United States. There’s no separate 30-day or 90-day driving clock. You’re legal for the duration of your lawful visit, and illegal the day you overstay, even if your foreign license itself won’t expire for years.

International Students

F-1 and J-1 students sit in an awkward middle ground: physically present for years, but with immigration status tied to a program rather than a fixed date. The Department of Homeland Security confirms F and M students and their dependents may be eligible to drive while in the United States.³ As a practical matter, Clemson University advises international students to obtain a South Carolina license before their first 90 days expire, even with a valid IDP in hand.⁴ Wait longer and you risk being treated as an unlicensed resident.

Employed Foreign Nationals From Reciprocal Countries

South Carolina offers a longer window for certain workers. If you’re employed in the state, at least eighteen, and hold a valid license from a country whose licensing standards are at least as strict as South Carolina’s and that grants reciprocal driving rights to South Carolina residents, you can drive on your foreign license for up to five years. Your dependents get the same benefit.¹ The SCDMV decides which countries qualify, so confirm eligibility with them before relying on this exception.

Military Personnel

Active-duty service members returning to the U.S. with a foreign license or one issued by the Armed Services can drive in South Carolina for up to 90 days from the date they return.¹

Documents to Carry

Keep your original, valid foreign license on you whenever you drive. South Carolina law requires it in your “immediate possession,” not back at your hotel.¹ Carry your passport with a valid visa or entry stamp to establish your legal presence and support your claim to nonresident status. A hotel reservation or return ticket isn’t legally required, but either helps confirm you’re a visitor rather than an undocumented resident.

Insurance You Must Have

Every driver on South Carolina roads must carry liability insurance, and foreign license holders are no exception. The minimums are $25,000 for bodily injury to one person, $50,000 for bodily injury to two or more people in a single accident, and $25,000 for property damage.⁵ Driving without coverage triggers a $550 uninsured motorist fee on top of any other penalty.

Rental car policies typically satisfy these minimums; confirm the details at the counter. Borrowing someone else’s car is trickier. Auto insurance in South Carolina generally follows the vehicle, so the owner’s policy may cover you, but some insurers limit or exclude coverage for drivers with foreign licenses. The owner should check with their insurer before handing you the keys.

Only AAA and AATA Issue Real IDPs

The only organizations authorized by the U.S. Department of State to issue International Driving Permits are the American Automobile Association (AAA) and the American Automobile Touring Alliance (AATA).⁶ Any website selling an IDP through a different organization is a scam. The Federal Trade Commission has warned that scammers build professional-looking sites to sell fake IDPs, often at inflated prices, to take your money or personal information.⁷

A fake IDP is worse than useless. If an officer discovers it, you’ll be treated as driving without valid documentation. South Carolina does not issue IDPs itself and does not recognize third-party documents claiming to serve as international permits. Get your IDP from AAA or AATA before you leave home.

Penalties for Driving Without a Valid License

If your foreign license has expired, your visa has lapsed, or your IDP turns out to be fraudulent, South Carolina treats you the same as anyone driving without a license. Under Section 56-1-440, this is a misdemeanor, and penalties escalate with each offense:⁸

First offense: a fine of $50 to $100, or up to 30 days in jail.
Second offense: a $500 fine, or up to 45 days in jail, or both.
Third and subsequent offenses: 45 days to six months in jail.

The statute contains one important safety valve. If you can prove to the court that you actually held a valid license when you were stopped, the charge must be dismissed. That matters if you had a valid foreign license but simply didn’t have it on you at the time.⁸

Officers may also impound the vehicle, particularly if no licensed driver can take over on the spot or if the license issue accompanies something like reckless driving. Skipping a court date on a citation can produce a bench warrant, which brings immigration complications on top of the criminal ones.

When You Have to Switch to a South Carolina License

Once you establish residency, the clock starts. The SCDMV requires new residents with a valid out-of-state or foreign license to apply for a South Carolina license within 45 days of moving to the state.⁹ After that window closes, you’re driving unlicensed.

Not every SCDMV branch handles international applications, so check which offices offer international customer services first. You’ll need original documents in several categories:¹⁰

Proof of identity, date and place of birth, and authorized stay: usually an unexpired passport with valid visa plus your I-94 arrival record. Permanent residents can use their unexpired green card.
Proof of a South Carolina address: a current lease, utility bill, or similar document mailed to your SC address.
A document confirming your authorized length of stay for your specific visa category.
Your Social Security number, or a letter from the Social Security Administration confirming you’re ineligible for one.

Every applicant takes a vision screening. Whether you also need the written knowledge exam and road skills test depends on your home country. If it has a reciprocal agreement with South Carolina and the SCDMV considers its standards at least as strict, you may be able to exchange your license directly. Otherwise, expect both tests. The branch issues a temporary driving certificate on the spot; the permanent card arrives by mail from a central printing facility.¹¹

Commercial Driving Is Different

Everything above covers passenger vehicles. Commercial driving runs on a separate federal framework. As of March 2026, the Federal Motor Carrier Safety Administration limits non-domiciled Commercial Driver’s Licenses to applicants in H-2A, H-2B, and E-2 status. No other nonimmigrant categories qualify, and every transaction, including renewals and address changes, requires proof of lawful immigration status. A Form I-797C alone is not enough.¹²
