Don Lemon Lawsuit: Minnesota Charges, Musk Suit, and Church Case

Don Lemon is currently tied up in three active legal matters: a federal criminal indictment in Minnesota over an anti-ICE protest at a St. Paul church, a civil lawsuit from a parishioner who was inside that church, and his own civil suit against Elon Musk and X in San Francisco over a scrapped talk show deal that a judge cleared for trial in July 2025. A fourth case that older searches often surface, a 2019 sexual assault suit by bartender Dustin Hice, was voluntarily dropped in 2022.

The Federal Criminal Case in Minnesota

Lemon was arrested on January 30, 2026, at a Beverly Hills hotel where he was covering the Grammy Awards.¹ A federal grand jury in Minnesota had returned an indictment against him the day before, charging him with two counts: conspiracy against the right of religious freedom at a place of worship, and interfering with the exercise of religious freedom at a place of worship. The charges carry a maximum sentence of 10 years in prison.²

The charges stem from a January 18, 2026 protest at Cities Church in St. Paul during a federal immigration enforcement push known as “Operation Metro Surge.” A pastor at the church was also a Special Agent for U.S. Immigration and Customs Enforcement. Protesters entered a Sunday service chanting “ICE out” and “Justice for Renee Good,” a person who had died in connection with federal immigration operations.³ Lemon livestreamed the event and has maintained he was there as an independent journalist.¹

Prosecutors initially struggled to get him charged. Magistrate Judge Douglas Micko approved arrest warrants for three protest suspects on January 20, 2026, but refused to approve them for Lemon, his producer, and three others. Chief District Judge Patrick Schiltz then declined a Justice Department request to overturn that decision, writing that “there is no evidence that those two engaged in any criminal behavior or conspired to do so.”⁴ A three-judge Eighth Circuit panel rejected the government’s emergency mandamus petition on January 23, 2026.⁵ Prosecutors then went directly to a grand jury.

Release, Arraignment, and Current Status

Magistrate Judge Patricia Donahue in Los Angeles released Lemon on personal recognizance, rejecting prosecutors’ request for a $100,000 unsecured bond, and permitted him to travel internationally with court approval.⁶ He pleaded not guilty at his arraignment on February 13, 2026 in Minneapolis federal court.⁷ The case is United States v. Levy-Armstrong, No. 26-cr-00025, in the U.S. District Court for the District of Minnesota.⁸

A superseding indictment filed in late February 2026 expanded the case to 39 defendants total, adding 30 people to the original nine without adding new charges.⁹¹⁰ Lemon’s attorney, Abbe Lowell, has signaled the defense will challenge the constitutionality of the prosecution and seek access to grand jury materials.⁷ A pretrial scheduling order was entered in March 2026, and no trial date has been publicly reported.¹¹

Press Freedom Arguments

Lowell has called the charges an “unprecedented attack on the First Amendment.”¹ The Reporters Committee for Freedom of the Press has said use of a federal religious-protection statute against a journalist is “apparently unprecedented.”¹² Career DOJ prosecutors reportedly refused to participate in the case, citing insufficient evidence.¹³ A Washington Post analysis of video and audio found that “at no point does Lemon appear to obstruct the pastor’s movement.”

Media ethics observers have raised separate concerns. Lemon helped a protester free a truck stuck in a snow drift and remained in the church for several minutes after the pastor asked him to leave. Dan Axelrod of the Society for Professional Journalists said Lemon failed to “adequately label his advocacy journalism” and “glorified his sources.”¹²

Civil Suit From a Cities Church Parishioner

Parishioner Ann Doucette sued Lemon, civil rights attorney Nekima Levy-Armstrong, and several other protesters in February 2026 in the U.S. District Court for the District of Minnesota.¹⁴ The complaint alleges civil conspiracy, aiding and abetting, intentional infliction of emotional distress, interference with religious exercise, and trespassing, and says Doucette suffered “severe emotional distress, fear, anxiety, and trauma” that deprived her of her right to freely practice her faith.²

The suit argues that Lemon’s presence and cameras “incentivized” the protesters and encouraged more aggressive behavior. Lemon’s representatives have called the suit a “threat to press freedom” and said he “did not direct or participate in the disruption himself.”¹⁵ The case remains active.¹⁴

Lemon’s Lawsuit Against Elon Musk and X

Lemon filed suit in San Francisco Superior Court in August 2024, seeking $35 million in damages from Musk and X.¹⁶ The complaint alleged fraud, breach of contract, misappropriation of name and likeness, negligent misrepresentation, and unjust enrichment. Lemon says he was induced through “false promises and representations” to invest hundreds of thousands of dollars in a production company and studio for a show that never launched on the platform.¹⁷

According to the lawsuit, the deal called for $1.5 million a year, 60 percent of gross advertising revenue from Lemon’s content, and performance bonuses tied to follower growth. The show was to air three 30-minute episodes per week, with X holding exclusive rights to video content for 24 hours before distribution elsewhere. Musk, then-X CEO Linda Yaccarino, and head of content Brett Weitz allegedly promised Lemon full editorial control, and Musk reportedly told him there would be “no need for a formal written agreement.”¹⁷

The partnership collapsed after Lemon’s first episode, a 90-minute interview recorded on March 8, 2024 in which he pressed Musk on his meeting with Donald Trump, his use of ketamine, and hate speech on the platform. People familiar with the matter said Musk was “miffed” by the questioning.¹⁸ Within a day, Musk texted Lemon’s agent that the partnership was canceled, and X told Lemon it would not pay him because there was no signed agreement.¹⁷

Where the Musk Case Stands

Musk removed the case to federal court in September 2024, arguing X’s principal place of business had moved to Bastrop, Texas. U.S. Senior District Judge Maxine Chesney sent the case back to state court, finding “no evidence that the property even has an office building on it” in Bastrop, and noting Musk had personally signed registration statements in Iowa and Oregon that still listed his San Francisco address.¹⁹

Back in San Francisco Superior Court, Judge Harold Kahn ruled in July 2025 that Lemon had “plausibly alleged” fraud by false promise and the existence of an implied contract, and denied the defense motions to move the case to Texas and to strike the complaint.²⁰²¹ Five claims will proceed: fraud, misappropriation of name and likeness, breach of implied contract, promissory estoppel, and unjust enrichment. Kahn also allowed Lemon to amend his breach of express contract claim to clarify whether the alleged agreement was oral, written, or implied.

Kahn dismissed the negligent misrepresentation, defamation, retaliation, negligence, and harassment claims. On defamation, he found Musk’s public comments, including comparing Lemon to Charlie and the Chocolate Factory‘s Veruca Salt, were “either non-actionable opinions or not susceptible to a defamatory interpretation.” On harassment, he found no evidence X had “invidiously targeted” Lemon because of his protected status.²¹ No trial date has been set as of mid-2025.²⁰

The Dustin Hice Case Is Closed

Readers looking into older reporting on a Lemon lawsuit sometimes find a 2019 case brought by Sag Harbor bartender Dustin Hice, who alleged Lemon assaulted him at a bar in 2018.²² That case is no longer active. In March 2022, U.S. Magistrate Judge Thomas Locke ordered Hice to pay $77,000 in sanctions for tampering with evidence and attempting to bribe witnesses.²³ In May 2022, Hice voluntarily dropped the suit, saying that “after a lot of inner reflection and a deep dive into my memory,” his recollection “were not what I thought they were when I filed this lawsuit.” Lemon’s attorney, Caroline Polisi, said Lemon never paid Hice anything.
