Dr. Ogunseinde Lawsuit: Four Malpractice Suits and Retaliation Claim

Dr. Babajide Ogunseinde, a Longview, Texas spine surgeon, is the subject of multiple lawsuits on two fronts: four active medical malpractice suits from former patients who allege botched or unnecessary spinal surgeries, and his own 2025 lawsuit against Longview Regional Medical Center claiming he was fired in retaliation for raising safety concerns. Four earlier malpractice cases against him have already been settled or dismissed, bringing the total filed in Gregg County since 2022 to eight.¹

The Four Active Malpractice Suits

Each of the pending cases alleges that Ogunseinde performed a negligent or medically unnecessary spinal procedure that caused serious, lasting harm.¹

Liquita Williams

Williams alleges Ogunseinde performed three surgeries on her between 2022 and 2024 that left her permanently disabled. According to her complaint, he misdiagnosed her condition and failed to account for pre-existing congenital spinal fusions, placed iliac bolts in the wrong position, and performed a laminectomy without proper stabilization, causing a kyphotic deformity. She also says she consented to surgery on her third and fourth vertebrae but that Ogunseinde operated on the second and third instead.¹

Dr. Henry Barnard II, a board-certified orthopedic spine surgeon retained as an expert witness, wrote that Ogunseinde violated the standard of care and misdiagnosed Williams, calling one procedure “honestly nonsensical because it is contradictory to her anatomy.”¹ Williams is represented by attorney Todd Turner.

Efrem Fryar

Fryar alleges Ogunseinde performed a negligent spine surgery on January 17, 2024, days after Fryar was diagnosed with cervical disc disease. The suit claims the surgeon injured Fryar’s spinal cord during the operation, leaving him partially paralyzed.¹

Arthur Perkins

Perkins filed suit in June 2025, seeking more than $1 million in damages tied to a spinal surgery Ogunseinde performed on June 20, 2023.² According to the complaint, Perkins sustained a dural tear during the procedure that Ogunseinde attempted but failed to repair and allegedly did not document. The suit also says the surgery was more invasive than medically necessary. Perkins reports developing left foot drop, lumbar pain, numbness, and difficulty walking after the operation, none of which he had before.¹ The defendants also include Longview Regional Medical Center, the Longview Orthopaedic Clinic Association, and Regional Clinics of Longview.

Tommy Hemphill

Hemphill alleges that a thoracic spine surgery Ogunseinde performed on June 4, 2025, caused permanent injury. His lawsuit claims the surgeon failed to act on signs of spinal cord injury during the procedure and that the surgery itself was medically unnecessary.¹

Earlier Cases

Four earlier malpractice suits in Gregg County have already been settled or dismissed, though the terms and amounts were not publicly disclosed.¹ One of them, Jill Spearman v. Babajide Ogunseinde, MD et al., was originally filed in Dallas County in February 2022 and transferred to Gregg County later that year. Court records show the case is closed, but the outcome is not detailed publicly.³ The remaining three earlier plaintiffs have not been identified in available reporting.

How Ogunseinde Is Responding

His attorneys have filed written responses in the active cases generally denying the claims. Ogunseinde has said he treats high-risk patients other surgeons often decline and that he has performed thousands of successful surgeries. He has also cited the FDA approval he received in 2024 for a sacroiliac joint fusion technique as evidence of his surgical expertise.¹

Personal injury attorney Amanda Demanda, offering outside context to the Longview News-Journal, said the volume of suits against a spine surgeon does not on its own indicate malpractice, noting that spine surgery is a high-risk specialty and each case has to be evaluated individually.¹

Ogunseinde’s Retaliation Suit Against the Hospital

In 2025, Ogunseinde sued Longview Regional Medical Center and several administrators. He alleges that on May 14, 2025, he raised concerns with hospital leadership about untrained, non-certified surgical technicians and nurses being assigned to assist in his spine surgeries. Less than a month later, on June 11, 2025, administrators met with him and halted his surgeries, citing anonymous reports of complications.¹

On July 10, 2025, the hospital terminated Ogunseinde “for cause.” He alleges no specific reasons were provided and that the termination violated his employment agreement. His suit brings claims for whistleblower retaliation, fraud, breach of contract, and wrongful discharge. As of early 2026, the case had not progressed significantly.¹

Current Surgical Status

Ogunseinde has been prohibited from performing surgeries at Longview Regional Medical Center since June 11, 2025.¹
