What Frank Tufano Alleges
Tufano’s complaint claims that a cosmetic eye surgery Dr. Taban performed in Beverly Hills left him with severe complications, including near-blindness and facial deformity. The damages figure has grown over the course of the litigation. Where the Case Stands
Tufano first filed in the U.S. District Court for the Middle District of Pennsylvania. Within a day, Magistrate Judge William I. Arbuckle ordered the case transferred to the Central District of California, where the surgery took place. The federal case, assigned to Judge Stephen V. Wilson, was terminated on June 24, 2025, then reopened on August 8, 2025. As of June 2026 it remains active, with the most recent docket entry (May 18, 2026) reflecting a motion by Tufano on a discovery dispute. Other Defendants Have Been Dismissed
Tufano named several professional organizations and the Medical Board of California alongside Dr. Taban and his practice, alleging they failed to recognize or prevent the alleged malpractice. Most have been removed from the case.
In the state case, on May 7, 2025, Judge Moreton granted the American Society of Ophthalmic Plastic and Reconstructive Surgery’s motion to quash for lack of jurisdiction. The court sustained the Medical Board of California’s demurrer without leave to amend, finding that Tufano had not complied with the Government Tort Claims Act, a prerequisite for suing a state agency.4Rulings.law. In the federal case, the American Academy of Ophthalmology, the American Board of Cosmetic Surgery, the American Society of Ophthalmic Plastic and Reconstructive Surgery, and the Medical Board of California were all terminated as defendants on June 3, 2025. Tufano’s Broader Litigation History
Court records show Tufano has filed numerous lawsuits on his own behalf. In a November 2025 ruling in a separate suit Tufano brought against Google, Magistrate Judge Martin C. Carlson described him as a “prodigious, but prodigiously unsuccessful, pro se litigant.” The court identified at least five other cases Tufano filed between September 2024 and January 2025, including suits against Reddit and TikTok, all either dismissed or recommended for dismissal.5GovInfo. That history does not speak to the merits of the medical claims against Dr. Taban. It does explain why so much of the procedural activity so far has involved defendants being removed on jurisdictional and procedural grounds rather than any examination of the underlying surgery.

A minority of reviewers have posted detailed negative accounts. Some describe outcomes including sunken or “skeletonized” eyes, distorted shapes, and rounded eye corners following orbital decompression and related procedures. Several allege that before-and-after photos were taken shortly after surgery, while swelling was still present, and do not reflect long-term results.10RealSelf. One RealSelf reviewer who underwent orbital decompression and almond eye surgery wrote that Dr. Taban had told them the risk of major complications was “less than 1%.” The reviewer pointed to Dr. Taban’s own 2017 study in the Aesthetic Surgery Journal, in which two of 26 patients reported dissatisfaction with outcomes including sunken eyes, and cited consultations with other surgeons who estimated the risk of diplopia from the procedure at between 10% and 40%.11RealSelf. What Has Not Been Decided
Dr. Taban has not been found liable in the Tufano lawsuit or in any related matter. The allegations in the court filings and the patient reviews are unproven, and Dr. Taban has the opportunity to contest them.
