Batiste Settlement: Closed and Paid
Church & Dwight, the maker of Batiste, agreed to a $3.1 million settlement made up of $2.5 million in cash plus $600,000 in vouchers. One detail worth noting: Church & Dwight never recalled Batiste. In November 2022, the company said its propellant suppliers had confirmed the propellants used in Batiste products did not contain benzene.4CNN. IGK Settlement: Closed, Payments Underway
Luxury Brand Partners settled claims involving IGK Direct Flight, Jet Lag, and First Class dry shampoos for $850,000. U.S. residents who purchased the products for personal use before April 23, 2024 were eligible, and claims closed on November 19, 2024.5ClassAction.org. Unilever Settlement: Denied Preliminary Approval
The biggest current development is what happened to the Unilever deal. In May 2025, Unilever agreed to a $3.625 million settlement to resolve allegations that its Suave, TIGI, TRESemmé, Dove, and Nexxus dry shampoos contained dangerous levels of benzene.1ClassAction.org. On February 17, 2026, U.S. District Judge Michael P. Shea denied preliminary approval. He found the proposed class “impermissibly broad,” pointing out that it swept in purchasers of products never shown to be contaminated and that the proposed start date of January 1, 2014 had no evidentiary connection to when contamination actually occurred. The plaintiffs are reworking the class definition and settlement terms. Other Cases: Dismissals and Ongoing Suits
Not every case has advanced. On September 23, 2024, U.S. District Judge Sharon Johnson Coleman dismissed the Paul Mitchell class action without prejudice, ruling that plaintiffs failed to show the specific Invisiblewear Brunette Dry Shampoo bottles they purchased were contaminated and therefore lacked standing. Other cases remain active. Class actions were filed in early 2023 against Sol de Janeiro over its Brazilian Joia Dry Shampoo and against DMP Color, LLC (dpHUE) over its Apple Cider Vinegar Dry Shampoo in the Northern District of Illinois.11Milberg. Why These Products Contained Benzene
Benzene was never an ingredient. It rode in as a contaminant on the propellants used to spray the product out of the can. Butane, isobutane, and propane are petroleum derivatives, and if they aren’t sufficiently purified they can carry benzene as a trace impurity.14Time. The initial discovery came from Valisure, an independent laboratory. On October 31, 2022, it filed an FDA citizen petition reporting that 70 percent of 148 dry shampoo batches from 34 brands contained detectable benzene, with three lots from a single brand exceeding 100 ppm. The FDA conditionally limits benzene to 2 ppm in certain drug products.17Valisure. What the Science Says About Actual Harm
Benzene is a known human carcinogen. The International Agency for Research on Cancer has held that designation since 1979, and long-term exposure at high levels is linked to leukemia and other blood cancers.20Huntsman Cancer Institute. Dry Shampoo and Cancer Risk: What You Need to Know
Whether the levels found in dry shampoos actually cause harm is a different question, and the current answer from public health experts is cautious. The Dana-Farber Cancer Institute has said “the exact duration or level of exposure required to cause health issues is not well understood,” and that exposure at the levels found in recalled dry shampoos “is not expected to cause major health issues.”21Dana-Farber Cancer Institute. That gap explains the shape of these cases. They are consumer fraud actions, brought by people who say they paid for products marketed as safe and would not have bought them (or would have paid less) had they known about the benzene. They are not personal injury suits alleging a product gave someone cancer.
Where the Litigation Is Headed
Two recent rulings have set the direction. Judge Coleman’s Paul Mitchell dismissal turned on plaintiffs’ inability to show that their specific bottles were contaminated. Judge Shea’s rejection of the Unilever settlement turned on a class definition that swept in buyers of products never linked to contamination. Courts are asking for a tighter chain between what testing actually found, which products were affected, and which consumers are in the class.
