The East Palestine, Ohio train derailment happened on the evening of February 3, 2023, when a Norfolk Southern freight train carrying hazardous chemicals came off the tracks in the small village near the Pennsylvania border, leading to a controversial burn of vinyl chloride, a mandatory evacuation, and years of cleanup, litigation, and federal safety debate that are still unfolding. Thirty-eight of the train’s 149 cars derailed. Eleven of those carried hazardous materials. No one was killed, but the fallout has reshaped rail safety policy, produced a $600 million class-action settlement, and drawn a $310 million federal enforcement package that is still awaiting final court approval.
What Happened on February 3, 2023
At about 8:55 p.m., Norfolk Southern train 32N derailed at milepost 49.5 on the Fort Wayne Line, roughly a quarter-mile west of the Ohio-Pennsylvania state line.1Federal Railroad Administration. No one died and no one was hurt in the derailment itself. Norfolk Southern later reported 24 minor injuries from inhalation hazards during the fire and cleanup: 18 civilians and 6 remediation contractors.1Federal Railroad Administration. The Vent and Burn Decision
Three days after the derailment, on February 6, 2023, the local incident commander ordered a “vent and burn” of five tank cars carrying vinyl chloride monomer. East Palestine fire chief Keith Drabick was given 13 minutes to approve it.3Chemical & Engineering News. Burning vinyl chloride breaks down into carbon monoxide, hydrogen chloride, and phosgene gas. The hydrogen chloride byproduct killed an estimated 3,500 fish in local waterways.4Pennsylvania Capital-Star. The National Transportation Safety Board later determined the vent and burn was unnecessary. Norfolk Southern and its contractors had told the incident commander the tank cars were at imminent risk of a polymerization-induced explosion, but the NTSB found that claim was unsupported. The tank car manufacturer, OxyVinyl, had inspected the cars, found a low risk of explosion, and reported the cars were cooling. Why the Train Derailed
The NTSB completed its investigation in June 2024 and issued report RIR-24-05 with 34 safety recommendations.6National Transportation Safety Board. NTSB News Release NR20240625 The probable cause was an overheated wheel bearing on the train’s 23rd car, a hopper car, that failed and separated the axle. The post-derailment fire likely started when a flammable liquid spilled from a punctured DOT-111 tank car.7National Transportation Safety Board. Railroad Investigation Report RIR-24-05
Several factors made the disaster worse. The train had passed a wayside hot bearing detector that flagged the failing bearing, but the alert was low-priority, and the NTSB found these detectors are inherently limited and often produce misleadingly low readings. Detector spacing on Norfolk Southern’s network and the company’s operating procedures kept the crew from receiving enough warning to stop in time. The older DOT-111 tank cars still in hazardous materials service have a lower survival rate in derailments than newer designs. Health Effects and Ongoing Research
In the weeks after the derailment, residents reported headaches, respiratory irritation, skin and eye irritation, and anxiety.8National Institutes of Health. NIH Long-Term Health Research, East Palestine, Ohio Train Disaster The CDC’s Agency for Toxic Substances and Disease Registry surveyed 701 people between February 21 and March 31, 2023. Of those, 86% reported exposure to hazardous substances, 92% reported at least one new or worsening physical symptom, and 70% reported at least one new or worsening mental health symptom. Forty-four percent said they had unmet needs, most commonly for clean water. A survey of 114 Pennsylvania first responders found that firefighters and those involved in fire suppression were more likely to report vapor and gas contact, which was associated with higher rates of multiple symptoms.10Disaster Medicine and Public Health Preparedness. For longer-term answers, the National Institutes of Health committed $10 million over five years to the East Palestine Train Derailment Health Research Program. The consortium includes the University of Kentucky, the University of Pittsburgh, Yale, Ohio State, Case Western Reserve, Texas A&M, and UC San Diego. Its work covers long-term health outcomes, biological markers of risk, and the effects of chemical exposure on DNA damage and organ function.12National Institute of Environmental Health Sciences. Cleanup and Water Safety
EPA personnel have been on-site since the night of the derailment. The agency describes the cleanup as nearing completion, with long-term monitoring continuing.2U.S. Environmental Protection Agency. East Palestine, OH Train Derailment Independent monthly testing by the Ohio EPA has found no contaminants associated with the derailment in the village’s municipal drinking water, and vinyl chloride has not been detected in the municipal supply or any water supply wells.13U.S. Environmental Protection Agency. Surface water has improved substantially. Butyl acrylate in Sulphur Run dropped from a post-derailment peak of 154,000 parts per billion to a final detection of 1.1 ppb on April 8, 2023. After more than 4,200 samples, the monitoring program transitioned in June 2024 to long-term monthly sampling focused on Sulphur Run and Leslie Run. Cleanup data itself has come under scrutiny. In September 2025, the EPA identified discrepancies in groundwater sampling data for 2-butoxyethanol. Analysts at ALS Houston, a subcontractor to the prime cleanup contractor Tetra Tech, had been altering measurements. Independent testing at the EPA’s PHILIS laboratory confirmed no 2-butoxyethanol was present. The $600 Million Class-Action Settlement
Norfolk Southern reached a $600 million class-action settlement covering residents and businesses within 20 miles of the derailment site.17Ideastream. Pearson in the U.S. District Court for the Northern District of Ohio. The $310 Million Federal Consent Decree
In March 2023, the United States filed a Clean Water Act complaint against Norfolk Southern. In May 2024, the Justice Department and EPA announced a settlement valued at more than $310 million.20U.S. Department of Justice. Ohio’s Separate Lawsuit
On March 14, 2023, Ohio Attorney General Dave Yost filed a 58-count civil suit against Norfolk Southern alleging violations of federal and state environmental laws, including CERCLA and Ohio’s hazardous waste and water pollution statutes, along with negligence, public nuisance, and trespass claims. Property Values and Local Economy
A December 2025 study in the Journal of Sustainable Real Estate found that residential property values in the area covered by Norfolk Southern’s Value Assurance Program dropped by about 14% compared to control communities, with estimates ranging from 12.8% to 15.8%. The Ohio Department of Development created a forgivable loan program for businesses within a two-mile radius, offering 0% interest loans of $10,000 to $1 million for payroll, rent, utilities, and inventory. What Is Still Unresolved
More than three years on, several major pieces of the East Palestine story are still open. The federal $310 million consent decree awaits final court approval. Ohio’s state lawsuit is unresolved. The NIH’s five-year health study is underway and results will take time. And the Railway Safety Act, first introduced in the 118th Congress as S. 576, stalled without a floor vote. As of May 2026, its provisions have been folded into the BUILD America 250 Act (H.R. 8870), which cleared the House Transportation and Infrastructure Committee on May 22, 2026, with bipartisan support. The NTSB called for an accelerated phaseout of DOT-111 tank cars, but that timeline is set by the FAST Act. Under the current schedule, DOT-111 cars must be replaced with modern DOT-117 models by May 1, 2025, for the most dangerous Packing Group I flammable liquids, and by May 1, 2029, for Packing Group II and III materials, with possible extensions to 2027 and 2031 if shop capacity is insufficient.31Federal Register.
