The El Paso noise ordinance, found in Chapter 9.40 of the city code, sets decibel limits that change with the zone you’re in and the time of day, and it treats violations as Class C misdemeanors with fines that can reach $500 per occurrence. Residential areas are held to the strictest standard: 55 decibels during the day and 50 at night, roughly the volume of a normal conversation.
Decibel Limits by Zone
Every property in the city falls into one of three noise zones, each with a daytime and a nighttime ceiling:
- Zone I (residential): 55 dB(A) day, 50 dB(A) night
- Zone II (commercial): 65 dB(A) day, 60 dB(A) night
- Zone III (manufacturing/industrial): 70 dB(A) day, 65 dB(A) night

Quiet Hours and the Music Adjustment
Quiet hours run from 10:00 p.m. to 7:00 a.m. every day. That’s when the lower nighttime number kicks in.
One wrinkle catches people off guard. The ordinance adds 5 dB(A) to each limit when the sound is speech or music, so a daytime residential property effectively allows up to 60 dB(A) for music. What the Ordinance Exempts
Not every loud activity is a violation. Chapter 9.40 carves out specific exemptions:
- Construction and remodeling on weekdays and Saturdays, 7:00 a.m. to 8:00 p.m., as long as noise doesn’t exceed 65 dB(A) above the zone’s standard limit when measured at a residence. Construction is never exempt on Sundays or holidays.
- Lawn mowers, leaf blowers, and other property maintenance equipment between 7:00 a.m. and 10:00 p.m. on any day.
- Sirens and alarms on emergency vehicles or machinery. Non-emergency alarms must stop within ten minutes of activation.
- Athletic events and entertainment on public parks, playgrounds, and school grounds between 7:00 a.m. and 10:00 p.m.
- Noncommercial speech in public spaces and rights-of-way.
- El Paso International Airport operations.
- Permitted outdoor gatherings, dances, and shows held between 7:00 a.m. and 10:00 p.m.

Animal Noise
El Paso’s code prohibits animals from making frequent or prolonged noise that disturbs a residential neighborhood. There’s no fixed minute threshold. Enforcement turns on whether the noise is frequent enough or long enough to disturb a reasonable person, and the rule applies around the clock rather than only during quiet hours.3KVIA. The city’s noise complaint form asks for the type of noise (barking, howling, and so on) along with dates and times.4City of El Paso. Noise Complaint Form A written log helps, because officers and judges need to see a pattern.
Vehicles and Amplified Sound
Motor vehicle sound is measured at 50 feet from the vehicle, and the ceiling depends on the type of vehicle and the posted speed:
- Passenger vehicles: 70 dB(A) at 35 mph or less, 79 dB(A) above 35 mph
- Motorcycles: 78 dB(A) at 35 mph or less, 82 dB(A) above 35 mph
- Heavy commercial vehicles (10,000+ lbs GVWR in interstate commerce): 86 dB(A) at 35 mph or less, 90 dB(A) above 35 mph, and 88 dB(A) at a stationary run-up

Sound Amplification Permits
If you’re planning an event that will exceed the standard decibel limits, such as a block party, outdoor concert, or festival, you need a sound amplification permit. The application asks for the event address, the date, and technical specs on the equipment you’ll use.
Applications go to the Planning and Inspections Department at the One Stop Shop Division, 811 Texas Avenue, not to the police department. Fees are non-refundable, and payment is made at the One Stop Shop cashier.5City of El Paso. Sound Amplification Permit Application Incomplete forms don’t move forward. Approved permits spell out the allowed hours and conditions, and the permit needs to be on-site during the event for inspection.
How to File a Complaint
There are three ways to report noise in El Paso:
- Dial 3-1-1 from any home or mobile phone.6City of El Paso. 311

Officers or code enforcement staff may use calibrated sound level meters to get a decibel reading. If the noise exceeds the Chapter 9.40 limits, they can issue a verbal warning, a written notice of correction, or a Class C citation depending on the circumstances.9City of El Paso. Fines and Other Penalties
A violation of Chapter 9.40 is a misdemeanor with a fine of up to $500, and each occurrence counts as a separate offense.2NPC Law Library. The city can also treat an ongoing violation as a nuisance and seek an injunction to force the noise to stop. For permit holders, continued noncompliance can lead the Planning and Inspections Department to suspend or revoke the sound amplification permit.9City of El Paso. When State Law Also Applies
The city ordinance isn’t the only enforcement tool. Under Texas Penal Code Section 42.01, making unreasonable noise in a public place or near a private residence you don’t occupy is disorderly conduct, a state criminal offense rather than a municipal citation. Noise is presumed unreasonable if it exceeds 85 decibels after the person making it has been told by a peace officer or magistrate that the noise is a public nuisance.10State of Texas. Renters Dealing With a Noisy Neighbor
If you rent in El Paso and a neighboring tenant’s noise is making your unit unlivable, your landlord may have to act. Texas law’s implied covenant of quiet enjoyment makes a landlord responsible for disturbances caused by other tenants in the same property. That responsibility doesn’t extend to noise from strangers or from people who don’t rent from your landlord, but if the problem tenant is in the same building or complex, a landlord’s failure to address it can give you grounds for legal relief.11Texas State Law Library.
