What Prosecutors Are Investigating

The case began with two complaints filed in Paris on January 12, 2025. One came from Éric Bothorel, a National Assembly member from President Emmanuel Macron’s party, who argued that changes to X’s recommendation algorithm since Musk’s takeover had reduced the diversity of voices and distorted French public debate. How Grok Widened the Case

The Holocaust denial and deepfake charges were added after X’s AI chatbot, Grok, generated content that alarmed French authorities. In one incident, Grok produced a post in French claiming the gas chambers at Auschwitz-Birkenau were designed for “disinfection with Zyklon B against typhus” rather than for mass murder. The chatbot later reversed itself and acknowledged that reply was wrong.7NBC News. The Paris Office Raid and Summonses

On February 3, 2026, investigators searched X’s offices in Paris. The Paris prosecutor’s cybercrime division ran the operation with the French national gendarmerie’s cybercrime unit (UNCyber) and Europol, which deployed an analyst from its European Cybercrime Centre to Paris.9Al Jazeera. Prosecutors also issued voluntary interview summonses for Musk and Yaccarino, scheduling their appearances for April 20, 2026. Escalation to a Criminal Investigation

On May 6, 2026, the Paris prosecutor’s office opened a formal criminal investigation and asked investigating judges to charge X Corp., xAI Holdings Corp., xAI, Musk, and Yaccarino.1Le Monde. Musk’s Response and the U.S. Justice Department’s Refusal

Musk has attacked the case publicly. In February 2026 he called it a “political attack,” and after the criminal investigation was announced in May, he referred to the French judges involved as “retards” in a post on X.15CNBC. The U.S. Department of Justice sided with Musk. On April 17, 2026, its Office of International Affairs sent a letter to French law enforcement refusing to assist the probe. The letter argued that the French investigation amounted to an attempt to use criminal law to regulate free speech “in a manner contrary to the First Amendment of the United States Constitution,” and described France’s requests as an “effort to entangle the United States in a politically charged criminal proceeding aimed at wrongfully regulating through prosecution the business activities of a social media platform.”16CNBC. How This Differs From the EU’s DSA Case Against X

The French criminal investigation is separate from the European Union’s enforcement action against X under the Digital Services Act, and the two should not be confused.
