Elon Musk ‘Pedo Guy’ Lawsuit Outcome: The Verdict and Aftermath

A federal jury in Los Angeles decided the Elon Musk “pedo guy” lawsuit in Musk’s favor on December 6, 2019, taking less than an hour to reject British cave explorer Vernon Unsworth’s defamation claim and his request for up to $190 million in damages. The eight jurors concluded that a reasonable person would not have read Musk’s tweet as a literal accusation of pedophilia.¹²

How the Dispute Started

Unsworth was one of the coordinators of the June and July 2018 rescue of a Thai youth football team from the flooded Tham Luang cave system. Musk sent engineers and a small rigid submarine built from Falcon rocket parts to the site. The device was never used; the head of the joint command center, Narongsak Osottanakorn, called it “not practical.”³

On July 13, 2018, Unsworth told CNN the submarine was a “PR stunt” and said Musk could “stick his submarine where it hurts.” Two days later Musk tweeted, “Sorry pedo guy, you really did ask for it,” and when challenged replied, “Bet ya a signed dollar it’s true.” He deleted the tweets the same day.⁴ On July 18 Musk apologized publicly, writing that his words “were spoken in anger” and that “the fault is mine and mine alone.”⁵

The dispute did not stop there. On August 30, 2018, Musk emailed BuzzFeed reporter Ryan Mac an off-the-record message repeating and expanding the accusations, calling Unsworth a “child rapist” and alleging he had moved to Chiang Rai “for a child bride.” BuzzFeed published the email. Musk later told a public relations adviser he was “a f—ing idiot” for sending it.⁶⁷

Around the same time, Musk’s family-office president Jared Birchall paid more than $50,000 to a private investigator, James Howard-Higgins, to look into Unsworth. Howard-Higgins turned out to be a convicted fraudster who had served 18 months for stealing roughly £426,000 from a former business partner. His report produced no substantiated evidence of wrongdoing.⁸⁹

What Unsworth Sued For

Unsworth filed his defamation complaint on September 17, 2018, in the U.S. District Court for the Central District of California, represented by defamation attorney L. Lin Wood. He sought up to $190 million in damages, including $150 million in punitive damages.¹⁰¹¹

Two pretrial rulings by U.S. District Judge Stephen V. Wilson shaped what the jury would consider. First, Judge Wilson denied Musk’s motion to dismiss, holding that “pedo guy” could be construed as a statement of fact rather than a throwaway insult. Second, he classified Unsworth as a private figure, meaning Unsworth had to show only negligence to win compensatory damages, not the tougher “actual malice” standard reserved for public figures. Punitive damages still required actual malice.¹²¹³

The judge also allowed the BuzzFeed emails in as evidence of Musk’s state of mind when he sent the tweets, even after Unsworth’s team dropped them as standalone defamation claims.¹³

What the Jury Heard at Trial

The trial began December 3, 2019 before Judge Wilson. Musk was represented by Alex Spiro and William Price of Quinn Emanuel Urquhart & Sullivan.¹⁴

Musk apologized again from the stand, telling jurors, “I literally didn’t mean he was a pedophile,” and cast the exchange as a mutual insult: “I assume he literally didn’t mean to sodomize me with a submarine.” He conceded the private investigator he had hired was a “professional con man” and described a settlement demand from Unsworth’s attorney as a “shakedown letter.”¹⁴

Unsworth testified that the tweets left him feeling “dirtied” and that he sued to keep the allegation from being treated as true. Lin Wood called Musk a “billionaire bully,” told jurors the accusation hit Unsworth “like a nuclear bomb,” and argued the investigation was an attempt to “finish him off.”¹⁵¹⁶

Spiro’s core message to the jury was that “pedo guy” was an insult swapped in a heated online argument, not a factual assertion. “I did not accuse Mr. Unsworth of being a pedophile,” he told jurors. Price attacked Unsworth’s damages case by showing he had pursued film deals about the rescue and had never sought counseling for the emotional distress he described. The defense also pointed out that Unsworth had continued to receive public honors after the tweets, including being photographed with the British Prime Minister.¹⁷¹⁸

The Verdict and Why It Came So Fast

After a four-day trial the jury deliberated less than an hour before returning a defense verdict on December 6, 2019. The controlling question was whether a reasonable reader of Musk’s tweet would have understood him to be stating, as a matter of fact, that Unsworth was a pedophile. The jury said no.²¹⁹

Because that finding defeated the defamation claim outright, the jury never had to weigh the damages figures Wood had proposed or decide whether Musk acted with actual malice for punitive purposes. The pretrial ruling that Unsworth was a private figure, once seen as a win for the plaintiff, ended up mattering less than the threshold question of what the words meant in context. Spiro’s framing of the tweets as insults exchanged in a public argument, combined with the same-day deletion and Musk’s July 2018 apology, appears to have carried the jury.¹⁸

Unsworth said afterward that he “respected” the jury’s decision, though it was not the outcome he had expected.²⁰

What Happened After the Verdict

Court records show the case terminated on December 6, 2019, with a last known docket entry on July 28, 2021. No appeal to the Ninth Circuit appears in the record.²¹ The BuzzFeed emails, which contained the more explicit “child rapist” language, were not the subject of a separate defamation claim at trial; Unsworth’s team had withdrawn those as standalone claims before trial, and Judge Wilson permitted them only as state-of-mind evidence on the tweets themselves.¹³

For readers looking at the case as a benchmark for online defamation claims, the takeaway is narrow. The jury did not decide that Musk’s accusations were true, and it did not decide that social media insults are categorically protected. It decided, on these facts, that this tweet, read in the context of a public argument and Musk’s same-day retraction, did not communicate a factual charge of pedophilia to a reasonable reader. Wood warned during the case that accepting the defense’s logic would “effectively prevent an individual from seeking redress for any and all false and defamatory attacks on reputation published on the internet.”¹⁸ The verdict rejected his framing on the words at issue here, but did not create a rule reaching further.
