Eloping in Gatlinburg, TN: Marriage License Requirements

To elope in Gatlinburg, Tennessee, you need a marriage license from the Sevier County Clerk, and the requirements are refreshingly light: both of you appear together with photo ID, pay $41 if you live out of state or $101 if you are Tennessee residents, and you can marry the same day. There is no waiting period, no witness requirement, and the license is valid for 30 days anywhere in Tennessee.¹

The catch most couples miss shows up later, at the ceremony itself. Tennessee will not recognize a marriage performed by someone whose ordination came from an online-only source. More on that below.

What to Bring to the Clerk

Tennessee law requires both applicants to appear together and submit a written application with your names, ages, current addresses, and Social Security numbers.² Bring a valid government-issued photo ID such as a driver’s license or passport so the clerk can verify identity and date of birth.

Completing the Sevier County Clerk’s online pre-application before you arrive saves time at the counter; the form forwards your information to the clerk so the visit is mostly verifying ID and signing.³ The online form asks for extra details like parent names and birthplace even for adult applicants, so have those ready.

Age

Both of you must be at least 17. If one applicant is 17, the other cannot be more than four years older, and a parent, guardian, or person with custody must appear at the clerk’s office to give sworn consent. No one under 17 can marry in Tennessee under any circumstance.⁴

If You’ve Been Married Before

The application asks for the date and manner your previous marriage ended. Tennessee does not require you to bring a divorce decree, but bring a copy anyway if you have one — occasional questions do come up, and having documentation on hand prevents a return trip.

If You Don’t Have a Social Security Number

A Tennessee Attorney General opinion concluded that applicants without a Social Security number for a legitimate reason, such as being a foreign national legally in the country, should still be issued a license after stating the reason on the application.⁵ Non-U.S. citizens should bring a valid passport as photo identification.

What the License Costs

Out-of-state couples pay $41 in cash. Tennessee residents pay $101 in cash. The lower out-of-state rate exists because Gatlinburg qualifies as a premier tourist resort under state law. If you pay by card, expect a small processing surcharge.¹

Tennessee residents can reduce the fee by $60 by completing a four-hour premarital preparation course and presenting a notarized certificate at the time of application, which brings the resident cost to $41. The course can be taught by a licensed therapist, clinical social worker, or a representative of a religious institution. The discount does not apply to out-of-state applicants because their fee is already reduced.¹

Where to Pick Up the License

Sevier County runs three clerk offices, and their hours are different enough that picking the wrong one can cost you a day:

Sevierville (Main Courthouse): 125 Court Avenue, Suite 202E. Monday through Friday, 8:00 AM to 4:00 PM.
Gatlinburg: 405 Reagan Drive. Monday, Wednesday, and Friday only, 8:00 AM to 3:45 PM. Closed Tuesday and Thursday.
Pigeon Forge: 186 Old Mill Avenue. Saturday only, 9:00 AM to 1:00 PM.

The Gatlinburg office is closest if you are already in town, but it is closed two weekdays. Arriving on a Tuesday or Thursday means driving to Sevierville. The Pigeon Forge office exists for weekend visitors.¹ Once the clerk verifies your ID and processes the application, you walk out with the physical license in hand. The visit rarely takes more than 20 minutes if you pre-applied online.

How Long the License Is Good For

The license is valid for 30 days from the date the clerk issues it.⁶ If the 30 days pass without a ceremony, the license expires and you have to reapply and pay again.

Tennessee has no mandatory waiting period, so same-day elopements are entirely possible.¹ The license also works statewide. If your plans shift and you end up marrying in another Tennessee county, the license is still valid.

Who Can Legally Marry You

Tennessee authorizes a wide range of people to perform marriages: ordained ministers, priests, rabbis, and other religious leaders over 18 who have care of a congregation, plus judges, chancellors, county mayors, members of county legislative bodies, county clerks, and notaries public, among others.⁷

Here is the part that trips couples up. Tennessee explicitly prohibits anyone with an online-only ordination from officiating a wedding.⁷ If a friend gets ordained through a website and performs your ceremony, the marriage will not be legally valid. The statute requires that ordination happen through “a considered, deliberate, and responsible act” of a religious organization, and Tennessee courts have read that to exclude quick internet credentials. Verify your officiant’s credentials before the ceremony, not after.

Tennessee does not require any witnesses. Only the two of you and the officiant need to be present.

After the Ceremony

Your officiant has a legal duty to note the date and time of the marriage on the license, sign it, and return it to the Sevier County Clerk within three days.⁸ Failing to do so is a misdemeanor, though a late return does not invalidate the marriage. The clerk records the license and forwards the record to the Tennessee Office of Vital Records.⁶ Confirm with your officiant before the ceremony that they know the three-day deadline and where to send the license.

You can request certified copies through the Tennessee Office of Vital Records in person, by mail with a completed application and photo ID, or online through VitalChek, the state’s authorized vendor for card orders.⁹ The Sevier County Clerk can also issue certified copies directly, which is often faster for a recently recorded marriage. Order at least two: one for your records and one for updating identification, bank accounts, or insurance policies.

Marrying Inside the National Park

If you want your ceremony inside Great Smoky Mountains National Park, the marriage license alone is not enough. The National Park Service requires a separate special use permit for all weddings, elopements, vow renewals, and commitment ceremonies within park boundaries.¹⁰

The permit costs a nonrefundable $50, payable through Pay.gov or by check. Apply at least 30 days before your ceremony date using Form 10-930, submitted by email to grsm_special_use_permits@nps.gov. Applications are accepted up to 12 months in advance.¹⁰

Ceremony limits are strict:

Outdoor locations: up to 25 people (including vendors), 6 vehicles, and one hour for setup, ceremony, photos, and cleanup combined.
Historic churches: up to 50 people, 8 vehicles, and one and a half hours total.

Those headcounts include everyone: couple, officiant, photographer, and guests. The permit does not give you exclusive use of the area, and elaborate decorations are not allowed at outdoor sites. Permits are nontransferable and nonrefundable, including for bad weather. Keep a copy of the approved permit with you during the ceremony and place another on the dashboard of any associated vehicle.¹⁰
