An emergency motion in Florida asks a judge to grant relief before the normal hearing schedule because waiting would cause harm no later order could fix. What Counts as an Emergency
The word that decides most of these motions is “irreparable.” If money or a later judgment can fix the problem, the court will treat the matter as ordinary and set it on the regular calendar. If the harm will land before a normal hearing can be held and cannot be undone once it does, the motion has a chance.
Situations that typically meet the threshold include a parent about to remove a child from the state, an imminent threat of violence, property about to be destroyed or hidden, and ongoing fraud that will drain marital or business assets before trial. Situations that generally do not: temporary financial strain, scheduling frustrations, disagreements between co-parents, or the other side ignoring informal requests. Judges see exaggerated emergency motions constantly, and filing one that misses the mark can push your case to the back of the queue.
Domestic Violence Injunctions
Petitions for injunctions against domestic violence are among the most common emergency filings in the state. Under Florida Statute 741.30, a victim of domestic violence, or someone with reasonable cause to believe they are in imminent danger of becoming one, can file a verified petition in circuit court. If the court finds an “immediate and present danger,” it can issue a temporary injunction without the respondent present. Outside the family context, emergency motions arise in disputes over property about to be sold or destroyed, business partners draining company accounts, non-compete violations that compound daily, and any situation where the status quo will shift irreversibly before a regular hearing. These filings run through the Rule 1.610 framework: prove immediate, irreparable harm through sworn facts.
What Goes in the Motion
An emergency motion is short but has to do a lot of work in a small space. The judge needs to see exactly what you want, exactly what facts justify it, and exactly which rule or statute authorizes it. Vague statements about feeling threatened or worried will get the motion denied.
- Put the words “Emergency Hearing Requested” in the title so court staff route it for expedited review.
- State the specific relief you want: a temporary restraining order, an order preventing removal of a child, exclusive possession of a residence, a freeze on identified accounts.
- Describe what happened, when, and why waiting for a regular hearing lets the harm occur. Stick to facts you can swear to.
- Explain why the harm is irreparable, meaning why money or a later order cannot fix it.
- Cite the legal authority that supports the request, such as Rule 1.610 for injunctive relief or Section 741.30 for domestic violence protection.
The Notice Certification
If you are asking the court to act before the opposing party has been notified, the movant’s attorney must certify in writing what efforts were made to give notice and why notice should not be required.1The Florida Bar. The Affidavit Carries the Weight

Under Florida Statute 92.525, a verification must state: “Under penalties of perjury, I declare that I have read the foregoing [document] and that the facts stated in it are true.” That declaration appears at the end of the document, immediately above the signature. Describe events you personally witnessed or experienced. Attach corroborating exhibits where you have them: police reports, medical records, threatening messages, photographs, financial statements showing dissipation. Exhibits strengthen the request, but the sworn narrative is what the judge is reading.
Bond
Under Rule 1.610(b), a temporary injunction does not take effect until the movant posts a bond in an amount the court sets, sufficient to cover costs and damages the other party would suffer if the injunction turns out to have been wrongly issued.1The Florida Bar. One important exception: no bond is required for a temporary injunction issued solely to prevent physical injury or abuse of a person.1The Florida Bar. When the state, a municipality, or a government agency seeks an injunction, the court has discretion to require or waive the bond.
For commercial and property disputes, expect the court to set a bond that reflects the financial exposure to the restrained party. Have the money or a surety arrangement ready before you file; a delay in posting stops the injunction from taking effect.
Filing and Getting the Judge’s Attention

Filing electronically does not by itself put your motion in front of a judge. After you file, call the assigned judge’s judicial assistant to alert them that an emergency motion is pending and needs expedited review. That phone call is where urgency is actually communicated. Without it, the motion sits in the queue with routine filings.
If the court grants ex parte relief, the resulting order has to be personally served on the opposing party. In domestic violence cases and cases involving a child’s safety, law enforcement can assist. Include the opposing party’s current address and phone number in the motion to make service possible.
What Happens After You File
If the sworn facts are strong enough, the judge can issue a temporary ex parte order without a hearing. More often, the court sets an expedited hearing within days. The hearing is narrow. The judge is not resolving the whole case, only deciding whether the emergency is real and whether temporary relief is warranted. Bring every witness and document that supports your affidavit. Subpoena timelines may be too tight for an expedited setting, so you may need witnesses to appear voluntarily.
A temporary injunction granted under Rule 1.610 stays in effect until further order of the court. Filing Without a Lawyer
Self-represented litigants can file emergency motions, and some circuits publish templates for the purpose. - The motion is under oath. Every factual claim must be something you can verify. Guesswork or exaggeration can lead to a perjury charge.

- You are usually responsible for notifying the other side once a hearing is set, in a manner reasonably likely to give actual notice. Failure to give proper notice can cause the hearing to be continued or the motion denied.
- A denied emergency motion may be rerouted to the regular scheduling calendar, meaning you can end up waiting longer than if you had filed a standard motion.
Even if you intend to represent yourself, consider consulting an attorney before filing. Sworn statements become part of the court record, and procedural mistakes carry real cost.
Consequences of a Weak Emergency Motion
Florida Statute 57.105 requires the court to award reasonable attorney’s fees to the opposing party when a claim was not supported by the material facts or existing law and the filer knew or should have known that. The fees are split equally between the losing party and their attorney. The statute also authorizes sanctions when a filing is made primarily to cause unreasonable delay.
A 21-day safe harbor applies to party-initiated sanctions motions: the moving party must serve the motion and give the other side 21 days to withdraw the challenged filing before presenting it to the court.
