Emilie Kiser Lawsuit: The Ruling, Sealed Records, and Fallout

Influencer Emilie Kiser’s lawsuit, filed in Maricopa County Superior Court on May 27, 2025, asked a judge to permanently seal the police reports, body camera footage, security video, and autopsy records tied to the drowning death of her three-year-old son, Trigg. On August 8, 2025, Judge Christopher Whitten allowed the 53-page Chandler police report to be released and ordered two pages of graphic detail redacted.¹

What the Lawsuit Asked For

The case, docketed as CV2025-018383, named the city of Chandler, Maricopa County, the Maricopa County Attorney’s Office, and the Maricopa County Office of the Medical Examiner as defendants.² Kiser was represented by Shannon Clark, Kevin O’Malley, and Flynn Carey of Gallagher & Kennedy in Phoenix.³ The complaint sought a permanent seal on every category of record police and county officials had compiled about Trigg’s death.⁴

Why She Filed

Kiser’s attorneys argued that Arizona law recognizes a family’s compelling privacy interest in death-related records and that releasing graphic material would inflict renewed trauma. In a court declaration, Kiser wrote that “viewing or knowing others could view these images forces me to relive the worst moment of my life.”⁵ Her lawyers also raised the risk that footage or photos could be used to generate AI reenactments of the child’s death.³

The volume of interest was part of the filing’s context. More than 100 public records requests had already been submitted to the city of Chandler and the county medical examiner’s office by the time she sued.²

The Arizona Republic was admitted to the case as a real party in interest and opposed broad redactions. Its attorney, Matthew Kelley, told the court the public deserved to understand why Chandler police recommended a felony charge and why the county attorney then declined to file one, calling that sequence “rare” in drowning cases and arguing the full record could “help save lives” in a state where drowning is the leading cause of death for children ages one to four.⁶

The Ruling

Judge Whitten’s August 8, 2025 order split the two interests. He directed the 53-page Chandler police report to be released and permitted two pages containing graphic descriptions of Trigg’s final moments to be redacted. Those sections, he wrote, were “not necessary for public accountability” and their “disclosure would serve no purpose other than satisfying morbid curiosity.”¹ The remaining pages, the court concluded, gave the public enough to evaluate the police investigation and the prosecutor’s decision.⁷

The Arizona Records Law Behind the Decision

Arizona’s public records statute creates a strong presumption that police reports, 911 recordings, and similar government documents are open. That presumption yields when disclosure would cause “substantial and irreparable private or public harm,” and judges are expected to weigh the public interest against privacy interests case by case.⁸ Arizona courts have separately recognized that autopsy photographs require a court order to release and that families have a recognized interest in preventing graphic death records from circulating publicly.⁹

Kiser’s public profile cut both ways in that balance. State law lets a judge consider whether a subject has a history of sharing personal details publicly when evaluating a privacy claim.⁸ The statute also does not classify news-gathering as a “commercial purpose,” which weakened any argument that outlets seeking the records were doing so for commercial exploitation.⁹

What the Released Report Revealed

The report described what happened on May 12, 2025 at the family’s Chandler home. Trigg fell into the backyard pool while his father, Brady Kiser, was inside caring for the couple’s five-week-old baby and watching an NBA playoff game. Emilie was not home. The pool’s protective net had been removed ahead of a scheduled cleaning and was not replaced.¹⁰ Surveillance footage showed Trigg alone in the backyard for more than nine minutes, and in the water for about seven minutes before Brady found him. Brady told investigators he thought he had lost sight of Trigg for three to five minutes; the video showed a longer gap, and police concluded he “was not aware of what [Trigg] was doing and was not watching him.”¹¹ Brady pulled Trigg from the pool, began CPR, and called 911. Trigg died six days later, on May 18, 2025, at Phoenix Children’s Hospital. The death was ruled an accidental drowning.¹²

Forensic analysis of Brady’s phone showed a $25 DraftKings bet placed at 5:14 p.m. on Jayson Tatum to score more than 40 points in a New York Knicks playoff game, paying out $102.50. The wager went in roughly 75 minutes before cameras captured Trigg entering the pool area. Police found no drug or alcohol use and wrote that “it is clear Brady’s attention was divided.”¹³

In July 2025, Chandler police recommended a Class 4 felony child abuse charge against Brady. On July 25, 2025, Maricopa County Attorney Rachel Mitchell announced her office would not file charges, saying there was “no reasonable likelihood of conviction” and that the case did not meet the legal standard of proving “a gross deviation from the standard of care.”¹⁴¹⁵ Investigators noted Brady acted immediately once he saw Trigg in the pool; the concern was the extended inattention beforehand.

The Online Attention That Shaped the Case

The lawsuit did not name Reddit, but the platform’s role in the surrounding attention shaped why the filing existed. Kiser had a dedicated Reddit snark page, a forum where users critique influencers. After Trigg’s death, the subreddit was shut down or paused as speculation intensified.¹⁶ Some moderators in the broader snark community had already treated the death of an influencer’s family member as content that fell outside what those spaces would host.

When the DraftKings detail surfaced in August, online anger sharpened around the image of a father placing a bet while his toddler drowned, even though prosecutors had already concluded the evidence would not support a criminal charge.¹⁷ The 100-plus records requests filed with Chandler and the medical examiner reflected that appetite for detail, and the redaction fight was, in practical terms, a fight over how much of that detail would ever be public.

Where Kiser Is Now

Kiser broke her silence on August 28, 2025. She wrote that she takes “full accountability as Trigg’s mother” and acknowledged that “a permanent pool fence could have saved his life.”¹⁸ She said she planned to set stricter limits on what she shares, noting that “relationships online lack boundaries, especially in protecting children’s privacy.”¹⁹

She returned to TikTok in September 2025 after a four-month absence.²⁰ In October 2025, she said she would no longer feature her children in her content: “I’m not sharing my kids anymore.”²¹ In a November 2025 Instagram post advocating for pool fences, layered barriers, swim lessons, and constant supervision, she wrote: “Drowning is quick and preventable. I know statistically Trigg’s drowning won’t be the last, and more have happened since.”²²
