The EpiPen settlement refers to a combined $609 million recovery from Mylan and Pfizer for consumers and insurers who overpaid for branded or authorized generic EpiPens between August 24, 2011, and November 1, 2020. Who Qualifies for a Payment
The consumer class covers anyone in the United States who paid for or was reimbursed for branded or authorized generic EpiPens for personal, family, or beneficiary use between August 24, 2011, and November 1, 2020. A narrower “Antitrust States Class” covers purchases of branded EpiPens from January 28, 2013, onward in 17 states: Alabama, California, Florida, Hawaii, Illinois, Kansas, Maine, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Hampshire, New York, North Carolina, Tennessee, and Utah.4EpiPen Class Action. Several groups are excluded from the consumer class: direct purchasers, government entities, fully insured health plans, consumers who purchased only through Medicaid, and pharmacy benefit managers.4EpiPen Class Action. How Much Individual Consumers Are Getting
The money is split unevenly. Of the total consumer funds, 80% goes to third-party payers (insurers, pension funds, and similar entities) and 20% goes to individual consumers. In the Pfizer settlement, that meant roughly $217 million was left after attorneys’ fees and expenses, and consumers’ share of that was about $44 million.5Allergic Living. What that has meant per person varies widely based on how much you actually spent on EpiPens during the class period. Reported payouts from class members have ranged from about $71 to over $3,700.7Top Class Actions. How to Claim or Check on Your Payment
The settlement administrator is A.B. Data, Ltd. It began distributing payments to eligible claimants in May 2023.2U.S. District Court, District of Kansas. If You Bought EpiPens for Resale: The Direct Purchaser Track
A separate class action, KPH Healthcare Services, Inc. v. Mylan N.V., covered wholesalers, pharmacy chains, and other businesses that bought EpiPens or generic EpiPens directly from Mylan or Teva for resale. This is a separate settlement from the consumer one; individuals who bought EpiPens at retail for their own use belong in the consumer class, not this one.
State Attorney General Settlements
Beyond the class actions, individual state attorneys general have reached their own settlements with Viatris (Mylan’s current corporate parent) over the same conduct. These are separate from the consumer class recovery and generally include a mix of money that goes to the state and non-monetary commitments that affect residents directly. - New Mexico: $2.25 million, announced April 15, 2026. Viatris has denied wrongdoing in each of these settlements. Why the Settlements Happened
Mylan acquired U.S. marketing rights to EpiPen in 2007, when a two-pack cost roughly $100. By 2016, the wholesale acquisition cost had climbed to $608 for a two-pack, an increase of more than 500%, and Mylan held about 89% of the epinephrine auto-injector market.19U.S. House of Representatives Committee on Oversight and Government Reform.
