Eric Melvin Lawsuit: Records Demand, Rumor, and Fat Mike

There is no Eric Melvin lawsuit. The NOFX guitarist has publicly denied suing frontman Fat Mike, NOFX, or any bandmate, and the band’s manager has confirmed no civil suit was filed. What Melvin did send, on October 7, 2024, was a private letter requesting access to the band’s financial records and asking that “certain conduct” stop. Drummer Erik “Smelly” Sandin later described that letter in public as legal service accusing Fat Mike of “legal financial malfeasance,” and that characterization is what launched the rumor Melvin then had to knock down.¹²

What Melvin Actually Sent

NOFX played their final show on October 6, 2024, at Berth 46 in San Pedro, California. The next afternoon, Melvin sent Fat Mike a letter. In a March 2026 Instagram statement issued during the SXSW premiere of the band’s documentary, Melvin wrote: “I never sued Fat Mike, NOFX, or served anyone in the band legal papers — not at 8am, not ever.”²

According to Melvin, the letter had two purposes. It requested financial records he said he had been seeking for years without success, and it asked that certain unspecified conduct stop. He said the letter was “not a lawsuit, not a demand Mike pay me millions of dollars,” and that the words “thief” and “illegal” appeared nowhere in it. He described the request for records as his right as a member of the band and its LLC.¹²

How the Lawsuit Rumor Started

On January 16, 2026, NOFX held a roundtable at Fat Mike’s Punk Rock Museum in Las Vegas to celebrate a new exhibition. Melvin did not attend. Fat Mike, Sandin, and Aaron “El Hefe” Abeyta did. Sandin read a prepared statement telling the crowd that Melvin’s lawyers had served Fat Mike with legal papers at 8:00 a.m. the morning after the final show, and that Melvin had cut off direct communication with the band, routing everything through counsel.³

Sandin defended Fat Mike from the underlying implication: “I’ve known Mike for 43 years. Mike is a lot of things. We all know that he’s a complicated person that’s very sweet, but he’s not a thief. I will go on record saying he is not a thief.”³

Coverage of Sandin’s remarks framed the situation as a pending lawsuit. Shortly afterward, NOFX manager Kent Jamieson pushed back on Instagram, writing that reports of a civil suit were “untrue” and that “Mel has grievances, no suit has been filed.”³ Melvin’s own statement two months later said he went public to “shut down the rumor mill.”⁴

A Records Demand Is Not a Lawsuit

The gap between what Melvin sent and how Sandin described it is a real legal distinction. What Melvin’s letter appears to be is a demand for accounting: a process by which an LLC member asks the company to open its financial books for inspection. Formal legal service, by contrast, involves delivering a summons, writ, subpoena, or complaint to start a lawsuit.⁵

Under California law, LLC members have a statutory right to inspect company records, including tax returns, accounting ledgers, and bank statements, regardless of their ownership percentage. If the LLC refuses, the member can go to court to enforce the right, but the initial written demand itself is not litigation.⁶ Melvin has asserted his standing as a member of the NOFX LLC as the basis for his request.²

The Financial Backdrop

Fat Mike, whose legal name is Michael Burkett, has long occupied two roles at once: NOFX’s frontman and the founder of Fat Wreck Chords, the independent label that released seven of the band’s fifteen studio albums. He and his wife, Erin Kelly-Burkett, ran the label for decades before selling its catalog of master recordings to Hopeless Records in a deal announced in 2025. As part of that sale, Fat Wreck forgave roughly $3.5 million in unrecouped balances owed by more than 100 artists.⁷

Asked about financial questions surrounding the label, Fat Mike said in a 2025 interview: “There were a couple of audits, but they didn’t lead to anything. No one can say that s–t.”⁷ Speaking to the Los Angeles Times around the time of the Punk Rock Museum event, he said the band had “never had a f—ing argument, ever,” while acknowledging that things had gotten “sketchy” during the COVID-19 pandemic when NOFX couldn’t perform.⁸

Where Things Stand

As of March 2026, no lawsuit has been filed between Eric Melvin and Fat Mike or NOFX. Both Melvin and the band’s manager have said so on the record. All four core members attended the SXSW premiere of the NOFX documentary 40 Years of Fuckin’ Up, with Melvin telling fans in advance, “We will all be there.” He also noted that the film is “rooted mostly in one person’s perspective.”¹

Whether Melvin’s underlying request for financial records has been resolved is a separate question, and neither side has publicly answered it.⁹
