Expired Driver’s License in CA: Penalties, Renewal, and Fees

An expired driver’s license in California is not a valid license, so driving on one is a citable offense that can cost well over $1,000 once court assessments are added, and the vehicle can be impounded on the spot. Renewing, on the other hand, is comparatively painless: the DMV charges no late fee, and most drivers can renew online if they act within 12 months of the expiration date on the card.

Penalties for Driving on an Expired License

Because an expired license is not valid, driving with one falls under Vehicle Code 12500, which prohibits operating a vehicle on any highway without a valid license.¹ For a first-time offender with an otherwise clean record, officers usually write it up as an infraction with a base fine of up to $250. That figure is misleading. California adds state and county penalty assessments to every traffic fine, and the real out-of-pocket cost of a $250 base fine can exceed $1,000.

The charge can escalate to a misdemeanor for repeat offenders or in more serious circumstances, carrying up to six months in county jail and fines up to $1,000 before assessments. On top of that, Vehicle Code 22651 authorizes law enforcement to remove and impound the vehicle whenever an officer issues a citation under CVC 12500.² Getting the car back means paying towing and storage fees on top of whatever the court orders.

This is a separate and less severe situation than driving on a suspended or revoked license, which is prosecuted under Vehicle Code 14601 and carries mandatory minimum jail time.³ Still, a CVC 12500 misdemeanor creates a criminal record, and the financial hit is real either way.

Your Insurance May Not Cover You

Even if your policy is paid up, driving with an expired license can put your coverage at risk. Many auto policies exclude losses that occur during illegal activity, and driving without a valid license qualifies. An insurer may deny a claim outright, argue for a reduced payout, or delay settlement while it investigates. Some policies explicitly exclude unlicensed drivers from liability coverage. Read the exclusions section of your policy before assuming a crash while your license is expired would be covered.

How to Renew an Expired California License

California charges no late fee for renewing after your expiration date, so the price is the same whether you’re early or late.⁴ Which method is available to you depends on how long the license has been expired and what else is going on with your record.

Online

You can renew online if you are within 90 days before or 12 months after your expiration date. You also cannot have a change of address pending, cannot be applying for a REAL ID for the first time, and cannot hold a commercial license.⁴ The online process uses the DMV’s electronic DL/ID application.⁵

By Mail

If the DMV sent you a renewal notice saying you’re eligible to renew by mail, follow those instructions. Eligibility generally requires no driving probation or suspension and no violation of a written promise to appear in court within the last two years.⁴ Send the completed packet to the DMV Renewal By Mail Unit at PO Box 942890, Sacramento, CA 94290-0001.

In Person

You’ll need to visit a DMV field office if your license has been expired for more than 12 months, if you’re upgrading to a REAL ID, if you need to change your address on the record, or if you otherwise don’t meet the eligibility criteria for online or mail renewal. Drivers 70 and older also have an in-person requirement, covered below.

After a successful renewal through any method, the DMV issues a temporary paper license valid for 60 days while the permanent card is manufactured and mailed. The plastic card typically arrives within three to four weeks.⁴

Fees and What to Bring

For a standard renewal, you’ll need your Social Security number and basic personal information: name, date of birth, and current address.⁵ The renewal fee for a Class C license is $46.⁶ Pay online by credit card, or by check or money order for a mail renewal.

If you’re also upgrading to a REAL ID, bring one identity document (a valid U.S. passport or an original or certified birth certificate are the most common) plus two different proofs of California residency, such as a utility bill and a bank statement.⁷ Both residency documents must show your name and the same mailing address on the application.

When You’ll Have to Take a Test

Testing depends on how you renew.

Vision screening is required at every in-person renewal. The DMV checks that you can see 20/40 with both eyes together. Fail, and you’re referred to an eye specialist to complete a Report of Vision Examination.⁸
A written knowledge test may be required as part of an in-person renewal. The renewal knowledge test has 25 questions. Online and mail renewals skip it.⁹
A behind-the-wheel driving test can be required in some cases, such as a long lapse or certain medical conditions.

If you qualify to renew online or by mail within the 12-month post-expiration window, you skip testing entirely. That alone is a strong reason not to let the license sit expired.

Drivers 70 and Older

California has specific requirements for drivers 70 and older, though the process is more flexible than it used to be. Most seniors can begin the renewal online, including taking an open-book eLearning course from home when the DMV requires a knowledge assessment.⁹ Every driver over 70 must still visit a DMV office for a vision screening, though. That step cannot be skipped.

After paying the application fee online, allow one business day for payment to appear in the DMV’s system before you schedule the office visit. The in-person appointment is limited to the vision test and final verification.

If You’re Out of State or on Active Duty

Active-duty members of the U.S. Armed Forces or Foreign Service stationed outside California, along with their spouses, can extend their licenses under Vehicle Code 12817 for the duration of their service. The extension remains valid for 30 days after returning to California; if honorably discharged, carry both the license and the discharge papers during that 30-day window.¹⁰ To request the extension or renew from abroad, call the DMV at (916) 657-7790 or write to PO Box 942890, Sacramento, CA 94290-0001 with your full name, license number, date of birth, and address.

If you’re a non-military resident temporarily out of California and unable to renew before your license expires, you can request a one-year extension by emailing dl-extensions@dmv.ca.gov before the expiration date. Include your name, license number, date of birth, California home address, and out-of-state address. Limited-term licenses are not eligible.¹¹

Should You Upgrade to a REAL ID at the Same Time?

Federal REAL ID enforcement began on May 7, 2025. Since that date, TSA requires a REAL ID-compliant license, a valid U.S. passport, or another federally accepted ID to pass through security for domestic flights.¹² A standard, non-REAL ID California license still works for driving, but it won’t get you through airport security or into federal buildings that require REAL ID.

If your license is up for renewal and you haven’t upgraded, handling both at once saves a separate trip. Either way, the REAL ID portion requires an in-person visit with the identity and residency documents listed above.⁷
