In Iowa, if you’re pulled over and can’t show proof of insurance, the officer chooses one of four responses: a written warning, a citation, a citation plus removal of your license plates, or a citation with plate removal and immediate impoundment of your vehicle. There is no required starting point at the lowest level, so a first offense can end with your car on a tow truck. What the Officer Can Do at the Stop

- Issue a written warning memorandum with no fine.
- Issue a citation for violating section 321.20B.
- Issue a citation, remove your license plates and registration receipt, and send the plates to be destroyed. The registration receipt and evidence of the violation go to your county treasurer.
- Do all of the above and impound the vehicle on the spot.
Which action you get is the officer’s call. The statute also reaches beyond roads and highways: a vehicle in a public parking lot is conclusively presumed to have been driven on a highway to get there, so you can be cited in a lot as well.1Justia Law. Fines and Getting the Citation Dismissed
If you’re cited, you have two paths. You can sign an admission of the violation and pay the scheduled fine set by Iowa Code 805.8A, or you can request a court appearance where a judge can impose the same scheduled fine or order unpaid community service in its place.2Iowa Legislature. There is a route out that many drivers miss. If you actually had valid coverage at the time of the stop and simply couldn’t show it, bring proof to the clerk of court before your scheduled court date. The court must dismiss the citation.2Iowa Legislature. Iowa Code 321.20B – Financial Liability Coverage Proof Required Violations Penalties Exceptions You will still owe court costs on the dismissed citation, so being insured but forgetting your card still costs you something.
If the officer also took your plates, the receipt from the clerk of court is what you take to your county treasurer, along with a $15 administrative fee, to have new plates and registration issued.
Getting Your Car and Plates Back After Impoundment
Impoundment is where the numbers get uncomfortable. To recover the vehicle you must show proof of financial liability coverage, pay any fine, and cover all towing and storage charges. Time matters. If nobody claims the vehicle within 30 days, Iowa treats it as abandoned and the state can dispose of it. When a lienholder has a security interest in the vehicle, the impounding agency must notify the lienholder within 72 hours. The lienholder can then claim the vehicle by paying all fees. If the vehicle is worth less than the outstanding lien, those fees are split evenly between the lienholder and the local government that impounded it.3Iowa Legislature. License Suspension and the SR-22 Requirement
The traffic stop is not the end of the story. The Iowa Department of Transportation can suspend your license for failing to maintain financial liability coverage, and the suspension stays in place until you file proof of financial responsibility with the DOT and pay a reinstatement fee.4Iowa Department of Transportation. Filing proof of financial responsibility normally means your insurer submits an SR-22 form to the state. An SR-22 is not a separate policy. It is a certificate the insurer files to confirm you are carrying the required coverage. Iowa’s administrative rules require the SR-22 to stay on file for two years from the effective date of your last suspension.5Legal Information Institute. If you drive but don’t own a vehicle, a non-owner liability policy can carry the SR-22 filing. The policy must still meet Iowa’s minimum liability limits to count as financial liability coverage.
The Coverage You Were Supposed to Have
The requirement itself is written in shorthand as 20/40/15:
- $20,000 for bodily injury or death of one person in a single accident
- $40,000 for bodily injury or death of two or more people in a single accident
- $15,000 for damage to another person’s property in a single accident
These limits apply to standard liability policies from an insurer authorized to do business in Iowa.6Iowa Insurance Division. What Counts as Proof
Iowa accepts two formats for the proof card: a paper card or an electronic image on a cell phone or other portable device with a screen.1Justia Law. Iowa Code Section 321.20B – Financial Liability Coverage Proof Required Violations Penalties Exceptions Your insurer must issue a card for each insured vehicle showing the vehicle’s registration or VIN, the insurer’s name, the insured’s name, the policy expiration date, and an emergency phone number. Approved self-insurers under Iowa Code 321A.34 carry a self-insurance card that serves the same purpose at a traffic stop.
Who Is Exempt
The financial liability coverage requirement carves out a narrow list of categories, including vehicles owned by or leased to the federal government, the state of Iowa, other states, or political subdivisions; vehicles subject to Iowa Code 325A.6 covering certain regulated carriers; registration-exempt vehicles under Iowa Code 321.18 subsections 1 through 6 and 8; vehicles owned by licensed dealers or wholesalers under Chapter 322; and lienholders who carry their own coverage on vehicles they drive or move.1Justia Law.
