Running a stop sign in Florida is a noncriminal moving violation that carries a $60 base fine, three points on your driving record, and, in practice, a total out-of-pocket cost of roughly $150 to $275 once county court costs and state surcharges are added. You have 30 days from the date on the citation to pay it, elect traffic school, or ask for a hearing to contest it. Each choice sends your record and your insurance premium in a different direction.
What the Ticket Actually Costs
The $60 figure printed against this violation is the statutory base penalty for moving violations that don’t require a mandatory court appearance.1Florida Legislature. Florida Code 318.18 – Amount of Penalties It is not what you pay. Every county tacks on mandatory court costs, state surcharges, and administrative fees, and the total typically lands between $150 and $275 depending on where you were cited.
Whatever the final number, it has to be paid within 30 days of the citation unless you choose traffic school or ask for a hearing. Miss that window and a separate, more expensive set of problems starts.
Three Points, and Why That Number Matters
A stop sign violation falls into the “all other moving violations” category under Florida’s point system, which means three points on your record. If the violation caused a crash, the assessment is four points.2Florida Senate. Florida Code 322.27 – Authority of Department to Suspend or Revoke License
Points accumulate on a rolling basis. Hit a threshold and the state suspends your license:
- 12 points in 12 months: suspension of up to 30 days
- 18 points in 18 months: suspension of up to 3 months
- 24 points in 36 months: suspension of up to 1 year
Points from an earlier suspension still count toward the next tier.3Justia Law. Florida Code 322.27 – Authority of Department to Suspend or Revoke License Three points on their own won’t suspend anyone, but paired with a speeding ticket earlier in the year they can put you closer to the 12-point line than you expect.
Insurance
Points signal risk to insurers, who pull your motor vehicle record at renewal. A three-point moving violation typically produces a noticeable premium increase, and the effect often persists for three to five years. Drivers with previously clean records tend to feel it most.
Your Three Options Within 30 Days
Pay the Fine
Paying is the simplest route and counts as an admission of guilt. The three points go on your record, the conviction is visible to insurers, and you’re done. For a driver who already knows the ticket is deserved and is not eligible for traffic school, this ends it fastest.
Elect Traffic School
For most drivers this is the better choice. Electing a Basic Driver Improvement course means adjudication is withheld, no points are assessed, and the base fine is reduced by 18 percent.4Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures
The limits: you can elect traffic school only once in any 12-month period and no more than eight times in your lifetime, and you cannot use this option if you hold a commercial driver license or commercial learner’s permit.4Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures Enroll and then fail to finish by the court’s deadline, and you are deemed to have admitted the infraction. You get adjudicated guilty and the points go on as if you had simply paid the ticket.5Justia Law. Florida Code 318.15 – Failure to Comply With Civil Penalty or to Appear
Contest the Citation
You can also notify the clerk of court that you want a hearing. Win, and the citation is dismissed with no fine and no points. Lose, and you owe the full fine plus court costs and the points are assessed. Because traffic infractions are civil rather than criminal, the state only has to prove the violation by a preponderance of the evidence.
Defenses that tend to gain traction target the elements the officer had to observe: that the stop sign was obscured or turned so it wasn’t reasonably visible, that a full stop actually occurred and the officer’s angle or distance made it look otherwise, or that the wrong vehicle was identified. Photographs of the intersection taken soon after the ticket help if visibility is the issue.
What Florida Law Requires at a Stop Sign
Knowing what the officer had to see makes the contest decision easier. Under Florida Statute 316.123, you must bring the vehicle to a complete stop before proceeding. The stopping point is the painted stop line if one exists, the crosswalk if there is no line, or the point nearest the intersecting road where you can see oncoming traffic if there is neither.6Florida Senate. Florida Code 316.123 – Vehicle Entering Stop or Yield Intersection A rolling stop does not satisfy the statute. After stopping, you must yield to any vehicle already in the intersection or close enough to be an immediate hazard.
What Happens If You Ignore It
Doing nothing is the most expensive option. If you don’t pay, complete traffic school, or appear for a hearing within the required timeframe, the clerk of court notifies the Department of Highway Safety and Motor Vehicles, and the department suspends your license 20 days after mailing the suspension order.5Justia Law. Florida Code 318.15 – Failure to Comply With Civil Penalty or to Appear
That suspension stays on your record for seven years, even after you clear it up. Reinstatement means going back to court, paying the original fine, and paying a separate reinstatement fee. You can still request a hearing within 180 days of the violation date after suspension, but the process becomes far more burdensome than handling the ticket on time.5Justia Law. Out-of-State Drivers
A Florida citation follows you home. Florida participates in the Driver License Compact, which requires member states to report traffic convictions to the driver’s home state. For a stop sign violation, your home state decides how to handle the report under its own rules, so points may or may not attach there.7Florida Senate. Florida Code 322.44 – Compact Enacted Into Law
If you ignore the ticket, Florida will suspend your driving privilege within the state and report the noncompliance. Many home states then suspend the license itself until the Florida citation is resolved. Handling it promptly from out of state is much less disruptive than dealing with a suspension in two jurisdictions.
Commercial Drivers
CDL holders cannot elect traffic school, so a stop sign violation goes on the record directly with the three points.4Justia Law. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures Federal regulations require motor carriers to check a prospective driver’s motor vehicle record in every state where the driver held a license during the preceding three years.8eCFR. 49 CFR 391.23 – Investigation and Inquiries One stop sign ticket won’t disqualify anyone by itself, but it stays visible to hiring managers for that window and adds to any pattern already on the record.
