Family Dollar MDL Settlement: Class, Payments, and Approval

The Family Dollar MDL settlement gave shoppers who bought products at 404 rodent-affected stores in six southern states between January 1, 2020 and February 18, 2022 the right to claim a $25 non-expiring Family Dollar gift card, one per household, with no proof of purchase required. A federal judge in the Western District of Tennessee granted final approval on May 6, 2024, and gift cards began reaching claimants by mid-June 2024.¹ The claim window has closed; the deadline to file, opt out, or object was January 9, 2024.²

What the Lawsuit Was About

An FDA inspection of Family Dollar Distribution Center 202 in West Memphis, Arkansas, conducted between January 11 and February 11, 2022, documented live and dead rodents, droppings “too numerous to count” near stored food products, gnaw marks, nesting material, and rodent odors throughout the warehouse.³ Internal records showed employees had collected more than 2,300 rodents between March and September 2021, and a January 2022 fumigation turned up more than 1,100 additional dead rodents. Family Dollar later acknowledged employees had been aware of insanitary conditions as early as January 2021, yet the warehouse kept shipping products until January 2022.⁴

On February 18, 2022, Family Dollar announced a voluntary recall covering FDA-regulated products shipped from the warehouse to 404 stores across Alabama, Arkansas, Louisiana, Mississippi, Missouri, and Tennessee. Recalled categories included drugs, medical devices, cosmetics, dietary supplements, and both human and pet food. All 404 stores were temporarily closed.⁵

At least 14 putative class actions followed. On June 2, 2022, the U.S. Judicial Panel on Multidistrict Litigation consolidated them in the Western District of Tennessee as In re Family Dollar Stores, Inc., Pest Infestation Litigation, MDL No. 3032, before Judge Sheryl H. Lipman.⁶

Who Qualified for a Payment

To qualify, a person had to live in Alabama, Arkansas, Louisiana, Mississippi, Missouri, or Tennessee and to have purchased any product from a Family Dollar store served by the West Memphis distribution center between January 1, 2020, and February 18, 2022. Receipts were not required. Claimants attested under penalty of perjury that they had shopped at an affected store during the class period.⁷

The class excluded the defendants and their corporate affiliates, class counsel and their employees, judicial officers assigned to the case and their immediate families, and anyone who opted out.⁸

What Class Members Received

Each approved household received a single $25 Family Dollar gift card. The deal was structured as an uncapped, claims-made agreement rather than a fixed common fund, meaning Family Dollar committed to issue a card to every valid claimant with no limit on the total number issued. Only one card was allowed per household.²

The cards do not expire, are fully transferable, and can be used at any Family Dollar store in the United States. Alcohol, tobacco, and items prohibited by law are excluded. Because the cards carry no expiration date, the court found there was no reversion of unclaimed money to the defendants.⁹

Family Dollar denied any liability or wrongdoing and said it agreed to settle to avoid the costs and risks of continued litigation.²

How Claims Were Filed and When They Were Paid

Angeion Group LLC administered the settlement.⁹ Claimants filed online at FDWarehouseSettlement.com or mailed a claim form to the administrator in Philadelphia, providing name, mailing address, and email. Where more than one person in a household filed, only the first valid claim was honored. The deadline for claims, opt-outs, and objections was January 9, 2024.²

After the final approval hearing on April 5, 2024, and the court’s May 6, 2024 approval order, gift cards began arriving in class members’ mailboxes by mid-June 2024.¹ If you filed a valid claim and never received a card, contact the administrator through the settlement website.

Objections, Approval, and Attorneys’ Fees

The State of Arkansas intervened in July 2023 and objected to several parts of the deal. Arkansas argued that the state’s Deceptive Trade Practices Act bars private class actions, that the one-card-per-household limit was too restrictive, that the claims process was burdensome, that unused gift card value would effectively revert to the defendants, and that the requested $10.5 million in fees and costs was unreasonable. The court overruled each objection, noting the settlement resolved existing claims rather than launching a new class action, and that non-expiring, transferable gift cards did not produce a true reversion.⁸

In October 2023, nine other state attorneys general filed an amicus brief supporting Arkansas, arguing private parties cannot release a state’s quasi-sovereign claims. The court noted the settlement expressly carved out the Arkansas Attorney General’s own case, so state enforcement was unaffected.¹⁰ Preliminary approval followed on October 27, 2023.¹¹

At final approval, the court awarded class counsel $10 million in fees.¹² Because the settlement was claims-made, the fee award was paid separately and did not reduce the value of gift cards available to class members.² Sarah Sterling Aldridge of Barrett Law Group and J. Gerard Stranch IV of Branstetter, Stranch & Jennings served as co-lead counsel for the plaintiffs, with Charles Barrett of Neal & Harwell as liaison counsel; Gibson, Dunn & Crutcher represented the defendants.¹³

What the Class Settlement Did Not Cover

Separate legal actions arose out of the same warehouse conditions, and none of them affected consumer payments under the MDL. On February 26, 2024, Family Dollar Stores LLC pleaded guilty in the Eastern District of Arkansas to a misdemeanor count of causing FDA-regulated products to become adulterated while held under insanitary conditions, agreeing to forfeit $41.475 million and pay a $200,000 fine, for a combined $41.675 million penalty. The Justice Department called it the largest criminal monetary penalty ever imposed in a food safety case.⁴ That money went to the government, not to shoppers.

The Arkansas Attorney General’s separate state-court lawsuit, filed in April 2022, was carved out of the MDL and resolved later through a $5.5 million consent judgment; $3.9 million was payable to the Arkansas Attorney General’s office and $1.6 million was suspended based on compliance with the federal plea agreement. Family Dollar denied wrongdoing in that action as well.¹⁴ Consumers were not paid through the state case.
