What the Lawsuits Alleged

Both cases centered on the same practice: showing a ticket price up front, then adding a mandatory convenience fee later in the checkout flow. Plaintiffs called this “drip pricing” and argued it made tickets look cheaper than they were.8Top Class Actions. Fandango Hit With Class Action Over Hidden Convenience Fees on Movie Tickets

The California case added a second theory tied to FanClub, the $9.99 monthly subscription Fandango launched in October 2024. FanClub advertised a $10 monthly ticket credit, waived convenience fees, and early access to bundles. Plaintiffs alleged the monthly credits and promo codes expired after 30 days without adequate disclosure, in violation of California’s gift card law, False Advertising Law, Consumers Legal Remedies Act, Unfair Competition Law, and the federal CARD Act.9Top Class Actions.
