The alienation of affection lawsuit against Fantasia Barrino was brought by Paula Cook in North Carolina in August 2010 after Cook’s husband, Antwaun, was found to have had an affair with the singer. It never produced a judgment against Barrino. Settlement talks broke down that November, and in December 2010 a North Carolina judge ruled that the Cooks had been legally separated since September 14, 2009 — a finding that placed most of the affair after the marriage had already ended and effectively pulled the factual floor out from under the claim. No public reporting shows the case ever went to trial.1Essence. Judge Rules Fantasia Did Not Break Up Antwaun Cook Marriage2Billboard. Legal Updates: Fantasia Didn’t Break Up Marriage
What Alienation of Affection Requires in North Carolina
North Carolina is one of the few states that still recognizes alienation of affection as a civil claim. A spouse can sue a third party who allegedly destroyed the love and affection in a marriage. Proof of sex is not required for this tort — that is the separate claim of criminal conversation — but the plaintiff must show that a genuine marital relationship existed and that the defendant’s conduct helped destroy it. Not knowing the other person was married can serve as a defense.3FindLaw. Alienation of Affection
Those elements explain why the separation date mattered so much in Barrino’s case. If the marriage had already lost its love and affection before the affair, the plaintiff’s core factual claim gets much harder to prove.
How the Claim Against Barrino Arose
Paula Cook filed for divorce in Charlotte in early August 2010 and named Barrino in the accompanying custody complaint. The filing alleged a “covert adulterous affair,” said Barrino and Antwaun Cook had traveled together to Miami, New York, Los Angeles, and Barbados, and claimed the two “have at times recorded their illicit sexual activity.”4CBS News. Paula Cook’s attorney, Tamela Wallace, said her client was “weighing her options” on an alienation of affection suit and described her as “embarrassed, and humiliated and distressed by the lack of respect that was shown for her marriage by Ms. Barrino.”6People. Barrino’s attorney, Gena Morris, called the potential use of North Carolina’s “home wrecker” laws “a comical irony” and accused Paula Cook of “intentionally” turning a private matter into “a public spectacle.” Morris said she would “vigorously defend” Barrino if the suit moved forward.6People. Mediation Collapses Over an Admission, Not Money
On November 1, 2010, Barrino and Paula Cook spent nearly twelve hours in mediation. Barrino offered as much as $100,000 to end the dispute. Cook refused. The block was not the dollar figure but a demand for an admission: Cook wanted Barrino to acknowledge she had known Antwaun was married when the affair began, and Barrino would not concede that. Reports at the time said the civil lawsuit would proceed.10The Light NC. Unable to Reach Settlement, Lawsuit Moves Forward for Fantasia
Later that month, Barrino testified in Antwaun Cook’s divorce proceedings and admitted she had known from the start that he was married and living with his wife, contradicting earlier public statements that she believed he was separated.11Los Angeles Times. Report: Fantasia Testifies She Knew Antwaun Cook Was Married That admission would ordinarily have helped the plaintiff, since knowledge of the marriage removes one of the standard defenses. What came next made the point largely academic.
The Ruling That Gutted the Claim
The fight over when the Cooks’ marriage effectively ended was the case’s center of gravity. Paula Cook said the couple lived together as husband and wife until June 2010, which would have put the whole eleven-month affair inside an intact marriage. Antwaun Cook’s side argued they had separated in the late summer of 2009.9NBC Connecticut. Fantasia’s Married Beau Says Blame Me Not Her

The finding hit both possible torts. For alienation of affection, it undercut the claim that a loving marriage existed for Barrino to destroy. For criminal conversation, a couple’s separation with intent to remain apart is a recognized defense. Coverage at the time noted that the impact on Paula Cook’s planned lawsuit was uncertain.12Los Angeles Times. Fantasia’s Boyfriend Antwaun Cook Was Legally Separated Earlier Than Wife Claimed
What the Public Record Shows About the Outcome
There is no publicly available reporting that the alienation of affection claim against Barrino went to trial or resulted in a judgment against her. After the December 2010 separation-date ruling, the case fell out of the news, and later coverage of Barrino treated the matter as behind her. The claim was raised, filed, negotiated, and then quietly overtaken by a factual finding that made it very hard to prove — which is how many of these cases end, without a verdict and without a formal dismissal on the public docket.
