Chip and Joanna Gaines, the couple behind HGTV’s Fixer Upper and the Magnolia brand, have been named in a handful of lawsuits and regulatory actions over the years, but none of the Fixer Upper lawsuits has produced a trial finding of wrongdoing against them. The disputes include a fraud claim by former business partners, an EPA lead-paint settlement, a neighbor’s property fight near Magnolia Market, a back-taxes suit over Cottonland Castle, a furniture-quality case tied to the Magnolia Home line, and a literary agent’s breach-of-contract claim. Most ended in settlements with confidential terms; the two that reached a judge on the merits were dismissed.
Former Business Partners’ Fraud Suit
The longest-running matter began in April 2017, when John L. Lewis and Richard L. Clark sued Chip Gaines in state district court in Waco. The two had co-founded the Magnolia Real Estate Company with Gaines in 2007 and alleged he pressured them into selling their ownership stakes for $2,500 each without disclosing that HGTV had picked up Fixer Upper, a show they said would send the company’s value soaring.1KBTX. Gaines’s attorney called the allegations “meritless.”1KBTX. That countersuit was headed to a jury trial in July 2023 when the parties reached a confidential settlement on July 13, 2023, dismissing every remaining claim and appeal in the case.3KWTX. EPA Lead-Paint Settlement
The Gaineses’ company had its most concrete regulatory hit in 2017 and 2018. On November 29, 2017, the U.S. Environmental Protection Agency filed an administrative complaint alleging that Magnolia Waco Properties, LLC (doing business as Magnolia Homes) failed to follow federal lead-safe work practices during renovations at 33 Waco properties depicted on Fixer Upper.4U.S. EPA. Magnolia settled on June 5, 2018. The company paid a $40,000 civil penalty and committed to spending $160,000 on lead-paint abatement in high-risk Waco homes, and it also agreed to run an internal compliance-monitoring program and produce an educational video featuring Chip Gaines about lead-paint dangers.4U.S. EPA. Neighbor’s Suit Over the Magnolia Market Alleyway
In October 2016, Daron Farmer, managing member of Head Properties, sued Magnolia Market and Chip Gaines in Waco’s 414th State District Court. Farmer owned a 1.4-acre parcel next to the Magnolia Silos. After a one-year parking-lot lease expired on September 30, 2016, Farmer planned to charge visitors a $10 parking fee. He alleged the Gaineses installed a metal gate across a Seventh Street alleyway that blocked access to his land and sought between $200,000 and $1 million in damages plus removal of the gate.6Baylor Lariat. The Gaineses’ attorney said the gate was put up so Magnolia Market customers would not mistakenly think Farmer’s operation was charging a parking fee.7KCRA. Reporting put the price at just under $1 million, though the parties did not confirm the figure. Farmer said the case was resolved “peacefully.”8KWTX. Cottonland Castle Back-Taxes Suit
In 2024, the city of Waco and the Waco Independent School District sued D&E Castle Holdings, LLC, a Gaines-owned entity, seeking about $43,372 in unpaid 2023 property taxes on Cottonland Castle, a historic Waco property.9KWTX. Magnolia Home Furniture Suit
In November 2016, Standard Furniture Manufacturing Co. and its affiliate International Furniture Marketing Inc. sued LF Products PTE LTD, a subsidiary of Li & Fung, and related companies in U.S. District Court in Santa Ana, California. The case centered on the Magnolia Home furniture line created in partnership with Chip and Joanna Gaines. Standard alleged the defendants pulled a “bait-and-switch,” substituting cheaper water buffalo hide for the top-grain cowhide specified in the contract in more than 90% of shipments, and claimed the resulting product was “substandard and unsaleable.”11Furniture Today. Standard sought $650,000 for the defective product plus freight and customs charges, along with more than $2 million in punitive damages.11Furniture Today. Literary Agent’s Breach-of-Contract Suit
In December 2022, literary agency Vigliano Associates sued Chip and Joanna Gaines, their company C&J Gaines Limited Co., Magnolia Brands, and United Talent Agency in New York State Supreme Court. The dispute arose from a five-book publishing deal that David Vigliano’s agency had brokered with HarperCollins in September 2017, reportedly worth a $12.5 million advance. The Gaineses shifted their management to UTA in 2018. In July 2020, the publishing agreement was amended to reduce the deal from five books to four and to substitute Chip Gaines as the author of the fourth book. Vigliano Associates alleged the changes were engineered to strip the agency of commissions, and it added a tortious-interference claim against UTA.14Justia. Vigliano Assoc Ltd v Gaines
On June 12, 2024, Judge Nancy M. Bannon dismissed the complaint. The court held that Vigliano Associates was merely an “incidental beneficiary” of the publishing agreement and lacked standing to enforce it, that the contract clearly permitted amendments, and that the tortious-interference claim against UTA amounted to “mere conjecture and self-serving speculation.”14Justia. Property Tax Appraisal Challenge
In 2019, six Magnolia-owned properties sued the McLennan County Appraisal District, arguing that the 2019 tax valuations were “excessive and unlawful” and exceeded fair market value. The properties included Magnolia Market at the Silos, the Magnolia Table restaurant and its parking lot, the coffee shop, and the company’s headquarters and warehouse in Woodway. What About the Home Work Complaints
One controversy often lumped in with Fixer Upper lawsuits is not a suit against the Gaineses. In January 2022, homeowners publicly accused Candis and Andy Meredith, hosts of the Magnolia Network show Home Work, of shoddy work and broken promises; one family said it wired $50,000 for a cottage expansion that never started and hired a collections attorney after receiving only about $14,000 back.18Today.
