The Florida Building Code, Mechanical governs nearly every HVAC installation, replacement, and alteration in the state, and almost all of that work requires a permit and inspection before the system can legally operate. The current version is the 8th Edition (2023), adopted under Chapter 553 of the Florida Statutes and enforced by local building departments.1The Florida Senate. What the Code Covers and When It Applies
The mechanical volume applies to any system that moves air, gas, or liquid through a building: central air conditioning, furnaces, exhaust fans, refrigeration lines, ductwork, and condensate drains. A permit is required whenever you install a new system, alter an existing one, or replace a component. Swapping a condenser, adding ductwork to a room, replacing an air handler, or converting from one fuel type to another all trigger the requirement. Routine maintenance does not. Changing filters, cleaning coils, and recharging refrigerant are service tasks, not modifications, so they fall outside the permitting rules.
Emergency Replacements
When a system fails in a Florida summer, the code lets the work start before the paperwork. Emergency equipment replacements and repairs can proceed without a permit, but you must submit the permit application on the next working business day.4North Bay Village. Emergency Repairs Section 105.2.1 FBC The exception covers timing only. The installation still has to meet every code requirement and pass inspection like any other job.
Who Can Legally Do the Work
Licensed Contractors
Florida issues two classes of air-conditioning contractor license. A Class A contractor can work on systems of any size, including commercial boilers, pressure vessels, refrigeration piping, and pneumatic controls. A Class B contractor is limited to systems producing no more than 25 tons of cooling or 500,000 BTU of heating.5The Florida Legislature. Florida Code 489.105 – Definitions Both classes can install ductwork as part of a complete system, reconnect certain electrical wiring at the unit, and run condensate drains to an approved disposal point. Class B covers most residential replacements. Larger commercial jobs need Class A.
Homeowner Exemption
If you own and live in a one-family or two-family home, Florida law lets you pull the permit yourself and either do the work or supervise workers onsite.6The Florida Legislature. Florida Code 489.103 – Exemptions You cannot sell or lease the property within one year of finishing the work; if you do, the law presumes you were acting as an unlicensed contractor. You will also sign an Owner Builder Disclosure Statement accepting responsibility for code compliance and worker safety.
The exemption does not lower the technical bar. Load calculations, duct sealing, and every inspection still apply, and homeowners who pull their own permits sometimes underestimate how much a failed inspection costs to fix.
Core Installation Requirements
Ducts
Chapter 6 of the mechanical code requires every joint and seam in a duct system to be sealed with mastic or tape meeting UL 181 standards.3Florida Building Commission. Ducts running through unconditioned spaces need insulation to prevent condensation on the cool surface. The Florida Energy Conservation Code typically requires R-6 for supply ducts in these spaces, with R-8 in some configurations. Duct insulation must carry manufacturer, R-value, and fire-performance labeling at intervals no greater than 36 inches.7ICC. Chapter 16 Duct Systems – 2023 Florida Building Code Residential Flexible ducts must be supported at intervals no greater than four feet so they do not sag and choke airflow.
Condensate
Florida air conditioners can pull gallons of moisture from the air on a summer day. The code requires a primary drain plus either a secondary drain line or an overflow shutoff switch that kills the system before water damages the building. A clogged primary line will otherwise dump water into ceilings and walls before anyone notices.
Condensate drains must terminate at an approved disposal point but cannot connect directly into a sanitary sewer line. The termination has to be somewhere visible, so a backup gets caught before it causes concealed damage.
Access and Clearance
Chapter 3 requires every mechanical appliance to remain accessible for service without removing permanent construction. At least 30 inches of clear working space, deep and wide, must be maintained in front of the control side of each appliance.8ICC. Chapter 3 General Regulations – 2023 Florida Building Code Mechanical Attic installations need a solid walkway at least 24 inches wide from the access opening to the equipment, plus a light fixture near the unit.3Florida Building Commission. Analysis of Changes for the 8th Edition 2023 Florida Building Code Mechanical Skipping either one can fail the inspection.
Ventilation and Exhaust
Chapter 4 sets minimum outdoor air rates by occupancy type, and intakes must be positioned away from plumbing vents, exhaust outlets, and parking areas so contamination does not enter the supply stream.3Florida Building Commission. Analysis of Changes for the 8th Edition 2023 Florida Building Code Mechanical Chapter 5 exhaust systems must discharge directly outdoors. In a Florida attic or crawl space, dumping humid bathroom or kitchen air into the enclosure invites mold.
Minimum Equipment Efficiency
Florida sits in the Department of Energy’s Southeast region, so federal minimums apply on top of the state code. Residential split-system air conditioners under 45,000 BTU need at least 14.3 SEER2; units at or above 45,000 BTU need 13.8 SEER2. Heat pumps must meet 14.3 SEER2 and 7.5 HSPF2 regardless of capacity. Packaged systems must reach 13.4 SEER2. Manufacturers stopped shipping non-compliant units to the Southeast region in 2023.
A2L Refrigerants
In December 2024, the Florida Building Commission adopted ASHRAE 15-2022 as a supplement to the mechanical code, introducing statewide rules for A2L mildly flammable refrigerants such as R-32 and R-454B.9City of Longwood. A2L Refrigerants Information Document These refrigerants are replacing R-410A in new equipment.
In buildings two stories or taller where refrigerant piping crosses multiple floors, the permit package now has to include cubic-foot calculations for each occupied space the piping passes through, identification of the smallest room on that path, and the estimated total refrigerant charge. If the charge exceeds the maximum allowable quantity for that smallest space under ASHRAE 34-2022, the piping must run inside a fire-rated, ventilated shaft designed by a licensed architect or engineer.9City of Longwood. A2L Refrigerants Information Document Most single-family homes will never hit this threshold. Multi-story commercial and multifamily buildings are where it matters.
Flood and Wind Rules for Outdoor Equipment
Flood Hazard Areas
In designated flood hazard areas, HVAC equipment must sit at or above the design flood elevation. That covers condensers, air handlers, ducts, and associated electrical components.10Florida Building Commission. Florida Building Code Mechanical Plumbing and Fuel Gas Flood Provisions Equipment can be located below that elevation only if it is specifically designed and certified to resist water entry, hydrostatic and hydrodynamic loads, and buoyancy.
In coastal high-hazard areas and Coastal A zones, mechanical equipment cannot be mounted on or routed through breakaway walls.11Florida Division of Emergency Management. 7th Edition 2020 Florida Building Code Flood Provisions Those walls are designed to collapse under wave forces, so a bolted-on condenser defeats the design and becomes a projectile in storm surge. Ventilation intake and exhaust openings in flood zones must also be at or above the design flood elevation.10Florida Building Commission. Wind Resistance and the HVHZ
Outdoor condensers and packaged rooftop units must be anchored to resist the wind loads for their location. Contractors size the tie-down system using ASCE 7 wind speed maps and the building’s exposure category. In the High Velocity Hurricane Zone covering Miami-Dade and Broward counties, every product used outdoors must carry a current Notice of Acceptance or Florida Product Approval showing it was tested to HVHZ standards. Roof-mounted units statewide must sit on curbs raised at least 8 inches above the roof surface.
Applying for the Permit
A residential HVAC replacement permit application generally requires a Manual J load calculation for the home, a Manual S equipment selection matching a specific unit to those loads, and the manufacturer’s AHRI certificate confirming the equipment’s rated performance. Submitting the package without accurate load data is the fastest way to have it kicked back.
Most Florida jurisdictions accept applications through online portals, and in-person filing is still available. Permit fees vary by municipality and depend on the scope and value of the work. The application goes in before work begins, with the emergency repair exception being the only situation where work can start first.
Inspections and What Happens if You Fail
A typical residential HVAC installation goes through at least two inspections. The rough-in happens after the ductwork and refrigerant lines are in place but before walls and ceilings are closed, so the inspector can see joints, duct sealing, and supports. The final inspection happens once the system is operating and checks that the installation matches the approved plans, electrical connections are correct, condensate drainage works, and the equipment runs within its rated parameters.
You get one reinspection at the standard fee if the system fails. After that, Florida law allows the local jurisdiction to charge four times the original inspection fee for each additional reinspection.12The Florida Legislature. Penalties for Unpermitted or Unlicensed Work
Criminal and Administrative Exposure
Performing contracting work without a license is a first-degree misdemeanor on the first offense. A second violation, or any violation committed during a governor-declared state of emergency, becomes a third-degree felony.13The Florida Legislature. Insurance and Resale
Florida insurance carriers frequently require four-point inspections on older homes, and those inspections evaluate HVAC condition and code compliance. If unpermitted equipment turns up, the insurer may decline coverage, refuse renewal, or exclude the system from the policy. A water-damage claim tied to an unpermitted condensate drain is exactly the kind of loss an adjuster will scrutinize.
When you sell a home in Florida, the standard seller disclosure form asks directly whether improvements were made without required permits and whether any open permits remain on the property. Florida law requires disclosure of all known facts that materially affect the property’s value, and unpermitted HVAC work is a material fact. Failing to disclose it exposes the seller to a lawsuit after closing. Many municipalities allow after-the-fact permits to legalize existing work, though the process usually involves opening walls for inspection, correcting anything that does not meet code, and paying additional fees.
