Florida business tax exemptions fall into a handful of practical categories: no state income tax at all for pass-through entities, a $50,000 income exemption for C-corporations, broad sales tax exemptions for manufacturers and agricultural operations, a full sales tax exemption for qualified nonprofits, and a $25,000 exemption on business tangible personal property assessed at the county level. Each one has its own paperwork, its own deadline, and its own way of being lost if you skip a step.
Income Tax: Most Florida Businesses Owe Nothing
Florida has no personal income tax. Sole proprietorships, general partnerships, S-corporations, and LLCs taxed as partnerships are pass-through entities, so profits land on the owners’ personal returns and no state tax follows. That covers the vast majority of small and mid-size businesses in the state.
C-corporations are the exception. Florida imposes a 5.5% corporate income tax on net income earned in or attributable to the state, but the first $50,000 of net income is subtracted before the tax is calculated. Filing is still required. Every corporation doing business in Florida, earning income in the state, or organized under Florida law must file a Florida Corporate Income/Franchise Tax Return (Form F-1120) each year, even if the entity is tax-exempt or expects to owe nothing. Sales Tax Exemptions for Manufacturers
Florida’s general sales tax rate is 6%, and counties can add a discretionary surtax on top. Manufacturers can eliminate sales tax on most of their major operating inputs if they document the exemption correctly.
Raw Materials and Components
Materials that physically become part of a finished product for resale are exempt under the standard resale exemption. A furniture maker’s lumber and a food processor’s ingredients qualify, because Florida only taxes the final consumer sale.
Industrial Machinery and Equipment
Industrial machinery and equipment used at a fixed Florida location to manufacture products for sale are fully exempt from sales tax. To qualify, the business’s primary activity at that location must fall within NAICS codes 31, 32, or 33, or codes 112511 (aquaculture) or 423930 (recyclable material wholesalers).3Online Sunshine. You can claim this exemption two ways. Give the seller a signed exemption certificate at purchase, or apply for a Temporary Tax Exemption Permit through Form DR-1214, which is useful for new or expanding manufacturers who want the department’s formal sign-off before making large purchases.4Florida Department of Revenue. Electricity and Steam
Electricity and steam used to run manufacturing machinery are exempt, but the percentage of the bill you save depends on how much of your facility’s power goes to production. If 75% or more powers qualifying machinery, all electricity or steam charges at that site are exempt. Between 50% and 74%, the exemption is 50%. Research and Development Equipment
Machinery and equipment used primarily for research and development are also sales-tax exempt. “Primarily” means at least 50% of the equipment’s use is dedicated to R&D. If a piece of equipment is split between production and research, track the usage carefully so you can show R&D accounts for the majority.5Florida Department of Revenue. Agricultural and Aquaculture Exemptions
Florida farms, ranches, and aquaculture operations get some of the broadest sales tax exemptions in state law. Power farm equipment and irrigation equipment, including replacement parts and repairs, are fully exempt when used in agricultural production.6Legal Information Institute. Other exempt categories include:
- Field, garden, and flower seeds used in cultivation.
- Fertilizers (including peat, topsoil, compost, and manure), insecticides, fungicides, pesticides, and weed killers used on crops, groves, or in commercial nurseries.
- Livestock feed, with “livestock” defined to include aquaculture products such as fish, shrimp, crabs, mollusks, alligators, and turtles.
- Diesel, kerosene, and liquefied petroleum gas used exclusively in tractors and farm equipment on the farm.
- Electricity used for production, packing, or processing of agricultural products on a farm or in a packinghouse.
To claim these, provide the seller with a signed purchaser’s exemption certificate. Nonprofit Sales Tax Exemption
Qualified charitable, religious, and educational organizations can apply for a Consumer’s Certificate of Exemption (Form DR-14) from the Florida Department of Revenue. Once issued, a copy of the certificate is presented to sellers at purchase, and the organization pays no sales tax as long as the purchase is used for its exempt purpose.8Florida Department of Revenue. To apply, submit a completed Application for a Consumer’s Certificate of Exemption (Form DR-5). The certificate must be renewed periodically. Purchases that fall outside the organization’s exempt purpose stay taxable even when the certificate is valid.
The $25,000 Tangible Personal Property Exemption
Separate from state taxes, Florida counties impose an annual tangible personal property (TPP) tax on business assets like furniture, computers, machinery, and fixtures, based on assessed value as of January 1. Every business is entitled to exclude the first $25,000 of assessed value, which wipes out the tax entirely for most small operations.
To activate the exemption, file a Tangible Personal Property Tax Return (Form DR-405) with your county property appraiser by April 1.9Florida Department of Revenue. Missing April 1 is expensive. Late returns are penalized at 5% of the total tax on the property for each month or partial month late, up to 25%. Not filing at all draws a 25% penalty for that year. Corporate Income Tax Credits Worth Claiming
For C-corporations that do owe Florida corporate income tax, two credits can reduce the bill further.
The Individuals with Unique Abilities Tax Credit gives C-corporations one dollar for each hour a qualifying disabled employee works during the tax year, up to 1,000 hours per employee. The employee must have worked for the company at least six months. A single business can claim up to $10,000 per year, and the program is authorized for tax years 2024 through 2026.11Florida Senate. The Research and Development Tax Credit under Section 220.196 offers a corporate income tax credit for qualified R&D expenses, but with a statewide cap of $9 million per calendar year across all applicants, so the credit is competitive.12Online Sunshine. Qualified Target Industry Refunds
Businesses in industries Florida has designated as economic priorities may qualify for the Qualified Target Industry (QTI) refund program. This is a reimbursement rather than an exemption. Approved businesses receive $3,000 per new job created, or $6,000 per job in a rural community or enterprise zone. Additional per-job bonuses of $1,000 or $2,000 are available for wages significantly above the local average.14Florida Senate. Retail businesses, electric utilities, mining operations, and hospitality companies regulated by the Division of Hotels and Restaurants are specifically excluded.
How to Actually Claim These Exemptions
Every business selling taxable goods or services in Florida must first register with the Department of Revenue to receive a Certificate of Registration. Registration is also necessary for businesses that only buy tax-exempt goods, because the state needs your account on file before it will process exemption applications.
The document you present to the seller depends on the exemption:
- Resale purchases: a valid Annual Resale Certificate.
- Manufacturing equipment: a signed exemption certificate given directly to the seller, or a Temporary Tax Exemption Permit obtained through Form DR-1214.
- Agricultural inputs: a signed purchaser’s exemption certificate (or Aquaculture Certification for aquaculture operations).
- Nonprofit purchases: a Consumer’s Certificate of Exemption (Form DR-14).
Get the paperwork before the purchase, not after. Then keep the documentation organized: copies of every exemption certificate, invoices showing the exempt transaction, and records showing how the exempt property was actually used. Auditors verify use, not just paperwork. A manufacturer who buys equipment tax-free and then uses it entirely for non-manufacturing activities will owe back taxes, interest, and penalties.
Florida law requires businesses to keep books, records, invoices, and supporting documents for as long as the Department of Revenue can issue an assessment under Section 213.35, generally three years but longer for fraudulent or unfiled returns.15Online Sunshine. Penalties for Getting It Wrong
Late filing or late payment of sales and use tax draws a penalty of 10% of the tax owed, with a $50 minimum even when no tax is due. Businesses required to file and pay electronically face an additional $10 penalty for each missed electronic filing or payment.16Florida Department of Revenue. Florida Sales and Use Tax
Late corporate income tax returns are penalized at 10% of the tax due for the first month and 10% for each additional month, up to 50%. A late return with no tax due still carries $50 per month, capped at $300.17Online Sunshine. Florida Statutes 220.801 – Penalties; Failure to Timely File Returns
Florida also charges a floating interest rate on late-paid taxes, adjusted every six months. The rate for the first half of 2026 is 11%.18Florida Department of Revenue. Floating Rate of Interest – January 1, 2026
If you discover an unreported tax liability before the department contacts you, the Voluntary Disclosure Program waives all penalties in exchange for paying the tax and interest owed, with one exception: a 5% penalty still applies if you collected tax from customers but never remitted it.
