Florida Car Lease Tax: State Rate, Surtax, and Cap

Florida car lease tax is calculated on the total of your monthly payments, not the vehicle’s sticker price. You pay the state’s 6% sales tax on that full lease total, plus a county surtax that applies only to the first $5,000, and the tax is spread across your monthly payments rather than collected as a lump sum at signing.1Online Sunshine. How the Tax Is Calculated

For a long-term vehicle lease of 12 months or more, Florida’s taxable base is the sum of every periodic payment you’re obligated to make under the contract. Sign a 36-month lease at $450 a month and the taxable base starts at $16,200, regardless of what the car would sell for outright.1Online Sunshine. Florida Code 212.05 – Sales, Storage, Use Tax

The total tax bill is set at signing, but you don’t write one big check for it. The dealer divides it across your monthly payments, and the leasing company remits the tax to the Department of Revenue as each payment comes due.2Florida Department of Revenue. Technical Assistance Advisement 01A-063 That monthly collection matters later if you end the lease early or move.

Because you’re only taxed on what you pay to use the vehicle, a lease usually generates less total sales tax than an outright purchase of the same car, where tax hits the full sale price at once.

State Rate, County Surtax, and the $5,000 Cap

The statewide sales tax rate is 6% and applies in every county.3Florida Department of Revenue. The surtax follows the lessee, not the dealer. Florida bases the motor vehicle surtax on the county where you live, so shopping at a dealership two counties over doesn’t change which rate applies.3Florida Department of Revenue. Florida Sales and Use Tax

Here’s the piece most lessees miss. The county surtax applies only to the first $5,000 of any single item of tangible personal property.5Online Sunshine. Florida Code 212.054 – Discretionary Sales Surtax; Authorization and Use The 6% state rate runs across your entire taxable lease total, but the surtax stops at $5,000. On $18,000 in total payments in a county with a 1% surtax, the county portion is $50, not $180.

A Worked Example

Say your total lease payments come to $15,000 and you live in a county with a 1% surtax:

  • State tax (6%): $15,000 × 0.06 = $900
  • County surtax (1%, capped at $5,000): $5,000 × 0.01 = $50
  • Total tax: $950, spread across your monthly payments

Lowering the Taxable Base

Two things at signing shrink the amount you’re taxed on, and both take effect before the rate is applied.

Trade-In Credit

The value of a trade-in is subtracted from your total lease payments before tax is calculated. Handing over a car worth $4,000 on a lease with $18,000 in total payments drops the taxable base to $14,000. That’s $240 saved in state tax alone.

Cash Down at Signing

Dealers call a cash down payment a “capitalized cost reduction” because it lowers the capitalized cost, which lowers each monthly payment. Since the taxable base is the total of those payments, a bigger down payment produces a smaller taxable total and less tax overall. A $3,000 down payment on the same $18,000 lease saves roughly $180 in state tax.

The two credits stack. Trade in a $4,000 vehicle and put $2,000 cash down, and your taxable base drops by $6,000.

Buying the Vehicle at Lease End

Most leases let you purchase the car at the end for a residual value set in the contract. Florida treats that buyout as a separate purchase, and you owe sales tax on the buyout price. The tax you paid on your lease payments doesn’t offset it, because the lease covered your right to use the vehicle and the buyout is the sale of the vehicle itself.

On a car with a $16,000 residual, you’d owe $960 in state tax plus the capped county surtax on that amount. If you know at signing that you want to own the car, it’s worth pricing a straight financed purchase against a lease-then-buy, because paying tax on both stages sometimes costs more overall.

Ending the Lease Early

Because Florida collects lease tax as each payment comes due, terminating early means you stop paying tax on payments that never arise.2Florida Department of Revenue. Technical Assistance Advisement 01A-063 Past tax already paid isn’t refunded, but future months you don’t use aren’t taxed.

The trade-off is the early termination fee. Most agreements impose a substantial penalty, and federal law requires the leasing company to disclose the calculation method. A motor vehicle lease must include a notice that early termination charges “may be up to several thousand dollars” and that ending sooner increases the charge.6eCFR. Whether the termination fee itself carries Florida sales tax depends on how the contract characterizes it. Fees tied to the remaining unamortized cost of the vehicle generally are taxable, since they act as accelerated lease payments. Ask the leasing company before signing.

Moving To or From Florida Mid-Lease

Lease a car in another state and move to Florida before the lease ends, and Florida taxes your remaining monthly payments once you register the vehicle here. The state doesn’t credit you for monthly sales tax paid to the previous state.2Florida Department of Revenue. Moving out works the other direction. Once you register the vehicle in the new state, Florida tax no longer applies to future payments. The new state’s rules may look very different from Florida’s, so check with that state’s tax authority before the move.

Other Fees at Signing

Sales tax is the biggest government charge on a lease, but a few others hit at signing.

Title and Registration

Florida issues the title in the leasing company’s name, not yours. The electronic title fee for a new vehicle is $77.25, with an additional $2.50 for a paper title.7Florida Department of Highway Safety and Motor Vehicles. Fees Registration fees depend on the vehicle’s weight and type.

If you need a new license plate, there’s a one-time initial registration fee of $225.7Florida Department of Highway Safety and Motor Vehicles. Fees Transferring a plate from a vehicle you already own avoids that charge and costs only a small processing fee.

Dealer Documentation Fee

Florida doesn’t cap dealer documentation fees by law, and amounts commonly run from around $600 to $999. The doc fee is typically rolled into the capitalized cost of the lease, which means it becomes part of the taxable base. You pay 6% state tax on it too, so a $900 doc fee adds $54 in state tax on top of the fee itself.
