Points and Fines in Detail
Careless driving without a crash is a non-criminal moving violation. For most people, the premium increase is the largest long-term cost.
Points from careless driving can combine with other violations to trigger a suspension. Florida’s thresholds:
- 12 points within 12 months: suspension of up to 30 days
- 18 points within 18 months: suspension of up to 3 months
- 24 points within 36 months: suspension of up to 1 year

When a Crash Is Involved

When the crash causes death or serious bodily injury, the process changes. Florida law requires a mandatory court hearing for any traffic infraction that results in a crash causing death or serious bodily injury. You cannot pay the fine and move on, and you cannot elect traffic school to avoid points.5Online Sunshine. If another person dies as a result of the infraction, the court may order up to 120 hours of community service on top of any other penalty.6Online Sunshine. How to Respond to the Ticket
You generally have 30 days from the date of the citation to respond. Your choice determines whether the points land on your record. There are three paths.
Pay the Fine
Paying is the fastest option and the worst one for your record. Payment counts as an admission of guilt, so you get the conviction, the three points, and the insurance consequences. If this looks like the easy route, factor in years of higher premiums against the one-time savings of skipping traffic school or a hearing.
Elect Traffic School
You can choose to attend a basic driver improvement course approved by the Department of Highway Safety and Motor Vehicles. The option has limits. You can elect traffic school only once every 12 months, and no more than five times in your lifetime.6Online Sunshine. Contest the Citation
You can request a hearing before a civil traffic hearing officer or judge. This is the only path to outright dismissal, but it takes preparation. You need to challenge the officer’s account, present evidence, and argue that the facts don’t meet the statutory standard. If you lose, the judge sets the penalty and you lose the traffic school option. Contesting makes the most sense when you have real grounds to dispute what happened, such as dashcam footage, witnesses, or circumstances the officer may have misread.
What Ignoring the Ticket Costs You
Doing nothing is the worst option. If you fail to pay the fine, fail to appear at a required hearing, or fail to complete a driver improvement course you elected, your license is suspended indefinitely. Indefinite means exactly that: the suspension does not expire on its own. Special Cases: CDL Holders and Out-of-State Drivers
Commercial driver’s license holders face a stricter set of rules. The stakes rise from there: two serious traffic violations within three years can result in a 60-day CDL disqualification.
Out-of-state drivers can’t leave the ticket behind either. Florida participates in the Driver License Compact, so if you’re licensed in another participating state, the conviction is reported home and your state’s DMV assesses points under its own system. Florida also participates in the Nonresident Violator Compact, which lets your home state suspend your driving privileges if you ignore a Florida citation, even though the offense happened here.
Careless Driving vs. Reckless Driving
Careless driving is a civil traffic infraction, not a crime.
