Florida condo handicap parking laws come from two layers of rule. The Americans with Disabilities Act, adopted into Florida law through Chapter 553, sets the minimum number and design of accessible spaces every condominium parking lot must provide. The federal Fair Housing Act and Florida’s Fair Housing Act (Chapter 760) go further: they require the association to grant reasonable accommodations, such as a designated space close to a resident’s unit, when a disability makes one necessary.1The Florida Legislature. Accessible Spaces the Lot Must Provide
The number of accessible spaces required depends on the size of the lot. For the sizes typical at a Florida condominium:3ADA.gov. Accessible Parking Spaces
- 1–25 total spaces: 1 accessible
- 26–50: 2 accessible
- 51–75: 3 accessible
- 76–100: 4 accessible
- 101–150: 5 accessible
- 151–200: 6 accessible
- 201–300: 7 accessible
At least one out of every six accessible spaces must be van-accessible, meaning it has a wider access aisle to accommodate a wheelchair lift.4U.S. Access Board. Chapter 5 – Parking Spaces
Design matters too. Each accessible space and its access aisle must be nearly level, with no more than a 2.08 percent slope in any direction, and the aisle must sit flush with the space itself so there is no lip between them. Spaces need both above-grade signage and painted surface markings. If a lot is missing the above-grade sign, officers may issue a warning instead of a full citation, but the space is still enforceable.3ADA.gov. Accessible Parking Spaces5Justia Law. Getting a Designated Space Near Your Unit
ADA-compliant accessible spaces in a condo lot are general-use spaces. Any driver with a valid permit can park in them, first come, first served. A resident who needs a guaranteed space close to their unit is asking for something different: a reasonable accommodation under the Fair Housing Act.
Both the federal and Florida Fair Housing Acts define discrimination to include refusing to make reasonable accommodations in rules, policies, or services when those changes are necessary for a person with a disability to have equal use and enjoyment of their home.6Office of the Law Revision Counsel. 42 USC 36042Florida Senate. Florida Code 760.23 – Discrimination in the Sale or Rental of Housing Assigning a specific parking space near a resident’s front door is one of the most common accommodations in the condominium setting. Because it is a change to how the association uses its common elements rather than a structural change to the building, it is an accommodation, not a modification. How to Submit the Request
Put the request in writing to the board of directors. A strong request:
- Identifies itself as a request for a reasonable accommodation under the Fair Housing Act
- Describes exactly what you need (for example, a marked space within a specified distance of your unit)
- Explains how the accommodation relates to your disability
- Attaches supporting documentation
If your disability is not obvious, a letter from a healthcare provider confirming the disability-related need for close parking is usually enough. The letter does not have to disclose a diagnosis. It only needs to describe the functional limitation and why a nearby space is necessary. Keep a dated copy of everything you send. Boards misplace paperwork, and proof of when you submitted the request will matter if the response is slow or the request is denied.
What the Board Must Do
The board must take the request seriously and respond within a reasonable timeframe. HUD guidance recommends responding within 10 business days.9U.S. Department of Housing and Urban Development. If the board thinks the exact request is unworkable, it cannot simply deny it. Joint guidance from HUD and the Department of Justice directs the association and the resident to engage in an interactive process: talk through the disability-related need and look at alternatives that would still meet it. The resident is not obligated to accept an alternative that fails to address the underlying limitation.7U.S. Department of Justice. When a Denial Is Legal
An association may deny a request only if granting it would impose an undue financial and administrative burden or fundamentally alter the association’s operations. That is a case-by-case determination that weighs cost, the association’s resources, the benefit to the resident, and whether an effective alternative exists.7U.S. Department of Justice. The cost of a sign and fresh striping is small, and the operational change is minor.
Who Pays
The association covers the cost of the accommodation, including installing signage and restriping the space. Federal guidance is explicit that housing providers cannot charge residents extra fees or deposits as a condition of receiving an accommodation.7U.S. Department of Justice. Joint Statement on Reasonable Accommodations Under the Fair Housing Act The association can convert an existing guest or common-area space for the resident’s exclusive use.
Florida Disabled Parking Permits
Florida issues disabled parking permits through the Department of Highway Safety and Motor Vehicles in two forms:8Florida Department of Highway Safety and Motor Vehicles. Disabled Person Parking Permits
- Permanent permits for long-term mobility impairments or people certified as legally blind. Valid for four years, renewed by the holder’s birthday, no fee.
- Temporary permits for short-term impairments. Valid up to six months, $15 fee. If the condition continues, a second temporary permit can be issued at no charge if applied for within 12 months of the first.
Both require a completed HSMV Form 83039 signed by a certifying medical authority (physician, podiatrist, optometrist for vision-related disabilities, advanced practice registered nurse, or physician assistant). The signed form must be submitted in person at a motor vehicle service center. Disabled license plates issued under Chapter 320 also work as valid credentials for accessible parking.
Enforcement in the Condo Lot
Florida enforces accessible parking rules on both public and private property, so a condominium lot is treated the same as a public lot.10Florida Senate. Florida Code 316.1959 – Handicapped Parking Enforcement Parking in a marked accessible space without a valid permit or plate, or blocking an access aisle, curb cut, or the path of travel to an accessible space, is a noncriminal traffic infraction. Any vehicle parked illegally in an accessible space can be removed immediately by a law enforcement officer, a parking enforcement specialist, or the property owner. Towing and storage costs become a lien against the vehicle, so the owner has to pay them to get the car back. For the association, this means the board can initiate towing of unauthorized vehicles from accessible spaces without waiting for law enforcement to arrive.
If the Association Says No
A denial without a documented undue burden or fundamental alteration is the kind of decision that leads to discrimination claims. Residents have two main paths.
Florida Dispute Resolution
For disputes involving the board’s authority over common elements, Florida law generally requires nonbinding arbitration through the Division of Florida Condominiums or presuit mediation before litigation. The arbitration petition has a $50 filing fee, and you must show that you gave the board written notice of the dispute, a demand for relief, and a warning that a petition would follow if the matter was not resolved.11Florida Senate. HUD Complaint
You can file a housing discrimination complaint with HUD’s Office of Fair Housing and Equal Opportunity online, by phone at 1-800-669-9777, or by mail.12U.S. Department of Housing and Urban Development.
