Florida emotional support animal laws give people with disabilities the right to keep an ESA in rental housing without paying pet fees, and they set clear rules for the documentation landlords can require. The framework lives in Florida Statute 760.27, which works alongside the federal Fair Housing Act. It spells out who qualifies, what a landlord can ask for, what fees are off the table, and what happens to people who fake a claim.1Florida Senate. What Counts as an Emotional Support Animal
Under Florida law, an emotional support animal is one that provides therapeutic emotional support simply by being present, alleviating one or more symptoms of a person’s disability. It does not need any specialized training.1Florida Senate. Service animals under the Americans with Disabilities Act are limited to dogs individually trained to perform specific tasks for their handler’s disability. Documentation That Landlords Will Accept
You do not need a particular diagnosis. What you need is reliable proof of a disability and a disability-related need for the animal. Florida Statute 760.27 lets a housing provider request supporting information when the disability is not obvious, and it lists the sources that qualify:
- A disability determination from any federal, state, or local government agency.
- Proof that you receive disability benefits or services from a government agency.
- Evidence of eligibility for a housing voucher based on disability.
- A letter or statement from a licensed health care practitioner who has personal knowledge of your disability and is acting within the scope of their practice.

Two conditions catch people out. The practitioner must have personal knowledge of your disability, so a five-minute online questionnaire from someone who has never evaluated you will not hold up. And if the practitioner is licensed outside Florida, they must have provided you in-person care at least once. Florida-licensed telehealth providers can issue documentation without an in-person visit; out-of-state telehealth alone cannot.1Florida Senate. Online ESA Certificates Are Not Enough
Florida law states outright that an ESA registration, identification card, patch, certificate, or similar item purchased online is not, by itself, sufficient proof of a disability or need for an ESA.1Florida Senate. Legitimate ESA owners lose battles with landlords over this all the time. They pay for an online certificate, hand it over, and the landlord rejects it, correctly. If you need documentation, get it from a licensed professional who has actually evaluated you.
What Landlords Must Do, and What They Cannot Charge
The Fair Housing Act requires landlords to make reasonable accommodations in their rules and policies so a person with a disability has equal opportunity to use and enjoy their home.4Office of the Law Revision Counsel. 42 USC 3604 – Discrimination in the Sale or Rental of Housing In Florida, that means a qualifying tenant can keep an ESA even in a no-pet building.
On money, the statute is direct: a person with a disability who keeps an ESA cannot be required to pay extra compensation for the animal.1Florida Senate. No nonrefundable pet fee. An ESA is a reasonable accommodation, not a pet.
When a Landlord Can Say No
Approval is not automatic. A landlord may deny an ESA accommodation if the specific animal poses a direct threat to the health or safety of others, or a direct threat of physical damage to the property, and that threat cannot be reduced or eliminated by another reasonable accommodation.1Florida Senate. Florida Statutes 760.27 – Prohibited Discrimination in Housing Provided to Persons With a Disability or Disability-Related Need for an Emotional Support Animal A blanket breed ban or a general worry about what the animal “might” do does not meet that standard. The threat has to be tied to the actual animal’s behavior or nature.
A landlord can also refuse when the documentation is inadequate, such as an online registry certificate on its own, or a letter from a practitioner with no personal knowledge of the tenant’s condition.
What a Landlord Cannot Ask You
The right to request documentation stops short of your medical file. HUD guidance says housing providers cannot require you to disclose your specific diagnosis or the severity of your disability, demand your medical records, require a medical exam, or insist that your provider use a particular form or sign a notarized statement.3U.S. Department of Housing and Urban Development. What they can ask for is confirmation of a disability and a disability-related need for the specific animal. The practitioner’s letter should describe the therapeutic support the ESA provides without opening up your clinical history. A landlord who pushes for your diagnosis or wants to speak directly with your therapist has gone too far.
You Still Pay for Damage
The no-fee rule is not a no-liability rule. Florida Statute 760.27 says a person with a disability or disability-related need is liable for damage their ESA does to the premises or to another person on the premises.1Florida Senate. Florida Statutes 760.27 – Prohibited Discrimination in Housing Provided to Persons With a Disability or Disability-Related Need for an Emotional Support Animal A landlord cannot collect a pet deposit up front, but if your ESA shreds the carpet or bites a neighbor, you owe. Damage can come out of your regular security deposit at move-out, and anything beyond that can still be pursued.
Penalties for Faking an ESA
Florida Statute 817.265 makes it a second-degree misdemeanor to falsify ESA documentation, provide fraudulent information, or misrepresent yourself as having a disability or a need for an ESA.5Florida Senate. The statute also requires anyone convicted to perform 30 hours of community service within six months of the conviction, with an organization that serves people with disabilities or another organization the court selects.5Florida Senate. Where ESA Rights Stop: Businesses and Airlines
Florida’s ESA protections are about housing. Once you leave your home, they largely end. Under the ADA, only dogs individually trained to perform specific tasks qualify as service animals with public access rights. An animal whose sole function is comfort or emotional support does not qualify.7U.S. Department of Justice. The same is now true in the air. The U.S. Department of Transportation revised its rules under the Air Carrier Access Act, and airlines only recognize trained service dogs for in-cabin travel. ESAs, comfort animals, and companionship animals are explicitly excluded.8U.S. Department of Transportation. Service Animals If you fly with your ESA, you follow the airline’s standard pet policy, which usually means a carrier fee and size limits.
If a Landlord Violates Your Rights
If a landlord refuses a legitimate ESA accommodation, charges pet fees, or demands your medical records, you can file a housing discrimination complaint with HUD. You can do it online, by phone at 1-800-669-9777, or by mailing a printed form to your regional HUD office.
