Gamarro vs Walgreens $6.8M Settlement: Eligibility and Payouts

The Gamarro v. Walgreens settlement is a $6.8 million California class action resolution covering pharmacy technicians who say Walgreens underpaid them and denied required meal and rest breaks. A Los Angeles Superior Court judge granted preliminary approval on April 21, 2025, and the final approval hearing is set for August 26, 2025.¹

Who Is Covered

The settlement class covers all current and former hourly, non-exempt pharmacy technicians who worked for Walgreen Pharmacy Services Midwest, LLC or Walgreen Co. at any California pharmacy location between April 15, 2020 and April 20, 2024. The court identified roughly 6,108 class members. The start date was picked to avoid overlap with a prior class action involving a similar group of workers.¹

A narrower PAGA subgroup covers pharmacy technicians employed from August 10, 2021 through April 20, 2024. Members of that subgroup share the $50,000 employee PAGA allocation and cannot opt out of the PAGA portion of the settlement, even if they exclude themselves from the broader class.²

How Much You’ll Get

Walgreens agreed to a gross settlement of $6,800,000. After attorneys’ fees, litigation costs, PAGA penalties, administration, and a $10,000 service award to the named plaintiff, approximately $4,245,383 goes to class members on a pro rata basis.³

You don’t need to file a claim. Payments are automatic and mailed to the address Walgreens has on file. Each share is based on how many workweeks you were employed during the class period. The administrator divides the net fund by the total eligible workweeks across the entire class (489,457 workweeks), then multiplies by your workweek count. That works out to roughly $8.67 per eligible workweek. Someone who worked the full four-year class period will receive a meaningfully larger check than someone employed for only a few months.²

If the total workweek count comes in above 538,403 (a ten percent increase over the baseline), Walgreens must increase the gross settlement proportionally.²

What the Lawsuit Alleged

Named plaintiff Anita Gamarro filed the case on August 10, 2022. She alleged that Walgreens systematically shortchanged pharmacy technicians by failing to pay proper overtime and minimum wages, denying required meal and rest breaks, issuing inaccurate wage statements, paying wages late, and failing to reimburse business expenses. The complaint raised ten causes of action under the California Labor Code, the Unfair Competition Law, and the Private Attorneys General Act. Walgreens denied all allegations and maintained it complied with California law throughout the relevant period.⁴

Key Dates and What to Do

ILYM Group, the court-appointed settlement administrator, mailed notice packets to class members beginning May 12, 2025.⁵ If you want to opt out or file a written objection, the deadline is June 26, 2025. The final approval hearing is scheduled for August 26, 2025 at 8:30 a.m. in Department 71 of the Stanley Mosk Courthouse in Los Angeles.²

If the court grants final approval and no appeals follow, ILYM Group will distribute checks. Checks are valid for 180 days.
