Garnet Health Settlements: Patient Privacy and 403(b) Plan

Two separate class action settlements involving Garnet Health are moving through the courts, and they cover different people for different reasons. One pays former patients whose data was allegedly shared with Meta and Google through website tracking pixels. The other pays current and former employees who participated in the Garnet Health Medical Center 403(b) Retirement Savings Plan. Eligibility, payment amounts, and deadlines are different for each. The Patient Data Privacy Settlement

Who Is Eligible

The class covers roughly 153,000 current and former Garnet Health patients who had a MyChart account with an “alive” status between May 7, 2020, and August 10, 2023.1ClassAction.org. When You’ll Be Paid

The court granted preliminary approval on November 19, 2025, and the final approval hearing was scheduled for April 13, 2026, before Judge Aaron Maslow.1ClassAction.org. The 403(b) Retirement Plan Settlement

The second case, George et al. v. Garnet Health Medical Center (Case No. 7:24-cv-6422, S.D.N.Y.), has nothing to do with patient data. Four employees sued in August 2024, alleging violations of the Employee Retirement Income Security Act (ERISA) in the management of the Garnet Health Medical Center 403(b) Retirement Savings Plan.7GarnetHealthERISASettlement.com. Who Is Eligible

What You Can Get

Garnet Health agreed to pay $4.6 million, which the court found to be roughly 22% of the maximum estimated damages.10Bloomberg Law. Garnet Health to Pay $4.6 Million to Exit Retirement Fee Lawsuit After court-approved deductions, the remainder is distributed to class members under an allocation plan. The approved deductions are:

  • Attorneys’ fees of $1,533,333.33, or one-third of the gross fund
  • Litigation expenses of $47,120.10
  • Settlement administration fees of $29,895.00 to Atticus Administration
  • Independent fiduciary fees of $15,000.00 to Fiduciary Counselors, Inc.

Current plan participants have their share deposited directly into their retirement accounts. Former participants who no longer have an account receive a check unless they submitted a rollover form by April 20, 2026. Case Status

Judge Philip M. Halpern granted preliminary approval on December 2, 2025.12Bloomberg Law. Garnet Health’s $4.6 Million Retirement Settlement Clears Hurdle He held the fairness hearing on April 20, 2026, and issued a final order the same day approving the settlement as “fair, reasonable, and adequate.” No objections were filed. Which Settlement Applies to You

These are independent cases with independent classes. Being a Garnet Health patient does not put you in the retirement plan class, and being a plan participant does not put you in the patient data class. It’s possible to qualify for both if you were both an employee-participant and a MyChart patient during the class periods, but each requires its own filing steps and pays from its own fund.
