Garth Brooks Lawsuit: Accuser’s Claims, Denial, and Countersuit

The Garth Brooks lawsuit is actually two lawsuits filed within weeks of each other in fall 2024: a California civil suit accusing the country singer of rape and sexual assault, and a Mississippi federal suit Brooks filed against the same woman for extortion and defamation. Brooks denies the allegations. As of mid-2026, both cases are on hold while a federal appeals court decides whether the accuser can proceed anonymously.

Who the Accuser Is

The woman, identified in court filings as “Jane Roe,” is a professional makeup artist and hair stylist from Mississippi. She began working for Trisha Yearwood in 1999 and started providing services to Brooks in 2017.¹ According to her complaint, Brooks began hiring her more frequently in early 2019 after she experienced financial hardship. She stopped working for him in 2021 when she moved to Mississippi.²

What She Alleges

The California complaint describes a pattern of sexual misconduct in 2019 and 2020. The central allegation is that on May 11, 2019, Brooks raped her in a Los Angeles hotel suite while he was in town for a Grammy tribute performance.³⁴ In another alleged incident, the complaint says Brooks walked out of a shower naked, grabbed her hands, and forced them onto his genitals.

The complaint also alleges Brooks regularly exposed himself in front of her, groped her breasts while she was doing his hair and makeup, sent sexually explicit text messages, and made repeated remarks about having a threesome with Yearwood.³ She says he attempted to assault her again in late October 2019 during a work trip to Los Angeles but she escaped because he was running late for a scheduled departure, and that in 2020 he took her phone and deleted most of his sexually explicit messages.²

Brooks’ Denial and Mississippi Countersuit

Brooks has categorically denied the allegations. He said in a public statement that he had been “hassled to no end with threats, lies, and tragic tales of what my future would be if I did not write a check for many millions of dollars,” adding: “Hush money, no matter how much or how little, is still hush money.”⁵

He didn’t wait to be sued. On September 13, 2024, Brooks filed a federal suit in the U.S. District Court for the Southern District of Mississippi, accusing the woman of extortion, defamation, and intentional infliction of emotional distress. He initially filed under the pseudonym “John Doe.”⁶ According to that complaint, the accuser’s attorneys had sent two demand letters in July and August 2024, and the second threatened a lawsuit and public disclosure unless Brooks made a “multimillion-dollar payment.”⁵ Brooks filed the day her attorneys had set as their deadline to sue in California if talks failed. In his Mississippi filings, he called her a “lying extortionist” and himself “the victim of a shakedown,” claiming the allegations arose only after he refused to give her salaried employment and health benefits.³

The California Case

The accuser filed her suit in Los Angeles County Superior Court on October 3, 2024, naming Brooks.¹ She brought it under California’s Sexual Abuse and Cover-Up Accountability Act (AB 2777), which revives otherwise time-barred sexual misconduct claims for conduct occurring on or after January 1, 2009. The causes of action include assault, battery, sexual battery, and claims under California’s Bane Act, Ralph Act, and gender violence statute.³

The case moved to the U.S. District Court for the Central District of California in November 2024 and was assigned to Judge Michael W. Fitzgerald. Brooks moved to dismiss, arguing the accuser’s claims were compulsory counterclaims that belonged in the Mississippi action. In December 2024, Judge Fitzgerald denied the motion without prejudice, citing the pending Mississippi case, and stayed the California proceedings.⁷⁸

The Fight Over the Accuser’s Anonymity

The pseudonym issue is what has stalled everything. Brooks’ own request to proceed as “John Doe” in Mississippi was denied by Judge Wingate, who cited the potential “unavoidable damage to his family” argument but ruled against it.³⁹¹⁰ Her attorneys called the naming “purely out of spite” and sought sanctions.

In September 2025, Judge Wingate denied her motion to proceed as “Jane Roe” and denied her sanctions request, finding that her identity was already public and that she appeared “more concerned with airing Mr. Doe’s identity to the public than preserving her own confidentiality.”¹¹ She appealed to the Fifth Circuit Court of Appeals.¹²

Where the Cases Stand Now

Both cases are effectively frozen while the Fifth Circuit considers the pseudonym appeal. In May 2026, a three-judge panel denied Brooks’ motion to expedite the appeal and set a briefing schedule that runs into the summer. A final opinion is not expected until at least fall 2026, and it isn’t clear whether the court will hold oral arguments.¹³

In the Mississippi case, Judge Wingate ruled on May 1, 2025, that the accuser’s original motion to dismiss was “moot.”⁶ She filed an amended motion to dismiss and change venue in November 2025, arguing Brooks chose Mississippi to bypass California’s anti-SLAPP protections. That motion remains pending.¹⁴ The California federal case is still stayed, with Brooks’ attorneys required to notify Judge Fitzgerald of any Mississippi developments within 10 court days.¹⁵

Brooks’ Career and Marriage Since the Allegations

Brooks completed a 72-show Las Vegas residency at the Colosseum at Caesars Palace in March 2025 and has continued to perform on a limited schedule.¹⁶ He is scheduled to headline two nights at Milwaukee’s Summerfest in June 2026 and a date at London’s BST Hyde Park later that month.¹⁷

Brooks and Yearwood, who married in December 2005, have stayed together through the litigation. On The Drew Barrymore Show, Yearwood said of the marriage: “This is not an option because I’m with the love of my life. So, we just figure it out.”¹⁸
