The 2017 Prison Sentence
In November 2017, Brinkley sentenced Mill to two to four years in state prison for violating probation. The cited conduct: a St. Louis airport altercation and a reckless driving arrest during a New York music video shoot (both set for dismissal or not prosecuted), plus a positive Percocet test.3WHYY. Misconduct Allegations Against Brinkley

During a February 2016 in-chambers meeting attended by Mill and his then-girlfriend Nicki Minaj, Brinkley reportedly asked Mill to record a cover of the Boyz II Men song “On Bended Knee” and include a shout-out to her. The motion also alleged she pressed Mill to leave Jay-Z’s Roc Nation and return to his former Philadelphia manager, Charles “Charlie Mack” Alston, telling him “it seemed as if, while Mr. Mack was representing him, there were fewer problems with the probation department.” Brinkley made an unannounced visit to a homeless shelter to watch Mill perform court-ordered community service, then reprimanded him about his tasks. According to the Philadelphia Inquirer, the FBI asked Mill in 2016 to secretly record conversations with Brinkley. He refused, and that inquiry ended.7Philadelphia Inquirer. The Arresting Officer’s Credibility Collapsed
The 2007 arrest that started it all rested on the testimony of one officer, Reginald Graham. A Philadelphia Police internal affairs investigation sustained findings that Graham engaged in criminal conduct, stole money on duty, and lied about it. A former colleague, Jeffrey Walker, said in a sworn affidavit that Graham bragged about beating Mill during the 2007 arrest and that Graham’s arrest report bore “the hallmarks of a fraudulent affidavit, written to manufacture probable cause.”10The Appeal. Conviction Overturned and Case Taken Away From Her
On April 24, 2018, the Pennsylvania Supreme Court granted Mill bail after roughly five months in prison.1Equal Times. The Philadelphia District Attorney’s office under Larry Krasner asked for a new judge as well, citing “the appearance of partiality.” The case was reassigned away from Brinkley.12ABC News. Stripped of Her Criminal Docket
In December 2022, the supervising judges of Philadelphia’s First Judicial District reassigned Brinkley from criminal court to civil court and pulled every remaining criminal case from her.13Philadelphia Inquirer. Brinkley called the move unlawful and petitioned the Pennsylvania Supreme Court (Case No. 99 EM 2022) for a writ of mandamus to reverse it. Roughly 120 Sentences Called Excessive
After the reassignment, attorneys at the Defender Association of Philadelphia and prosecutors began reviewing Brinkley’s caseload. The review found she had imposed illegal sentences, allowed sentences to run past their maximum dates, extended probation tails beyond what the law permitted, and failed to schedule hearings ordered by higher courts. Protests and Her Withdrawal From Retention
As the sentencing review became public, the 215 People’s Alliance held weekly Wednesday-morning protests outside the Juanita Kidd Stout Center for Criminal Justice. Organizer Kurt Evans said Brinkley had handed out “a lot of blind justice” and that “her superiors see the miscarriage of justice here.”16Billy Penn. What the Case Changed
Mill co-founded the REFORM Alliance, a nonprofit focused on probation and parole law, with backing from Michael Rubin and Jay-Z.21REFORM Alliance. It limits when courts can imprison people for technical probation violations, caps incarceration for such violations at 14 days for a first offense and 30 days for a second, and establishes a presumption that misdemeanor probation should end after two years and felony probation after four.22WHYY.
