Ghislaine Maxwell Arrest: Charges, Verdict, and Appeals

The FBI arrested Ghislaine Maxwell on July 2, 2020, at a secluded estate in Bradford, New Hampshire, on a federal indictment charging her with helping Jeffrey Epstein recruit and sexually abuse underage girls. She was convicted at trial in December 2021 on five counts, including sex trafficking of a minor, and sentenced in June 2022 to 20 years in federal prison. Her appeals have failed, and she is currently held at a minimum-security prison camp in Texas.

How the FBI Found Her

Agents moved on a 156-acre property in Bradford, New Hampshire, at about 8:30 a.m. on July 2, 2020, acting on a six-count grand jury indictment returned in Manhattan federal court three days earlier.¹² They broke through a locked gate, announced themselves at the front door, and watched through a window as Maxwell ignored their commands and retreated to another room, shutting the door behind her. Agents forced their way in to complete the arrest.³

A search of the house turned up a cellphone wrapped in tin foil sitting on a desk. Prosecutors called it a “misguided effort to evade detection.”⁴ The property had been bought in December 2019 for roughly $1.07 million in cash through an LLC called Granite Reality, registered to Scott Borgerson, Maxwell’s then-husband.⁵ Maxwell had introduced herself to a local realtor as “Janet Marshall,” saying she was a journalist who valued her privacy.⁶ A security detail of former British military personnel ran her errands and did the food shopping on a credit card tied to the LLC; she did not leave the property.

William F. Sweeney Jr., then head of the FBI’s New York Field Office, said agents had been “discreetly keeping tabs on Maxwell’s whereabouts” and that she had “slithered away to a gorgeous property in New Hampshire.”² Prosecutors described her as an “extreme flight risk” who had spent roughly a year in hiding, switching phone numbers, changing email addresses, and using different names on shipping labels.¹

The Charges

The original indictment, filed in the U.S. District Court for the Southern District of New York as Case No. 20 Cr. 330, carried six counts: enticement of a minor to travel to engage in illegal sex acts, conspiracy to transport minors with intent to engage in criminal sexual activity, transportation of a minor with intent to engage in criminal sexual activity, and two counts of perjury.⁷

A superseding indictment returned on March 29, 2021, added a fourth alleged victim, extended the charged conduct to cover 1994 through 2004, and added sex trafficking charges.⁸ The perjury counts were severed for a separate trial on April 16, 2021.⁹ Maxwell pleaded not guilty to all eight counts.

Held Without Bail

Maxwell was booked into the Metropolitan Detention Center in Brooklyn and stayed there through trial.¹⁰¹¹¹² On April 27, 2021, a Second Circuit panel affirmed the detention orders, rejecting Maxwell’s offers to renounce her French and British citizenship and place her assets under a retired judge’s supervision.

Her lawyers said in an April 2021 filing that she was being held in conditions equivalent to solitary confinement, with inadequate food, constant overhead lighting, and guards shining flashlights into her eyes every 15 minutes to check that she was breathing. The checks were driven by institutional anxiety over Epstein’s 2019 death in federal custody, which officials were determined not to see repeated.¹⁰

The Trial and Verdict

Trial began on November 29, 2021, before Judge Nathan in the Southern District of New York.¹³ Prosecutors called 24 witnesses over 10 days; the defense called nine over two days.¹⁴

Four women testified about abuse spanning roughly a decade. A woman using the pseudonym “Jane” said she was first approached by Maxwell and Epstein at a summer arts camp in 1994, when she was 14, and was abused about every other week over the next two years; she said Maxwell sometimes touched her or Epstein during sexual acts.¹⁵¹⁶ “Carolyn” testified that she first visited Epstein’s mansion in 2001, at age 14, that Maxwell touched her breasts and told her she had “a great body for Epstein and his friends,” and that she went back more than 100 times, paid $300 each visit, until she became “too old.” Annie Farmer, the only accuser to use her full name, said that at 16 in 1996, Maxwell gave her a massage at Epstein’s New Mexico ranch, pulled down the sheet, and rubbed her naked chest. A fourth woman, “Kate,” said Maxwell arranged sexual meetings with Epstein after they met when Kate was 17.

Prosecutor Lara Pomerantz described Maxwell and Epstein as “partners in crime,” casting Maxwell as an active recruiter who used her gender and social standing to gain trust before funneling girls to Epstein. Defense attorney Bobbi Sternheim argued that Maxwell was a “convenient stand-in” for Epstein, who could not be tried after his 2019 death, and that accusers’ memories had been distorted by time.¹⁷

A jury of six women and six men deliberated about 40 hours over six days and returned its verdict on December 29, 2021. Maxwell was convicted on five of six counts: sex trafficking of a minor, transporting a minor with intent to engage in criminal sexual activity, and three conspiracy charges. She was acquitted on one count of enticement of a minor to travel to engage in illegal sex acts.¹³¹⁴

The Juror Problem

Within days of the verdict, a juror identified as Scotty David told reporters he was a survivor of childhood sexual abuse and had shared that experience with fellow jurors during deliberations. The screening questionnaire had asked whether potential jurors or their family members had been victims of sexual harassment, abuse, or assault, and he had checked “No.”¹⁸

Maxwell’s lawyers moved for a new trial. At an evidentiary hearing on March 8, 2022, David, granted immunity, testified that the omission was an “honest mistake,” saying he had rushed through the questionnaire while preoccupied with a recent breakup.¹⁹ Judge Nathan denied the motion, finding the omission inadvertent rather than deliberate and the juror not biased.²⁰

20 Years in Prison

Judge Nathan sentenced Maxwell on June 28, 2022, to 20 years in federal prison, a $750,000 fine, and five years of supervised release.²¹ The judge called Maxwell’s conduct “heinous and predatory,” saying she had “worked with Epstein to select young victims who were vulnerable and played a pivotal role in facilitating sexual abuse,” and noted that Maxwell’s statement to the court did not include an expression of personal responsibility.²²

Several victims addressed the court. Virginia Giuffre told Maxwell, “Together, you damaged me physically, mentally, sexually, and emotionally. For me, and for so many others, you opened the door to hell.”²² Annie Farmer described a lasting “loss of trust in myself, my perceptions, and my instincts,” and later called Maxwell’s courtroom statement a “very hollow apology.”²¹ Sarah Ransome said the abuse had driven her to alcoholism and two suicide attempts.

Appeals and the Habeas Petition

Maxwell raised five issues on appeal. Her central argument was that a 2007 non-prosecution agreement between Epstein and the U.S. Attorney’s Office in Miami shielded her from prosecution in a different federal district. She also challenged the statute of limitations, the denial of a new trial over the juror issue, an alleged constructive amendment of the indictment tied to a jury-note response, and the procedural reasonableness of her sentence.²³

On September 17, 2024, a Second Circuit panel rejected every argument and affirmed the conviction and sentence, holding that the Florida agreement did not bind the Southern District of New York, that the indictment complied with the statute of limitations, that the juror’s inaccurate questionnaire responses were inadvertent, and that the 20-year sentence was “procedurally reasonable.”²⁴ The U.S. Supreme Court declined to hear the case on October 6, 2025.²⁵

Maxwell filed a pro se habeas corpus petition in the Southern District of New York on December 17, 2025, seeking to vacate her conviction based on what she called “substantial new evidence” of juror misconduct, collusion between the government and victims’ attorneys, and due-process violations tied to withheld exculpatory information.²⁶ The petition remained pending as of early 2026.²⁷

Where She Is Now

Maxwell is held at the Federal Prison Camp in Bryan, Texas, a minimum-security facility. She was moved there from a low-security prison in Tallahassee, Florida, in August 2025, days after two days of recorded proffer sessions with Deputy Attorney General Todd Blanche.²⁸ Under Bureau of Prisons policy, convicted sex offenders are generally ineligible for minimum-security camps without a special waiver.²⁹

The proffer sessions operated under a limited immunity agreement: the government could not use her statements against her directly but reserved the right to prosecute her for false statements and to use the information for impeachment. Blanche was explicit that these were not a cooperation agreement, telling her, “I’m not promising to do anything.”³⁰ Maxwell said President Trump “was never inappropriate with anybody” in her presence and said she was unaware of inappropriate activity involving figures like Bill Gates, Chris Tucker, or Kevin Spacey. The Justice Department released redacted transcripts and audio in August 2025.³¹

The placement at FPC Bryan has drawn scrutiny. Representative Jamie Raskin wrote the warden in October 2025 citing whistleblower reports of preferential treatment, including meals delivered to Maxwell’s dormitory, special visitor accommodations, and late-night workout access.²⁹³²³³

In a February 2026 virtual deposition before the House Oversight Committee, Maxwell invoked the Fifth Amendment while her attorney publicly said she would “clear” both President Trump and former President Clinton of wrongdoing regarding Epstein if granted clemency.³⁴ Attorney David Oscar Markus told Politico in July 2025, “There’s a good chance and for good reason that she would get a pardon.” Trump said at the time that “nobody’s approached me with it” formally and called it “inappropriate to talk about.” House Speaker Mike Johnson has expressed opposition, and House Oversight Chair James Comer said, “I think it looks bad.”³⁵ As of spring 2026, reporting indicates clemency remains unlikely.³⁶
