Goodles Lawsuit: Recall, Refunds, and Class Action Prospects

No Goodles lawsuit has been filed as of early 2026 over the September 2025 recall of two Goodles mac and cheese varieties, though at least one plaintiffs’ firm is publicly soliciting consumers who had allergic reactions. For now, the only remedy Gooder Foods, Inc. offers is a refund: return the product to the store where you bought it. Medical bills and other damages are not covered by the recall itself.

Which Products Are Recalled

Gooder Foods announced the voluntary recall on September 10, 2025, and the FDA posted its alert the next day.1U.S. Food & Drug Administration. Gooder Foods Issues Allergy Alert on Undeclared Milk and Cashews in Goodles Products Two products are covered:

  • Vegan Is Believin’ (Plant Based White Cheddar with Spirals), lots 09725N, 09825N, 09925N, 10025N, and 10125N, which contained undeclared milk despite being sold as plant-based.
  • Here Comes Truffle (Creamy Truffle Flavored Cheddar and Shells), lots 10125N, 10425N, and 10525N, which contained undeclared cashews.2U.S. News & World Report. Goodles Mac Cheese Recalled Due to Hidden Allergen Risk

What Has Been Reported

Gooder Foods reported eight allergic reactions linked to the recalled products: six tied to Here Comes Truffle and two to Vegan Is Believin’.1U.S. Food & Drug Administration. The contamination was flagged by consumer feedback, not by internal testing.3USA Today. Boxed Mac and Cheese Recall FDA The recall came more than four months after the first affected boxes shipped in late April.

Gooder Foods has not publicly explained how the allergens ended up in the products. In a statement to SFGATE, the company said that “effective immediately, all Truffle production has moved to a tree nut-free facility, and we are no longer producing any dairy-based mac and cheeses at the same facility that makes our vegan products.”5SFGATE. How to Get a Refund

Consumers with an affected box can return it to the store where they bought it for a full refund.6Goodles. What a Lawsuit Would Look Like

No suit has been filed against Gooder Foods over the recall.7Top Class Actions. Gooder Foods Recalls Pasta Due to Undeclared Allergens The plaintiffs’ firm Parker Waichman LLP has publicly solicited consumers who had allergic reactions, describing potential claims under strict liability, negligence, failure to warn, breach of warranty, and wrongful death. The firm has said affected consumers could seek medical expenses, lost wages, pain and suffering, and punitive damages.

Whether personal injury litigation actually materializes will likely depend on whether any of the eight reported reactions required serious medical treatment. Food allergen cases often settle when causation is clear, because the tie between eating the food and the reaction is usually direct. For comparison, a Massachusetts jury in 2024 awarded a family roughly $220,000 after a restaurant served a child a peanut-containing burrito despite a noted allergy.8Allergic Living. Class Action Prospects

Even without serious injuries, the recall could draw a consumer class action of the type that has become common after food recalls. A 2024 analysis found plaintiffs’ firms routinely filing suits arguing that companies charged premium prices for contaminated or mislabeled products, and seeking refunds of the purchase price, consumer fraud penalties, and attorneys’ fees. Undeclared allergens drove roughly 180 of 491 food recalls in 2024.9Food Safety Magazine. Widening Recalls and Class Action Lawsuits Alarming Recall Trends

Recent appellate rulings have made these cases harder to bring, though. In 2024, the Seventh Circuit rejected a “benefit of the bargain” standing theory in the Abbott infant formula litigation, holding that plaintiffs who couldn’t show their specific product was contaminated had only hypothetical injuries. The Third Circuit reached a similar conclusion, ruling that a recall announcement alone doesn’t establish that any particular plaintiff’s product was defective.10Crowell & Moring LLP. Recall Litigation Report Trends in 2024 Continue Into 2025 A Goodles class action would likely require plaintiffs to show they bought one of the specific recalled lots, not just the product line.

The Labeling Law Behind Any Claim

Any claim would rest on the Food Allergen Labeling and Consumer Protection Act of 2004, or FALCPA, which requires packaged-food makers to clearly identify any of the nine major food allergens on the label: milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soybeans, and sesame.11U.S. Food & Drug Administration. Food Allergen Labeling and Consumer Protection Act of 2004 Products that fail to disclose these allergens are misbranded under federal law, and the FDA can pursue inspections, warning letters, seizures, and recalls.12U.S. Food & Drug Administration. Food Allergies Milk and cashews both sit squarely within FALCPA, so the mislabeling is a straightforward regulatory violation whether it came from cross-contact on the line or a packaging error.

If You Had a Reaction

Keep the box, the receipt, and any medical records tied to the reaction. Those three items are what a lawyer will ask for first if a case is later filed, and they are also what would put you inside any eventual class defined by purchase of the specific recalled lots. A refund from the store does not release any personal injury claim you may have.
