Google Assistant Settlement: Who Qualifies, Payouts, and Deadlines

The Google Assistant settlement is a $68 million class action resolution covering people in the U.S. whose Google Assistant devices may have recorded them without being intentionally activated, or who bought a qualifying Google device, between May 18, 2016 and March 19, 2026. If you qualify, you can file a claim online at GoogleAssistantPrivacyLitigation.com or by mail. The deadline is August 27, 2026.¹²

The court granted preliminary approval on March 19, 2026. Final approval is still pending, and no payments have gone out yet.³

Who Qualifies

The settlement has two classes, and you can belong to one or both. The class period runs from May 18, 2016 through March 19, 2026.²

The Purchaser Settlement Class covers U.S. residents whose Google account was linked to a Google Assistant-enabled device and who bought a qualifying Google-made device during the class period. Qualifying devices include Google Home, Home Mini, Home Max, Nest Hub, Nest Hub Max, and Pixel smartphones. Proof of purchase is required, and claims cover up to three devices.²

The Privacy Settlement Class covers users of Google Assistant, and members of a user’s household, whose conversations were recorded because of a “False Accept” (the device activating without anyone saying “Okay Google”) or shared with a third-party review vendor during the class period. No proof of purchase is needed. You have to attest to a good-faith belief that your communications were recorded that way.²

Children can be included, but each person needs their own claim form, and claims for minors must be filed by a parent or legal guardian.²

How to File a Claim

Claims can be submitted online at GoogleAssistantPrivacyLitigation.com or by mail. Many eligible class members received an email with a unique ID and PIN that speeds up the online form. If you didn’t get that email but believe you qualify, you can still file directly on the settlement website.⁴

For the Purchaser Class, have receipts, order confirmations, or other proof of purchase ready for each device you’re claiming (up to three). For the Privacy Class, the form asks you to confirm your good-faith belief that your communications were recorded through a False Accept or shared with a review vendor during the class period.²

The August 27, 2026 deadline is also the last day to request exclusion from the settlement or file an objection.¹

How Much You Could Get

Payouts are calculated on a point system. Purchaser Class members get four points per eligible device, up to three devices. Privacy Class members get one point per person. The dollar value of a point depends on how many valid claims come in.⁵

Estimated payments run about $18 to $56 per device for purchasers and $2 to $10 for privacy-only claimants, depending on participation.¹

Those numbers come after deductions from the $68 million fund. Plaintiffs’ counsel will ask the court for up to one-third of the fund in attorneys’ fees (about $22.7 million), up to $1.6 million in litigation expenses, service awards of up to $10,000 per named plaintiff, and administration costs, taxes, and escrow fees. The fund is non-reversionary, so none of it goes back to Google. What’s left after distribution may fund a second round of payments or, if that isn’t feasible, go to a court-approved nonprofit.⁶

Key Dates and When Payments Arrive

August 27, 2026: Deadline to file a claim, request exclusion, or object.¹
October 1, 2026: Final approval (fairness) hearing.³

Payments will only be issued after the court grants final approval and any appeals are resolved. If final approval is granted and no appeals follow, payments would be expected roughly 90 days after appeals are exhausted.⁷⁵

What the Lawsuit Was About

The case, In re Google Assistant Privacy Litigation, was filed in July 2019 in the U.S. District Court for the Northern District of California. Plaintiffs alleged that Google Assistant devices experienced “False Accepts” — activating on ambient sounds or words that resembled “Okay Google” — and that Google collected, stored, and used those recordings to train its speech-recognition technology. They also alleged that some recordings were shared with third-party vendors who reviewed audio as part of a human quality-assurance program.⁸³

One family named as plaintiffs described a private disciplinary conversation on September 17, 2018 that they said was recorded without a wake word, and claimed products discussed then appeared later in ads on non-Google platforms such as Instagram.⁹

Judge Beth Labson Freeman found that users have a “reasonable expectation of privacy” that could be violated if conversations are recorded without activation and used for targeted advertising.⁹ Google denied all allegations and did not admit any wrongdoing. The company said it agreed to settle to avoid the costs and risks of further litigation.³
