The core allegation targeted GreenPan’s “0% Toxins” and “COMPLETELY TOXIN FREE” slogans. The complaint pointed to the Thermolon coating’s own U.S. patent filings, which it said listed silane, aluminum oxide, tetraethoxysilane, methyltrimethoxysilane, and potassium titanate. Other marketing language also came under fire. The complaint alleged that GreenPan’s pans marketed as “reinforced with diamonds” contained no meaningful amount of diamonds or diamond fragments. It said the broad “good for the environment” claim was unqualified and violated the Federal Trade Commission’s Green Guides. How the Case Was Resolved
The lawsuit never reached trial or class certification. On December 15, 2020, the parties filed a joint stipulation to dismiss. According to that filing, they reached an individual settlement after informal discovery and after The Cookware Company signaled it would move for summary judgment on standing and failure-to-state-a-claim grounds.6ClassAction.org. Saldivar’s individual claims were dismissed with prejudice, meaning she cannot refile them. The claims of absent putative class members were dismissed without prejudice, which leaves other consumers free to bring similar claims. The Dispute Over What’s Actually in Thermolon
Much of the case turned on the composition of GreenPan’s proprietary Thermolon coating. The company describes it as a ceramic nonstick surface made through a sol-gel process, with silicon dioxide from sand as the primary ingredient. GreenPan states the coating is free of PFAS (including PTFE and PFOA), silanes, aluminum oxide, potassium titanate, titanium dioxide nanoparticles, BPA, lead, cadmium, mercury, and antimony, and that accredited third-party labs have tested it up to 850°F without toxic fumes.8GreenPan. Saldivar’s approach was to bypass the marketing and read the patents. Independent testing has cut in different directions. A 2020 Ecology Center study of a GreenPan product found no PTFE and no detectable PFOA, with the coating consisting primarily of silicon dioxide, but the study did not test for the specific chemicals named in the complaint.10LeafScore. The 2012 NAD Ruling the Complaint Leaned On
Saldivar’s lawsuit built on an earlier round of scrutiny. In November 2012, the National Advertising Division of the Better Business Bureau reviewed GreenPan’s marketing after a challenge from DuPont, then a maker of competing PTFE nonstick coatings.13E&E News. The Cookware Company faced a parallel class action over a different brand around the same time.
