The girl and her parents are asking for more than $50,000 in damages. The Florida Law Behind the Claim
Florida allows private hosts to be sued civilly when they give alcohol to minors. Under Florida Statute 768.125, a person who “willfully and unlawfully” furnishes alcohol to someone under the legal drinking age can be held liable for resulting injuries.7Florida Legislature. Florida Statute 768.125
Florida’s Open House Party statute adds a second route. A plaintiff generally has to show that a party took place where alcohol was served, that the defendant controlled the residence, that underage guests drank, that the host knew about the drinking, and that the host failed to take reasonable steps to stop it.
