GS Labs Pandemic Settlement: Claims, Payouts, and Eligibility

The GS Labs settlement is a $4.87 million agreement announced June 10, 2026, resolving claims by 18 state attorneys general that the COVID-19 testing company overcharged patients, tacked on hidden administrative fees, and failed to deliver results within its promised three-day window. About $3.6 million of that will go directly to affected consumers, and eligible patients can file a claim through an online portal the company is funding at www.gslabstesting.com.¹

Who Qualifies for Restitution

Three groups of former GS Labs customers are eligible for money under the settlement:

Cash-paying patients who were charged well above market rates. GS Labs advertised cash prices as high as $380 for a single rapid test and close to $1,000 for multi-panel tests, and roughly 30,000 out-of-pocket patients paid inflated amounts.²
Insured patients who were charged administrative fees up to $49 per test despite marketing that said they would owe nothing. About 70,000 patients were hit with those fees.³
Patients whose results took longer than the three days GS Labs guaranteed.²

The conduct at issue ran from 2020 through 2022, when GS Labs operated at least 75 testing sites across 21 states.

How Much Money You Can Get

The consumer portion of the settlement, $3,628,718, is divided among the three claim types: $1,843,376 for cash-paying patients who were overcharged, $1,749,568 for patients hit with administrative fees, and $33,692 for patients who did not receive results within three days.⁴ The remaining $1.25 million goes to the states for investigative costs and attorney fees.²

Individual payments vary by state and by the type of charge you paid. Washington, for example, has allocated about $987,000 to its residents, with individual payments running from $5 to $200.³ Iowa’s total consumer allocation is $654,335, broken into $430,314 for administrative fee refunds, $59,589 for cash-patient overcharges, and $1,752 for late-result refunds. Nebraska is set to receive nearly $1.5 million in combined consumer restitution and its share of the state payout.⁵

Restitution is available to consumers in the 18 states that joined the case: Kansas, Minnesota, Nebraska, and Washington led the negotiations, joined by Alabama, Arizona, Colorado, Illinois, Indiana, Iowa, Massachusetts, Missouri, New Jersey, North Dakota, Ohio, Oregon, Pennsylvania, and South Dakota.²

How to File a Claim

GS Labs is funding and administering the claims process itself through www.gslabstesting.com. Eligible consumers complete a verification process on the site and then receive payment. The company has also been contacting affected patients directly by email.¹

No hard filing deadline has been published, but the Washington Attorney General’s office has urged consumers to submit claims quickly because payments are being distributed on a rolling basis.³ There is a firm outer limit built into the deal itself: any restitution money still unclaimed one year after the agreement was entered goes to the participating states rather than to consumers.⁶

What the States Accused GS Labs Of

The multistate investigation found that GS Labs’ advertised cash prices were intentionally inflated so the company could justify higher charges to insurers. Before the company lowered its prices in January 2022, a single PCR test could cost as much as $979.⁷ Blue Cross and Blue Shield of Kansas City described the pricing as roughly 75 times the wholesale cost of a rapid antigen test.⁸

On results, the states alleged GS Labs regularly missed its three-day guarantee, sometimes by a week or more. During the Omicron surge, one Minnesota site reportedly held a backlog of nearly 28,000 undelivered results, some up to five weeks old.⁷

What GS Labs Must Do Going Forward

GS Labs has told the states it is no longer operational, but the settlement, an Assurance of Discontinuance filed in Ramsey County District Court in Minnesota, binds the company if it ever resumes testing. It must stop charging administrative fees, disclose actual cash prices and turnaround times in its marketing, issue full refunds when results are late, and refrain from unjustified price increases during declared emergencies. Breaking those terms would void the release of claims and open the company to further civil penalties.⁶

GS Labs denied the allegations and said it agreed to the settlement to resolve the matter rather than because the claims had merit.⁵
