Harold Henthorn Now: Prison, Failed Appeals, and His Daughter

Harold Henthorn is now serving a mandatory life sentence without the possibility of parole in federal prison for the 2012 first-degree murder of his second wife, Dr. Toni Henthorn, whom he pushed from a cliff in Rocky Mountain National Park. He has exhausted every avenue of appeal available to him, and his daughter, Haley, now goes by her mother’s maiden name and gave her first public interview in February 2025.1ABC News. Where Henthorn Is Today

Henthorn was sentenced on December 8, 2015, by U.S. District Judge R. Brooke Jackson to life in federal prison without the possibility of parole, the mandatory sentence for first-degree murder committed on federal land.2The Denver Post. There is no parole in the federal system for this offense, and no post-conviction filing has succeeded in disturbing the sentence.

Every Appeal Has Failed

Henthorn’s direct appeal went to the Tenth Circuit Court of Appeals, where he argued that the trial court should not have allowed the jury to hear about the 1995 death of his first wife or a 2011 incident in which a wooden beam struck Toni at the couple’s cabin. On July 26, 2017, the Tenth Circuit affirmed his conviction. The court found the prior incidents “extraordinarily similar” to the charged offense: each occurred in a remote location, each had Harold as the sole witness, each was followed by inconsistent accounts, and each followed the acquisition of substantial life insurance. The Ineffective-Counsel Motion

In January 2019, Henthorn filed a pro se motion under 28 U.S.C. § 2255 to vacate his sentence, accusing his trial attorney, Craig Truman, of ineffective assistance. He claimed he paid Truman $1,064,772 and that Truman “never prepared any actual defense at all.” Among the accusations was a claim that Truman handed him a broken pen at trial so he could not take notes or participate in his own defense.5CBS News Colorado. Appointed counsel later filed a supplemental motion listing twelve categories of alleged deficiencies. Judge Jackson held a three-day evidentiary hearing in May 2022 and denied the motion on June 23, 2022. The court credited Truman’s testimony and described his trial decisions as “adequately informed strategic choices” that deserved deference. Jackson called Henthorn’s claim that his lawyer had “sold him down the river” “incredible” and lacking “any semblance of merit,” and added that even if performance had been deficient, there was no “reasonable probability that the outcome would have been different.”6GovInfo. Henthorn asked the Tenth Circuit for a certificate of appealability. On September 5, 2023, the court denied it and dismissed the matter, agreeing that reasonable jurists would not debate Judge Jackson’s findings.8Law Week Colorado. His Daughter’s Life Since

Haley Henthorn was nine when her mother died and twelve when her father was sentenced. During the two years between Toni’s death and Harold’s 2014 arrest, Harold monitored his daughter through a baby monitor, required his permission for basic activities, told her not to cry in public because “people would be watching,” and coached her to describe her mother as “clumsy.”10The Denver Post. On December 23, 2015, a Denver court granted permanent guardianship of Haley to her maternal uncle, Barry Bertolet, and his wife, Paula. The family moved to Mississippi. Her guardian ad litem reported that Haley had stopped calling Harold her father and was referring to him as “Mr. Henthorn.” She was later formally adopted by the Bertolets and now uses her mother’s maiden name.10The Denver Post. On February 28, 2025, Haley gave her first public interview, on ABC’s 20/20. She called her mother “amazing,” “so intelligent,” and “so wise and eloquent.” Of her father, she said she has forgiven him: “Not for his sake, but for mine. So that I know that I’m freed from him, from his control, that I’m my own person.” Paula Bertolet told the program that when Haley first came to live with them, she was “almost afraid to do anything without permission” and “hungry for a loving parent.”1ABC News. The First Wife’s Death Remains Officially Unresolved

Toni was not the first of Harold’s wives to die in his presence. On May 6, 1995, his first wife, Sandra Lynn Henthorn, was crushed beneath the couple’s Jeep Cherokee on a remote stretch of Highway 67 near Sedalia, Colorado. Harold told authorities a vehicle jack had toppled while Lynn was under the car changing a tire. He was the only witness. The Douglas County coroner ruled the death an accident.12The Denver Post. After Toni’s death, the Douglas County Sheriff’s Office reopened the 1995 case on October 12, 2012, citing “extraordinary circumstances.” In December 2014, Douglas County Coroner Lora Thomas officially changed the manner of death on Lynn’s death certificate from “accident” to “undetermined.”13CBS News Colorado. How the Case Was Built

For readers coming to this story fresh, the conviction rested on a wholly circumstantial record. Toni fell about 140 feet from a cliff ledge in Rocky Mountain National Park on September 29, 2012, the couple’s twelfth wedding anniversary. Harold was the only witness and, within 48 hours, gave Toni’s brother at least three different accounts of what happened.15CBS News. The Accidental Husband

Investigators found that Harold had visited the specific area of the fall at least eight or nine times in the six weeks before Toni’s death, and they recovered a park map from his Jeep with a pink “X” hand-drawn at the exact location where she fell.15CBS News. A decade on, the conviction stands, the appeals are done, and the child at the center of the story is an adult living under a different name.
